TheParliamentofVictoriaenactsasfollows:
1.Purpose
ThepurposeofthisActistoamendtheWaterAct1989
(a)torequiretheuseofwaterinprivatedamsorfromspringsorsoaksforcommercialandirrigationpurposestobelicensed;
(b)toprovideforthedeclarationofwatersupplyprotectionareasandthepreparationandimplementationofmanagementplansforthoseareas;
(c)torequirecertaindamstobelicensed;
(d)torequirelicenseddrillerstocomplywiththeconditionsofboreconstructionlicences;
(e)tomakeothermiscellaneousamendments.
2.Commencement
(1)ThisAct(exceptsections19(2),19(4),20,25(1),26,27,28and31)comesintooperationonthedayafterthedayonwhichitreceivestheRoyalAssent.
(2)Sections19(2),19(4),20,25(1),26,27,28and31comeintooperationon1February2002.

(2)If
(a)anannualreservevolumeofgroundwaterhasbeenspecifiedfortheareaundersection49AoftheGroundwaterAct1969;or
(b)aprescriptionhasbeenmadeundersection62(1)oftheGroundwaterAct1969ofthemaximumtotalamountsofwatertobeextractedperannumfromalllicensedboreswithinthearea
avolumespecifiedinanOrderundersub-section(1)ofthissectionmustnotaffectthevolumereferredtoinparagraph(a)andmustnotbelessthantheamountsreferredtoinparagraph(b).

9.PowerofMinisterrewaterresourcesassessmentprogram

27.Declarationofwatersupplyprotectionarea
(1)TheMinister,ontheMinister'sinitiativeoronanapplicationfromapersonreferredtoinsub-section(3),may,byOrderpublishedintheGovernmentGazette,declareanareatobeawatersupplyprotectionarea.
(2)Anareamaybedeclaredundersub-section(1)tobeawatersupplyprotectionareafortheprotectionofthegroundwaterresourcesintheareaorthesurfacewaterresourcesintheareaorboth.
(3)Anapplicationforadeclarationundersub-section(1)maybemadeby
(a)apersonauthorisedtousegroundwaterorsurfacewaterunderthisAct;or
(b)anAuthoritythat
(i)holdsabulkentitlement;or
(ii)usesgroundwater;or
(iii)supplieswater;or
(c)abodythathasresponsibilitiesunderanyActrelatingtotheconservationormanagementofwater,orofland
intheareaconcernedorinanareawherethewatersupplyisaffectedbythetakinganduseofgroundwaterorsurfacewater(asthecaserequires)intheareaconcerned.
(4)TheMinistermayonlymakeadeclarationundersub-section(1)if
(a)theMinisterhasfirstcausednoticeoftheproposeddeclarationtobe
(i)publishedinanewspapercirculatinggenerallyintheareaconcerned;and
(ii)givenbyposttotherelevantpersonslistedinsub-section(5);and
(b)theMinisterhasconsideredanysubmissionsmadewithin60daysafterthepublicationorgivingofnoticeoftheproposeddeclarationundersub-paragraph(i)or(ii)ofparagraph(a),whicheveristhelater.
(5)Forthepurposesofsub-section(4)(a)(ii)therelevantpersonsare
(a)theMinisteradministeringtheConservation,ForestsandLandsAct1987;and
(b)theMinisteradministeringthePlanningandEnvironmentAct1987;and
(c)anyAuthorityexercisingafunctionunderPart8or11intheareaconcerned;and
(d)anyAuthoritythatholdsabulkentitlementtowaterfromasourceintheareaconcerned;and
(e)anypublicstatutorybodywhichtheMinisterconsidersmaybedirectlyaffectedbythedeclaration;and(f)anycouncilinwhosemunicipaldistricttheareaconcernediswhollyorpartlysituated;and
(g)theresponsibleauthorityunderthePlanningandEnvironmentAct1987inrelationtoaplanningschemeforthewholeoranypartoftheareaconcerned.
