RESOLUTIONS

1.WAGE REVISION OF NON-EXECUTIVES:

The 3rd PRC has released its recommendations for revision of pay scales of Executives and Non-Unionized Supervisors and the same has been accepted by the Cabinet. Accordingly the BSNL Board has revised the pay scales of BSNL Executives and sent to DOT for clearance.

The pay scales of Non-Executives are to be revised by the joint committee of BSNL Management and the recognized Unions of BSNL.The CMD has accordingly formed a committee on 26.12.2016 with five official side members.But the recognized representatives Union have failed to nominate the member of staff side even after the lapse of more than a year.This shows their disinterest for the revision of pay scales of Non-Executives and the delay in revision of pay scales results in labour Unrest in the BSNL.

We therefore request the BSNL Management to complete the process of constitution of the joint committee by Nominating the General Secretaries of all applicant Unions to start Wage negotiation for revision of pay scales of Non-Executives of BSNL without any further delay.

2.ON TOWER CORPORATION :

The circle conference of this Union resolves to request the Government and the BSNL Management to ensure that the revenue and the expenditure of the proposed tower corporation,Which is stated to be a subsidiary to BSNL are incorporated in the balance sheet of BSNL by a proper agreement with the Unions.The H M(C) in his reply to a question on the formation of Tower corporation has replied in parliament ,that the Union and Associations of BSNL have not Opposed the formation whereas these Unions are deliberately misleading the BSNL Workers and the Officers to go on strike opposing the formation of Tower corporation.We strongly condemn the duel roll of theUnions particularly the recognized representative Union and Associations to create industrial Unrest in BSNL.This conference therefore Urges the BSNL and the DOT to ensure the incorporation of the Accounts of subsidiary tower corporation with that of BSNL If at all the formation of the subsidiary Tower corporation is not rolled back.

3.ON REDUCTION OF RETIREMENT AGE.

Despite the repeated statements from the CMD BSNL,The recognized Unions and Associations are making false propaganda that the retirement age of the BSNL employees and Executives are to be revised as 58 from 60.As per the terms and conditions for absorption in BSNL,The age of superannuation of the BSNL absorbed DOT employees will be as per Govt. Orders which is 60.

This false propaganda of the Unions without any basics have been rejected by the BSNL Management repeatedly.

This conference therefore request the BSNL and the DOT to declare that the age of superannuation of BSNL employees remain as sixty and not 58 as claimed by the Unions to restorepeace in the industry.

4. ON NEPP

The present promotion/Upgradation of pay scales policy under NEPP is totally against the interest of the BSNL Non-Executive employees.This scheme should be scrapped totally to have a relook with that of the time bound promotions already exercised prior to this NEPP policy.

A fresh agreement is needed taking in to account that exercised prior to the introductionof this scheme, so that the BSNL Absorbed DOT employees are not denied the benefits of the promotions that exercised in the old time bound promotions such as OTBP/BCR etc.

5. PENSIONARY BENEFITS FOR AVERAGE EMOLUMENTS:

In the then DOT and the present BSNL the TTA’s were officiating as JTO’s and the Sr Accountants and Part- I passed Sr TOA’S were officiating as JAO’S for years together and were dreaming more pay than that of their substantive pay ofcourse Under provision of FR- 35.

At the time of their superannuation their average emoluments are more that their pay in the substantive Cadre of TTA,SrAcctt,Sr TOA etc.and as per Rule 49 of CCS(PENSION) Rules they should be given the benefits of DCRG,PENSION etc. based on the average emoluments which is more beneficial to them.But the DOT CELL ,T N Circle denying this benefit without any valid reasons. Denial of this benefit which is their legal right is incorrect.

This conference therefore resolves to request the Pr.CCA,DOT CELL T N Circle to have a relook in this matter to revise the pensioners benefits as per the provisions of CCS(Pension) Rules Which is statuary and mandatory. We hope that the Pr.CCA, DOT-CELL,T N Circle will render justice to these retired employees without bios.

6.ON ONE INCREMENT GIVEN TO BCR EMPLOYEES OF RESTRUCTURED CADRE OF Sr.TOA/TTA etc.

The Sr.TOA’s and TTA’s were given one increment in the last year of service if they are not given Grade IV Promotion .In T N Circle most of the above cadre employees were given one increment in lieu of Grade IV Promotion and in fact it was earlier taken in to account for pensioners benefits.But when the pension revision after merger of 78.2% IDA was taken up this one increment benefit was cut down by the DOT Cell and their pension revision for 78.2% IDA is still pending.

It is a fact that this facility was given to BCR Gr III officials of pre restructured cadre when the 10% benefit was not given to re structured cadre.Later this 10% promotion was extended to re structured cadres also.As such denial of this one increment granted in lieu of 10% promotion to the restructured cadre officials is not in order.This conference therefore resolves to urge the CGM and the BSNL corporate office to review this objection of DOT- CELL, T N Circle to revise the pension to these retirees also based on 78.2% IDA.

7.ON CONTRACT LABOURERS:

The Contract Laborers in the BSNL are engaged through the contractors for carrying out the regular nature of workin BSNL against the provisions of Contract Labor regularization and Abolition Act.This practice is not only against the Act but also the wages and other benefits given by the BSNL Management are not reaching the workers in full.In order to ensure that the Contract Laborers are not getting their full entitlements of WAGE,EPF and ESI benefits .We request that they are appointed directly by the BSNL Management through the agency of employment exchanges to avoid exploitation of their wages and other benefits by the contractors who are the middle men. This will ensure full benefit reaches the contract workers without breach.
