AN ORDINANCE AUTHORIZING THE CITY OF ______, MISSOURI, TO MARKET RENEWABLE ENERGY CREDITS TO LARGE COMMERCIAL AND INDUSTRIAL USERS.

WHEREAS, the Missouri Joint Municipal Electric Utility Commission (MJMEUC) began seeking statements of commitment from local municipal electric utilities to encourage large electric utility customers to receive a portion of their electric power from renewable sources backed by Renewable Energy Credits (RECs); and

WHEREAS, MJMEUC set a deadline for the participation in this program; and

WHEREAS, the City of ______, Missouri, wishes to participate in said program.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF ______, MISSOURI, AS FOLLOWS:

Section 1. Any large commercial or industrial electric customer who is or will become a user of city electric services may agree to participate in the use of Renewable Energy Credits. In order to participate, a large commercial or industrial electric customer must submit to the City the Form of Service Agreement in the same format as supplied to the City by MJMEUC. In order to be considered a large commercial or industrial electric customer, the customer must meet the following conditions:

(a)Receive electrical service from the City;

(b)Maintain an annual load factor of at least 55 percent as certified by the City;

(c)Maintain an annual power consumption level in excess of 60,000 kWHrs;

(d)Commit to participation in the program for at least a twelve-month period;

(e)Agree to purchase at least 20 percent of the previous year’s consumption of electricity through the program.

Section 2. Any large commercial or industrial electric customer participating in the program shall pay an upcharge to the City of $1.00 per megawatt hour (or $.001 per kilowatt hour) over the rate normally charged.

Section 3. Any interested large commercial or industrial electric customers must complete and file with the City statements of interest on forms provided by MJMEUC by close of business on August 31, 2016.

Section 4. In the event the City receives a Form of Service Agreement from any large commercial or industrial electric customers by the closing date of the program, then the City shall take such other steps as are necessary to create a new renewable electric rate under the customer’s appropriate classification and said rate shall be effective no later than January 1, 2017.

Section 5. That this ordinance shall take effect and be in force from and after its passage and approval.