(6)Ifanapplicationundersub-section(1)ismadeforadeclaration,thepublicationorgivingnoticeoftheproposeddeclarationistobeattheexpenseoftheapplicant.
(7)TheMinistermayrequirefurtherinformationwithrespecttotheproposeddeclarationtobeprovidedbytheapplicantforthedeclarationoranyAuthoritywithafunctionunderthisActintheareaconcerned.
(8)TheMinistermustmakeadecisionwhethertodeclareanareatobeawatersupplyprotectionareawithin60daysaftertheperiodof60daysreferredtoinsub-section(4)(b).
(9)IftheMinisterdecidestodeclareanareatobeawatersupplyprotectionarea,theMinistermustcauseanoticetothateffecttobepublishedinanewspapercirculatinggenerallyinthearea.
(10)IftheMinisterdecidesnottodeclareanareatobeawatersupplyprotectionarea,theMinistermustcauseanoticetothateffecttobepublishedinanewspapercirculatinggenerallyinthearea.
(11)TheMinistermustcauseadeclarationundersub-section(1)tobelaidbeforeeachHouseofParliamentwithin5sittingdaysofthatHouseafteritismade.
28.Amendmentorabolitionofwatersupplyprotectionarea
(1)TheMinistermay,byasubsequentOrderpublishedintheGovernmentGazette,amendtheboundariesof,orabolish,awatersupplyprotectionarea.
(2)Section27applies(withanynecessarymodifications)toanOrderundersub-section(1)asifitwereadeclarationundersection27(1).
29.Consultativecommittee
(1)IftheMinistermakesadeclarationundersection27(1),theMinistermustappointaconsultativecommitteetoprepareadraftmanagementplanfortheareathatisthesubjectofthedeclaration.
(2)Thefollowingprovisionsapplywithrespecttothemembershipofaconsultativecommitteeappointedunderthissection
(a)theMinistermustmakesurethat,sofarasispossible
(i)allrelevantinterestsarefairlyrepresentedonthecommittee;
(ii)themembershipconsistsofpersonswhohaveknowledgeorexperienceinthematterstobecoveredinthemanagementplan;
(b)atleastonehalfofthemembershipmustconsistofpersonswhoareownersoroccupiersoflandintheareaconcernedappointedafterconsultationbytheMinisterwithbodiesrepresentativeofthosepersons;(c)anypublicstatutorybodywhichtheMinisterconsiderstobedirectlyaffectedbythedeclarationmust,afterconsultationbytheMinisterwithit,berepresentedonthecommittee.
(3)Unlesstheareathatisthesubjectofthedeclarationiswhollywithinanurbanarea,thepersonsreferredtoinsub-section(2)(b)mustbefarmerswhoownoroccupyfarminglandinthearea,appointedbytheMinisterafterconsultationwiththeVictorianFarmersFederation.
(4)Section318(2)to(6)appliestoaconsultativecommitteeappointedunderthissection.
30.Guidelinesforpreparationofdraftmanagementplans
(1)TheMinistermayprepareguidelinesforthepreparationofadraftmanagementplanforanareathatisthesubjectofadeclarationundersection27(1).
(2)TheMinistermayfromtimetotimeamendorrevokeanyguidelinespreparedundersub-section(1).
(3)TheMinister,assoonaspracticableafterpreparing,amendingorrevokingguidelinesunderthissectionmustgivetherelevantconsultativecommittee
(a)acopyoftheguidelinesortheamendment;or
(b)noticeoftherevocationoftheguidelines.
31.Preparationofdraftmanagementplan
(1)Aconsultativecommitteeappointedundersection29must,within18monthsafteritsappointment
(a)prepareadraftmanagementplaninaccordancewithanyguidelinespreparedbytheMinisterundersection30;and
(b)makethedraftmanagementplanavailableforcommentbyinterestedpersons.
