TORBAY CHILDREN’S SERVICES PROCESS COVERING AUTHORISTATION FOR BOTH ‘OUT OF AREA’PLACEMENTS AND ‘PLACED AT A DISTANCE’

What legislation does this process refer to?

The Children Act 1989

The Care Planning, Placement and Case Review (England) Regulations 2010 (as amended by the Children’s Homes and Looked After Children (Miscellaneous Amendments) (England) Regulations 2013

Out of authority placement of looked after children Supplement to the Children Act 1989 (July 2014 )

This legislation created new requirements for the Local Authority making the ‘distance placement’to consult with Children’s Services in the‘area of placement’and for the Director of Children’s Services (DCS) of the ‘placing’authority to approve these placements.

PROCESS

When the Placements Team identify a placement ‘out of area’they will complete the ‘out of area’approval form and will distinguish if this is an ‘out of area’placement which meets the ‘placed at distance’status.

PLACEMENTS TEAM to complete PART A at the point the placement offer is made.

PLACEMENTS TEAM to pass the form to the Social worker or manager for completion of PART B

ALLOCATED SOCIAL WORKER - To discuss with the receiving LA see Annex 1 of regulations.

ALLOCATED SOCIAL WORKER will complete PART B and must obtain the views of the Child or young person about the proposed placement including the location

TEAM MANAGER / HOS to pass completed paperwork to PA of ASSISTANT DIRECTOR OR DIRECTOR OF CHILDREN’S SERVICE for signature before placement is made.

PA to ensure form is completed and signed within the day and sent back to SOCIAL WORKER and copy to PLACEMENTS TEAM

PLACEMENTS TEAM to save in the Child’s PARIS file under XX
