RECISSION OF WASTE DISCHARGE REQUIREMENTS
ORDER NO. 85-58

The California Regional Water Quality Control Board, San Francisco Bay Region, (hereinafter called the Board), finds:
DISCHARGERS AND LOCATION
1.The City of Santa Clara and Pacific Recovery Corporation (formerly Pacific Lighting Energy Systems, Inc.) disposed of landfill gas condensate into a landfill formerly referred to as the City of Santa Clara Station (Santa Clara Station). Santa Clara Station is located south of State highway 237 between San Tomas Aquinas Creek and the Guadalupe River (see Figure 1, site location map).
PURPOSE OF ORDER
2.The purpose of this Order is to rescind Waste Discharge Requirements Order No. 85-58 for the Santa Clara Station, which are no longer applicable.
BASIS FOR RECISION
3.Santa Clara Station landfill has been incorporated into the area identified as the Santa Clara All Purpose Landfill and is currently regulated by the Waste Discharge Requirements (Order No. 94-050) for the Santa Clara All Purpose Landfill. The Santa Clara Station landfill comprises the area of Parcels 1, 2, and 4 of the Santa Clara All Purpose Landfill. All landfill controls for the Santa Clara Station Landfill are currently covered in Waste Discharge Requirements for Santa Clara All Purpose Landfill, which remain in effect.
4.Santa Clara All Purpose Landfill is no longer accepting waste and has been closed. Per Board Order No. 94-050 and previous Board Orders, waste material at the Santa Clara All Purpose Landfill has been capped and contained, leachate control systems are in place, and groundwater and surface water is monitored.
5.The Board has notified the discharger and interested agencies and persons of its intent to rescind the Waste Discharge Requirements (Order No. 85-58), and has provided them with an opportunity for a public hearing and an opportunity to submit their written views and recommendations.
6.This action is an Order to enforce the laws and regulations administered by the Board. This action is categorically exempt from the provisions of the California Environmental Quality Act pursuant to Section 15301, Title 14, California Code of Regulations.
7.The Board, in a public meeting, heard and considered all comments pertaining to this amendment of Waste Discharge Requirements.
IT IS HEREBY ORDERED THAT: Board Order No. 85-58 is rescinded.