(2)Iftheconsultativecommitteedoesnotprepareadraftmanagementplanwithintheperiodreferredtoinsub-section(1),theMinistermay
(a)fromtimetotimeextendthetimewithinwhichthedraftmanagementplanmaybepreparedandmadeavailableforcommentbyinterestedpersons;or
(b)preparethedraftmanagementplan.
(3)If,undersub-section(2),theMinisterpreparesthedraftmanagementplan,theMinistermustmakethatplanavailableforcommentbyinterestedpersons.
32.Overlappingmanagementplanstobetakenintoaccount
Inpreparingadraftmanagementplanforanareadeclaredtobeawatersupplyprotectionarea,theconsultativecommitteemusttakeintoaccountanyotherdraftorapprovedmanagementplanthatappliestotheareaorpartoftheareaunderthisDivision.
32A.Managementplan
(1)Theobjectofamanagementplanistomakesurethatthewaterresourcesoftherelevantwatersupplyprotectionareaaremanagedinanequitablemannerandsoastoensurethelong-termsustainabilityofthoseresources.
(2)Amanagementplanmayrelatetogroundwaterresources,surfacewaterresourcesorbothintherelevantwatersupplyprotectionarea.
(3)Amanagementplanmayprescribefortherelevantwatersupplyprotectionareaoranypartofthatarea
(a)requirementsformetering,monitoringandaccountingforgroundwaterorsurfacewaterorboth;or
(b)requirementstonotifytheAuthoritythathasthedutyofadministeringandenforcingtheplanofthetakingofgroundwaterfromanyspecifiedboreorgroupofboresunderarightconferredbysection8(1);or
(c)requirementsforthelocation,capacityandoperationofprivatedamswhichare
(i)notlicensedundersection51;and
(ii)notfordomesticandstockuse;or
(d)restrictionsorprohibitionsontheissueoflicencesundersection51or67;or
(e)restrictionsorprohibitionsontherenewalofregistrationlicences;or
(f)restrictionstobeimposedonthetakingofgroundwaterfromanyspecifiedbore,groupofboresoraquifer,ifnecessarytoprevent
(i)aspecifiedmaximumgroundwatertabledeclinebeingexceeded;or
(ii)arelevantpermissibleannualvolumebeingexceeded;or
(g)restrictionstobeimposedonthetakingofsurfacewateratanylocationspecifiedinthearea,ifnecessarytoensurethat
(i)specifiedflowsatanyparticulartimeorforanyparticularcircumstancesaremaintained;or
(ii)thepermissibleannualvolumefortheareaisnotexceeded;or
(h)restrictionstobeimposedonthesupplyofgroundwaterbyanAuthoritythattakesgroundwaterfromasourceintheareaorpart;or
(i)conditionsrelatingtotheprotectionoftheenvironment,includingtheriverineandriparianenvironment;or
(j)conditionsrelatingtopaymentfortheamountofgroundwatertakenandusedfromanyspecifiedboreorgroupofboresunderarightconferredbysection8(1);or
(k)conditionstowhichlicencesissuedundersection51aretobesubject;or
(l)withoutderogatingfromrightstowaterfordomesticandstockuseconferredbysection8,conditionstowhichlicencesissuedundersection67aretobesubject;or
(m)conditionstowhichlicencesissuedundersection51totakeandusegroundwaterorsurfacewater,andtransferredundersection62,aretobesubject,includingaconditionrelatingtothemaximumvolumeofwaterwhichmaybetakenandusedunderthetransferredlicence;or(n)themaximumvolumeofwaterthatmayberetained
(i)ineachprivatedamonaparticularlotinaplanofsubdivisionintheareaconcerned;or
(ii)inallprivatedamsoneverylotinaplanofsubdivisionintheareaconcerned;or
(o)anymatterrelevanttotheobjectofthemanagementplanoritsimplementation.
(4)AdraftmanagementplanmaymakearecommendationtotheMinisterastothetotalvolumeofwaterthatshouldbedeclaredtobethepermissibleannualvolumefortheareaconcerned.
