What Happens If Drug Screen Results are Positive:

Current Employees

After receiving a positive, confirmed test result, the employee has five business days to submit information to the Medical Review Officer (MRO) explaining or contesting the results. The MRO will then confirm with the employee’s physician any prescriptions or other medications that may have resulted in a positive drug screen. The employee must be notified within 15 days, whether the explanation is satisfactory.

Employees may also have the specimen re-tested at their own expense within 72 hours of notification of a verified positive test result. A second drug screen will NOT be accepted.

  1. Provide the employee with a completed “Notice of Drug-Screening Failure” form
  2. If this is the first offense, the employee has the option to enter into a Rehabilitation program at his/her own expense.
  3. For DOT employees, a certified Substance Abuse Professional must be used. A list of SAP providers is included in the Drug Free Workplace Policy (Addendum A)
  4. For state DFWP (non-DOT) employees, there are 2 options; 1) if the employee is enrolled in Nextran’s group health insurance coverage, he/she may contact the Mental Health and Substance Abuse division by referencing the customer service number on the back of the insurance card, or 2) the employee may contact the Employee Assistant Program (EAP) at 1-877-757-7587 and request rehabilitation.
  5. The employee is responsible for providing Nextran with proof of enrollment in such program within 15 days after being notified of confirmed, positive test results. He/she will be suspended without pay until such proof is provided.
  6. Once proof of enrollment is received, Nextran will consider reasonable accommodations which may enable the employee to perform the essential duties of his/her job (or an alternative job) while attending rehabilitation. (Reasonable accommodation may include leave without pay)
  7. The Rehabilitation program is to be completed within 12 weeks.
  8. By enrolling in the program, the employee consents to follow up testing at least once per year for a period of two years (or longer, if recommended by the SAP)
  9. For DOT employees, follow up testing will be performed six times during the twelve month period after returning to work.
  10. You must terminate the employee effective immediately in the event that:
  11. He/she declines to enter the Rehabilitation Program after the first offense
  12. He/she fails to provide Nextran with proof of enrollment in an acceptable Rehabilitation Program within 15 days
  13. This is his/her second confirmed positive test result after having already completed a Rehabilitation Program.

Any employees performing safety sensitive duties may not return to work until the Rehabilitation Program is completed and a follow up drug screen returns with negative results.

Job Applicants : Candidates with positive test results are not eligible for the Rehabilitation Program, and may not reapply for employment for a period of 180 days.
