PREMIER WOODS CARD ANNUAL AGREEMENT

(Valid May 1, 2014 – April 30, 2015)

The purchase of a Premier Woods Card Annual Agreement at a cost of $132.00 + tax (ie. $140.60) entitles the owner of the card to the following benefits:

To play golf on World Woods Championship Courses, Pine Barrens and Rolling Oaks, and The Short Course at the rates shown below, and to utilize all facilities at World Woods Golf Club on the days of play, including the restaurant and pro shop, at the applicable fees associated with such amenities, and with payment made when services are rendered. World Woods is a spikeless facility. Championship prices shown below are per person for 18 holes including cart fee, greens fee.

  • May 1, 2014 through October 31, 2014$26.00 + tax
  • November 1, 2014 through December 31, 2014$32.00 + tax
  • January 1, 2015 through April 30, 2015$40.00 + tax
  • Short Course $10.00 + tax with golf car (based on availability)

$ 5.00 + tax walking

The Premier Woods Annual Card is available to residents of Florida with a valid Florida Driver’s license (no ID cards accepted), is not transferable, and only the owner of the card (Applicant) is eligible for the above listed benefits of the card.

The undersigned Applicant agrees to notify the Company immediately in writing of any change in the information contained in this application.

The undersigned Applicant hereby applies for a Premier Woods Annual Card, which Applicant understands does not convey membership rights in World Woods Golf Club, but grants only a temporary license for limited-use privileges as described in this Application. All such privileges granted are given expressly, subject to the Club’s Rules, which are expressly incorporated herein by this reference (collectively, the “Club Rules”), and upon the following additional terms and conditions:

SCHEDULE OF PAYMENT: Subject to approval of this application for the Premier Woods Annual Card (the Card) by World Woods Corporation (the Company), the undersigned prospective Applicant agrees to pay for the card in full at the time of application and for all services rendered at the time of service. Advance tee times may require a credit card; adequate cancellation must be given or the full greens fee will be collected. Applicant further agrees that failure to use the club facilities will not relieve the undersigned Applicant from the obligation to pay all fees, deposits, costs, taxes and other expenses owed to the Company pursuant to the purchase of the Card.

CONSUMER’S RIGHT OF CANCELLATION: THE UNDERSIGNED APPLICANT MAY CANCEL THIS APPLICATION WITHOUT PENALTY OR OBLIGATION WITHIN THREE (3) DAYS, EXCLUSIVE OF HOLIDAYS AND WEEKENDS, FROM THE DATE OF SUBMITTAL TO THE COMPANY (PROVIDED THAT APPLICANT HAS NOT ALREADY USED THE FACILITIES PURSUANT TO THE CARD AGREEMENT). UPON RECEIPT OF SUCH WRITTEN NOTICE, THE COMPANY WILL PROVIDE A REFUND (LESS A $25 PROCESSING FEE) OF ALL MONIES PAID PURSUANT TO THIS APPLICATION.

I acknowledge reading page one and page two of this application and agree to be bound by all matters stated or referenced in this application and otherwise pertaining to the Company.

PREMIER WOODS ANNUAL CARD APPLICATION TERMS AND CONDITIONS

1. Cancellation of Premier Woods Card: The Applicant understands and acknowledges that any card approved by the Company pursuant to this application is valid from May 1, 2014 through April 30, 2015 and may not be cancelled during that period of time except as specifically provided to the contrary in the application and under applicable law. The Company reserves the right to cancel any cards for excessive cancellation of tee times, inappropriate behavior, violations of dress code, or other actions not in the best interest of the Company. NO REFUNDS OR PARTIAL REFUNDS WILL BE ISSUED.

2. Assignment of Application or Premier Woods Card Rights: The Company may assign the Premier Card contract and revenues arising therefrom to any other person or entity and, if so assigned, the Company assignee shall have all of the rights and powers of the Company pertaining to such card. The card, as may be granted by the Company pursuant to this application, is personal to the applicant and cannot be assigned or transferred unless specifically authorized by prior written approval of the Company, and the Company shall have no obligation to any purported assignee or transferee of a card without prior written approval. Any unauthorized transfer of the card will result in the immediate termination of the card’s benefits to the applicant by the Company.

3. Other Agreement: The terms and conditions of this application, the Club Rules (including, without limitation, rules and regulations posted by the Company at the facilities) governing the benefits and obligations of applicants constitute the entire and exclusive agreement between the parties to this application, and all promises and representations made prior to its execution are superseded by this application. Any promises, representations, understandings or other agreements pertaining directly or indirectly to any applicant that are not specifically stated or referenced herein are hereby waived by the parties hereto. Any modification of application must be in writing and signed by the parties hereto.

4. Condition of Applicant and Use of Facilities: The applicant warrants, represents, and agrees that each applicant is in good physical condition with no disability, impairment or ailment precluding the applicant from engaging in active or passive exercise or that will be detrimental to the applicant’s health, safety, comfort or physical condition, if the applicant does engage in such exercise. The applicant acknowledges that, in exercising or using the facilities (including parking lot) the undersigned does so at the applicant’s own risk. The applicant agrees that the Company shall not be liable for any claims, demands, injuries, suits, actions or causes of action whatsoever to the person or property of the undersigned arising out of, or connected with the use of any of the club facility’s services to which the applicant may be entitled and the applicant does hereby fully and forever release and discharge the Company, its owners, employees and agents from any and all claims, demands, injuries, suits, damages, actions, or causes of action whatsoever resulting from or arising out of the applicant’s use or intended use of such Club facilities. THE APPLICANT UNDERSTANDS AND AGREES THAT ALL WARRANTIES, EXPRESS OR IMPLIED ARE HEREBY DISCLAIMED BY THE COMPANY, INCLUDING WITHOUT LIMITATION ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IN CONNECTION WITH ANY USE OF THE FACILITIES (INCLUDING WITHOUT LIMITATION, ALL PARKING AREAS)

5. Attorney’s Fees: The applicant agrees to pay the Company’s costs and attorney and paralegal fees, including without limitation, all such fees and costs incurred in the trial court and on all appeals, in the event it becomes necessary for the Company to enforce any of the terms and conditions of the agreement made between the parties hereto directly and indirectly pertaining to application for, or issuance by the Company of said card.

6. Lost Cards: The Company is not responsible for any misplaced, lost or stolen cards.

7. Facility hours: The applicant understands that the facility's hours of operation are subject to change without notice and may close temporarily due to facility maintenance, capacity, inclement weather or special events. The Club is not responsible for full or partial refunds and/or other compensation or considerations for the cost of the card in the event that the facility is temporarily closed during the timeframe of this card.

8. Identification: The applicant understands that photo identification is required at the time of registration for all facility services.

9. Tee Times: The applicant understands that tee times may be obtained no more than four days (i.e. 96 hours) in advance. The applicant further understands that any tee time made in advance of 96 hours will be paid for at the regularly listed price. Attempts made to “hold” or “block” tee times more than 96 hours in advance, at the Premier Woods Card rate, will result in the immediate termination of the card’s benefits to the applicant by the Company. The names and Premier Woods Card numbers of all players in your group must be provided when a reservation is made to avoid overbooking and those that do not cancel unneeded tee times 24 hours in advance may be subject to a cancellation fee or “additional restrictions” when making future tee times. The applicant further understands that the Company does not guarantee the availability of tee times and that no such warranty is implied.