(5)AdraftmanagementplanmustnametheAuthoritywhichistohavethedutyofadministeringandenforcingtheplanifitisapproved.
(6)TheMinistermay
(a)approveadraftmanagementplan;or
(b)refusetoapproveadraftmanagementplan.
(7)TheMinistermustcause
(a)noticeoftheapprovalorrefusal(asthecaserequires)ofadraftmanagementplantobepublishedandgiveninaccordancewithsection27(4)(a);and
(b)ifthedraftmanagementplanisrefused,thereasonsfortherefusaltobepublishedwiththatnotice.
(8)TheMinistermustcauseanapprovedmanagementplantobelaidbeforeeachHouseofParliamentwithin5sittingdaysofthatHouseafteritisapprovedundersub-section(6).
(9)Sections23,24and25oftheSubordinateLegislationAct1994applytoanapprovedmanagementplanasiftheapprovedmanagementplanwereastatutoryrulewithinthemeaningofthatAct.
(10)AnapprovedmanagementplanmaybedisallowedinwholeorinpartbyresolutionofeitherHouseofParliamentinaccordancewiththerequirementsofsection23oftheSubordinateLegislationAct1994.
(11)Anapprovedmanagementplanisbindingoneveryperson(includingeverypublicstatutorybody)excepttotheextentthattheMinisterotherwisespecifiesbynoticepublishedintheGovernmentGazette.
(12)Ontheapprovalofadraftmanagementplanthatprescribesarequirement,restrictionorconditiontowhichalicenceissuedundersection51or67istobesubject,everylicenceissuedundersection51or67,whetherissuedbeforeorafterthecommencementofsection10oftheWater(IrrigationFarmDams)Act2002,isdeemedtobesubjecttothatrequirement,restrictionorcondition,despiteanythingtothecontraryspecifiedinthelicenceoranyconditionthatisprescribedorfixedorimposedbytheMinisterundersection56or71(asthecaserequires)inrelationtothelicence.
(13)Apersonmustnotcontraveneanapprovedmanagementplan.
Penalty:20penaltyunits.
32B.Administrationandenforcementofmanagementplan
(1)TheAuthoritythathasthedutyofadministeringandenforcinganapprovedmanagementplanmay
(a)directthatanyspecifiedworksbecarriedoutoranyspecifiedequipmentbeinstalled;or
(b)ordertheremovalofanyspecifiedworks(otherthanaprivatedam)orthediscontinuanceofanyspecifiedaction
if,intheopinionoftheAuthority,itisnecessarytodosoinordertosecurecompliancewiththeplan.
(2)ApersonwhoseinterestsareaffectedbyadecisionofanAuthorityundersub-section(1)togiveadirectionormakeanordermayapplytotheTribunalforreviewofthedecision.
(3)Anapplicationforreviewmustbemadewithin28daysafterthelaterof
(a)thedayonwhichthedecisionismade;(b)if,undertheVictorianCivilandAdministrativeTribunalAct1998,thepersonrequestsastatementofreasonsforthedecision,thedayonwhichthestatementofreasonsisgiventothepersonorthepersonisinformedundersection46(5)ofthatActthatastatementofreasonswillnotbegiven.
(4)ApersonmustnotcontraveneadirectiongivenorordermadebyanAuthorityundersub-section(1).
Penalty:20penaltyunits.
32C.Reportonadministrationandenforcementofmanagementplan
(1)TheAuthoritythathasthedutyofadministeringandenforcinganapprovedmanagementplanmustprepareareportinrespectofitsactivitiesincarryingoutitsdutiesinrelationtotheplan
(a)fortheperiodcommencingonthedaythemanagementplanisapprovedandendingon30Junenextfollowing;and
(b)fromthenon,foreachyearendingon30JuneorforsuchotherperiodoftimerequestedbytheAuthorityandapprovedbytheMinister.
