Water Rates for Outside City Customers

BE IT ENACTED, by the City Council of the City of Wilton, Iowa:

SECTION 1.This Ordinance as amended is enacted to add changes of rates in the portion of Chapter 14 of the Wilton Municipal Code pertaining to:

Sections: 14.17.010 Definitions

14.17.020 Water Rates Outside the City

14.17.010 Definitions: For use in this chapter, the following terms are defined:

  1. CBOD” (denoting Carbonaceous Biochemical Oxygen Demand) means the quantity of oxygen utilized in the biological oxidation of organic matter under standard laboratory procedure in five (5) days at twenty degrees (20º) C, expressed in milligrams per liter or parts per million.
  1. “Total Suspended Solids (TSS)” means the portion of total solids retained by a filter using EPA methods or standard methods.
  1. “TKN” means the Total Kjeldahl Nitrogen concentration expressed in mg/l as determined using EPA methods or standard methods.
  1. “Normal domestic wastewater” means wastewater that has a BOD5 concentration of not more than 125 mg/l, a suspended solids concentration of not more than 125 mg/l, and an ammonia nitrogen concentration of not more than 65 mg/l.

14.17.020 WATER RATES OUTSIDE THE CITY. Water service shall be provided to any customer located outside the corporate limits of the City whichthe City has agreed to serve at rates one hundred twenty-seven percent (127%) of the rates provided in Section 14.16 of the Wilton Municipal Code. No such customer, however, will be served unless the customer shall have signed a service contract agreeing to be bound by the ordinances, rules and regulations applying to water service established by the Council.

SECTION 2.SEVERABILITY CLAUSE.If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

SECTION 3. WHEN EFFECTIVE.This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

SANITARY SEWER RATES FOR OUTSIDE CITY CUSTOMERS

BE IT ENACTED, by the City Council of the City of Wilton, Iowa:

SECTION 1.This Ordinance as amended is enacted to add changes of rates in the portion of Chapter 15 of the Wilton Municipal Code pertaining to:

TITLE 15, Section 15.29 – Sanitary Sewer Rates for Outside City Customers

15.29.030 Surcharge

15.29.010 Definitions: For use in this chapter, the following terms are defined:

  1. CBOD” (denoting Carbonaceous Biochemical Oxygen Demand) means the quantity of oxygen utilized in the biological oxidation of organic matter under standard laboratory procedure in five (5) days at twenty degrees (20º) C, expressed in milligrams per liter or parts per million.

15.29.020 SEWER RATES OUTSIDE THE CITY. Sewer service shall be provided to any customer located outside the corporate limits of the City whichthe City has agreed to serve at rates one hundred twenty percent (120%) of the rates provided in Section 15.28. No such customer, however, will be served unless the customer shall have signed a service contract agreeing to be bound by the ordinances, rules and regulations applying to sewer service established by the Council.

15.29.030 SURCHARGE. For those contributors who contribute wastewater, the strength of which is greater than the limits set out below, a surcharge in addition to the normal user charge will be collected. The City will collect 24-hour composite samples once a month and submit them for testing to determine the appropriate charges for that month. The contributor will be responsible for paying the testing costs. The surcharge for operation and maintenance including replacement is:

  1. $0.22 per pound Carbonaceous Biochemical Oxygen Demand (CBOD) per pound over 125 mg/l.
  2. $0.60 per pound Total Suspended Solids (TSS) in excess of 125 mg/l.
  3. $0.16 per pound Total Kjeldahl Nitrogen (TKN) in excess of 65 mg/l.

SECTION 2.SEVERABILITY CLAUSE.If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

SECTION 3. WHEN EFFECTIVE.This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
