TRADING TERMS
This Agreement shall be operative from the date of acceptance of this Agreement.
MARKET STAFF
All site applicants and market related enquiries, issues, disputes or complaints by Stall Holders or Persons applying to be Stall Holders, shall, in the first instance, be directed to the Market Managers by email at:
Any enquiries, issues or disputes shall be in writing.
Where this document refers to the Market Managers it shall also apply to their appointed alternate 3 Peas Markets employees, Volunteers or Delegates.
INSURANCES LICENCES AND REGISTRATIONS
Stall Holders shall provide evidence of Insurance from an approved provider. 3 Peas Markets shall be supplied a copy of such Insurance with their application. The policy shall cover public and product liability to the value of $10,000.000 for general stalls and $20,000,000 for all food stalls. Insurance MUST be kept current at all times. Failing to hold current insurance is deemed a breach of Application which could lead to termination or Application being revoked. Stall Holders shall ensure that their business practices and goods and services comply with all relevant product, safety, business and trade legislation. Stall Holders shall obtain any licenses and registrations required for the sale of their goods and display them as required. Stall Holders selling produce, food or food products shall all food safety requirements and hold local council registration certification. All electrical equipment shall be tagged by an appropriately qualified electrician and should be renewed every 12 months.
All equipment shall be inspected, tested and tagged before use at 3 Peas Markets.
GOODS THAT MAY BE SOLD & PRODUCT CHANGES
Only the goods described and authorised on the 3 Peas Markets Surfest Expression of Interest Form shall be sold from the stall.
The 3 Peas Markets aim to keep a variety of products and a balance of the same & different types of products in the market.. The 3 Peas Markets reserves the right to decide which products are accepted into the market event for the consideration of all stallholders & the local community.
STALL SITES
Whilst all efforts are made to ensure that Stall Holders will receive their given site allocation, The 3 Peas Markets reserve the right to re-allocate sites as necessary.
All Stall Holders are required to provide their own equipment i.e. tables, chairs, Marquee's (white tops/exterior covers required)
Stall Holders shall ensure that all equipment used for their site is safe and secure at all times. Umbrellas, marquees or other materials used to provide shade shall be safely secured in the interests of public safety and to comply with Work Cover Safety requirements.
Due to wind factors at coastal locations marquee’s must be appropriately weighted down with longer ground pegs water weights and/or sand bags for safety reasons. *Market Staff will be inspecting all Stalls on the day. *Weights; Pegs; & Sand Bags/Buckets can be purchased at any camping store. *Table chocks are highly recommend for both events in case of unlevel ground. Walkways and public areas shall be kept clear at all times. Stalls shall stay within site boundaries unless authorised in writing by the Market Manager. Any promotional material shall only be offered within site boundaries.
Sites shall be kept clear of rubbish and shall be left clean and tidy at the end of each Market. Rubbish bins shall not be used for the disposal of Stall Holder’s packaging and/or preparation materials (e.g. cardboard boxes and food preparation scraps) removal and disposal of your rubbish is required. Recycling is encouraged. Stall Holders shall acknowledge that 3 Peas Markets has the right, in its sole discretion, to reduce or re-organise the number and location of sites and to decide what criteria shall be used and which sites shall be terminated or relocated accordingly.
ADVERTISING
Each Stall Holder is required to advertise and promote the events through social media, (facebook & Instagram) and cross-promotion with website.
LOSS AND DAMAGE CLAIMS
3 Peas Markets shall not accept liability for any damages or losses arising, either directly or indirectly, from products sold by Stall Holders.
Stall Holders, by signing their application shall indemnify 3 Peas Markets in relation to all claims for damages or costs whatsoever arising from the provision to them of a site, or the sale by them of any product at that site, whether by the Stall Holder or any person representing the Stall Holder or their product. In the event of any action involving a Stall Holder, their staff or their product, to which 3 Peas Markets is joined as a party to the dispute and/or litigation, the 3 Peas Markets and/or its insurers shall pursue the Stall Holder issuing such litigation or dispute recovery process to recover all costs and expenses incurred by 3 Peas Markets.
RENTAL AND OTHER FEES
Stall fees are made by way of direct deposited or cheque only.
Payments can be made to 3 Peas Markets by direct deposit to Westpac, BSB: 032521 Account Number 262619. Site Fee's can also be accepted by cheque or money order payable to: 3 Peas Markets.
No claim of payment shall be accepted without evidence of an official receipt or transaction record.
ATTENDANCE AND OCCUPATION OF SITES
Stall Holders shall be ready to trade by 8.30am with bump in time from 6.30am. Pack up times shall be at 2pm (Stockton) or 3pm (Merewether) or as varied at the Market Manager’s discretion.
Vehicles shall not be brought into the market trading area except with the Market Manager’s approval.
If a Stall Holder is unable to attend a Market, they shall inform the Market Managers by 9am on the Wednesday preceding the Market day.
Stall Holders shall attend whether or not bad weather conditions prevail. In the event of very bad weather, the Market Managers shall make a decision as to whether the conditions are adverse enough to make attendance voluntarily and shall do so as early as possible on the day in question and advise the Stall Holders via text message, email and the 3 Peas Markets facebook page (https://www.facebook.com/3peasmarkets).
Cancellation of the Market may occur in extreme weather conditions where attendance by Stall Holders, staff and the public may put any party in danger. This decision shall be made at the Market Managers discretion. No Credits or refunds will be given in this circumstance.
No refunds will be issued for cancellations.
FOOD VENDORS
All food stalls shall have New South Wales State Food Authority approval and display a current certificate of Licenses and Registration.
All food Stall Holders shall have completed a food handler’s course and shall be able to produce a certificate of competency, from a registered agency, upon request.
All food Stall Holders shall have appropriate Insurances.
Gas bottles shall have compliance certificates.
Stalls using cooling facilities shall have a working thermometer and if using heating facilities shall have appropriate safety barriers.
All food Stall Holders shall keep their sites tidy and sanitary during operation.
All foods including beverages, shall be prepared, displayed, served and stored in a manner that shall protect them from contamination and spoilage as per NSW Food Authority (www.foodauthority.nsw.gov.au).
Everyone involved in the cooking and serving process shall be suitably attired in clean protective clothing.
PARKING
Stall Holder’s vehicles shall not be brought into the Market /Event trading area except with the approval of the Market Managers.
GENERAL MARKET CONDUCT
No Stall Holder shall behave in a manner that is deemed offensive, dangerous or that adversely affects the reputation of 3 Peas Markets. Any Stall Holder deemed to be acting in this manner will be immediately removed from the market grounds and will be considered a breach of this agreement resulting in termination of stall site.
3 Peas Markets are strictly non-smoking areas. All Stall Holders shall comply with the non -smoking policy of 3 Peas Markets.
Stall Holders shall not damage or alter gardens or landscaping on Market grounds.
BREACHES AND REVIEWS & INCIDENT REPORTING
In the event of a breach of this Agreement the Market Managers may at their, discretion give notice that this Agreement is terminated immediately or otherwise.
Any incident causing concern will be documented. If the incident results in injury, accident, illness, or any other serious outcome, witness statements may be required. If you witness anything of concern (eg, any person or animal displaying concerning or antisocial behaviour, please let the Market Managers aware.