(2)TheAuthoritymust,onorbefore30Septemberineachyear,giveacopyofthereportto
(a)theMinister;and
(b)everyCatchmentManagementAuthoritywhosecatchmentandlandprotectionregioniswhollyorpartlyinthearea.
32D.Publicavailabilityofreport
AnAuthoritythathaspreparedareportinaccordancewithsection32Cmust,assoonaspracticableaftergivingacopyofthereporttotheMinister
(a)makeacopyofthereportavailableforinspection,duringbusinesshours,freeofchargeattheofficesoftheAuthority;and
(b)publishanoticeofthatavailabilityinanewspapercirculatinggenerallyintheareatowhichtheapprovedmanagementplanapplies.
32E.Certainplansdeemedtobeapprovedmanagementplans
(1)DespiteanythingtothecontraryinthisDivisionbutsubjecttothissection,theMinistermayapproveaplanforthemanagementofsurfacewaterresourcesthathasbeenpreparedorpartlypreparedbyorforthedepartmentforaparticularareabeforethecommencementofsection10oftheWater(IrrigationFarmDams)Act2002.
(2)Beforeapprovingaplanasamanagementplanundersub-section(1),theMinistermay
(a)revieworrevisetheplan;or
(b)appointanadvisorycommitteetoassistindevelopingorcompletingtheplan.
(3)AnadvisorycommitteeistoconsistofsuchpersonsastheMinisterthinksfit.
(4)TheMinistermustnotapprovetheplanunlesstheMinisterissatisfiedthattheplancomplieswithsection32A(1)to(5).
(5)OntheapprovalbytheMinisterofaplanundersub-section(1)
(a)theparticularareatowhichtheplanrelatesisdeemedtobeawatersupplyprotectionareafortheprotectionofsurfacewaterresources;and
(b)theplanisdeemedtobeanapprovedmanagementplanforthesurfacewaterresourcesoftherelevantwatersupplyprotectionareaandmaybeamendedorrevokedinaccordancewiththisDivision.
32F.Compensationincertaincircumstances
(1)Theownerandoccupierofanyworksisentitledtobepaid,bythepersonspecifiedbytheconsultativecommitteethatpreparedtheplan,orspecifiedbytheMinisterinaplanreferredtoinsection32E,compensationforanylosssufferedorexpensessustainedasaresultof
(a)beingdirectedundersection32B(1)(a)tocarryoutworksorinstallequipment;or
(b)beingorderedundersection32B(1)(b)toremoveworks.
(2)Ifasaresultoftheenforcementofanapprovedmanagementplanabenefitisconferredononepersonandadetrimentissufferedbyanotherperson,thesecond-mentionedpersonisentitledtobepaidbythefirst-mentionedpersoncompensationforthedetrimentsuffered.
(3)Theamountofcompensationpayableundersub-section(1)or(2)isasagreedbythepartiesor,intheabsenceofagreement,asdeterminedbytheAuthoritythathasthedutyofadministeringandenforcingtheplan,andthatamountmaybeenforcedasadebtinacourtofcompetentjurisdiction.(4)Apersonwhoseinterestsareaffectedbyadecision
(a)ofanAuthorityundersub-section(3)astotheamountofcompensationpayable;or
(b)ofaconsultativecommitteeortheMinisterundersub-section(1)
(i)thataspecifiedpersonmustpaycompensation;or
(ii)thatnocompensationispayable
mayapplytotheTribunalforreviewofthedecision.
(5)Anapplicationforreviewmustbemadewithin28daysafterthelaterof
(a)thedayonwhichthedecisionismade;
(b)if,undertheVictorianCivilandAdministrativeTribunalAct1998,thepersonrequestsastatementofreasonsforthedecision,thedayonwhichthestatementofreasonsisgiventothepersonorthepersonisinformedundersection46(5)ofthatActthatastatementofreasonswillnotbegiven.
32G.Amendmentorrevocationofapprovedmanagementplan
