1. - TITLE

This Award shall be known as the West Australian Petroleum Pty Ltd Long Service Leave conditions Award 1991.

3. - DEFINITIONS

"The Company" means any Company to which the provisions of the Hydrocarbons and Gas (Production and Processing Employees) Award 1986 - Part VII and the Hydrocarbons and Gas (Mechanical and Electrical Trades) Barrow Island Award 1985 apply.

4. – APPLICATION OF AWARD

Except as hereinafter provided the Long Service Leave - Standard Provisions as gazetted in Volume 71 WAIG 1 - 4 shall apply to all employees of the Company in the State of Western Australia who are eligible for membership of the unions respondent to the awards as set out in Clause 3. - Definitions of this award.

5. – PERIOD OF LEAVE

(1)The leave to which an employee shall be entitled or deemed to be entitled shall be as provided in this clause.

(2)Subject to the provisions of subclause (5) of this clause, where an employee has completed at least 10 years' service, the amount of leave shall be -

(a)In respect of 10 years' service so completed - 13 weeks leave; or

(b)On the termination of the employee's employment -

(i)by the death of the employee;

(ii)in any circumstances otherwise than by the employer for serious misconduct,

in respect of the number of years' service with the employer completed since the employee last became entitled to an amount of long service leave, a proportionate amount on the basis of 13 weeks for 10 years' service.

(3)Where an employee has completed at least 7 years' service but less than 10 years' service since its commencement and the employee's employment is terminated -

(a)By death; or

(b)In any circumstances, otherwise than by the employer for serious misconduct,

the amount of leave shall be such proportion of 13 weeks' leave as the number of completed years of such service bears to 10 years.

(4)In the cases to which paragraph (b) of subclauses (2) and (3) of this clause apply, the employee shall be deemed to have been entitled to and to have commenced leave immediately prior to such termination.

(5)An employee whose service with an employer commenced before 5 October 1985 and whose service would provide an entitlement to long service leave under this clause shall be entitled to leave calculated on the following basis -

(a)for each completed year of service commencing before 1 October 1964, an amount of leave calculated on the basis of 13 weeks' leave for 20 years' service; and

(b)for each completed year of service commencing before 5 October 1985, an amount of leave calculated on the basis of 13 weeks' leave for 15 years' service.

Provided that such employee shall not be entitled to long service leave until the completed years of service entitle the employee to the amount of long service leave prescribed in paragraph (a) of subclause (2) of this clause as the case may be.

(6)Long service leave, in the case of employees employed on an even time commute cycle roster, shall be made up equally of rostered on and rostered off periods and such leave shall not be taken in portions of a commute cycle.
