Interpretation.
1.—(1)InthisAct"theconsolidationActs"means—
(a)the[1991c.57.]WaterResourcesAct1991,the[1991c.56.]WaterIndustryAct1991,the[1991c.59.]LandDrainageAct1991andthe[1991c.58.]StatutoryWaterCompaniesAct1991;and
(b)somuchofthisActasre-enactsprovisionsrepealedbythisAct.
(2)InthisAct—
"the1989Act"meansthe[1989c.15.]WaterAct1989;
"the1976Act"meansthe[1976c.70.]LandDrainageAct1976;
"commencement"meansthecommencementoftheconsolidationActsandofsomuchofthisActasgiveseffecttoanyrepeal;
"localstatutoryprovision"means—
(a)aprovisionofalocalAct(includinganActconfirmingaprovisionalorder);
(b)aprovisionofsomuchofanypublicgeneralActashaseffectwithrespecttoaparticulararea,withrespecttoparticularpersonsorworksorwithrespecttoparticularprovisionsfallingwithinanyparagraphofthisdefinition;
(c)aprovisionofaninstrumentmadeunderanyprovisionfallingwithinparagraph(a)or(b)above;or
(d)aprovisionofanyotherinstrumentwhichisinthenatureofalocalenactment;
"modifications"includesadditions,alterationsandomissions,andcognateexpressionsshallbeconstruedaccordingly;
"theNRA"meanstheNationalRiversAuthority;
"subordinatelegislation"hasthesamemeaningasinthe[1978c.30.]InterpretationAct1978.

2.—(1)TheenactmentsmentionedinSchedule1tothisActshallhaveeffectsubjecttotheamendmentstherespecified(beingamendmentsconsequentialonthere-enactmentofprovisionsintheconsolidationActs).
(2)Thetransitionalprovisions,transitoryprovisionsandsavingscontainedinSchedule2tothisActshallhaveeffect.
(3)Thepowersundersections190(1)and194(5)ofthe1989Actandthepowersunderparagraph2ofSchedule17tothatAct(byvirtueofwhichconsequentialamendments,transitionalprovisionsandsavingsmaybemadeinconnectionwiththecomingintoforceofprovisionsofthatAct)—
(a)shallnotberestrictedinconsequenceofanyrepealmadebythisActorofanyprovisionoftheconsolidationActs;but
(b)shallbeexercisableinrelationtoanyprovisionofthoseActstothesameextentas,beforethecomingintoforceofthisAct,theywereexercisableinrelationtoanycorrespondingprovisionofthatAct.
(4)TherepealsmadebythisActshallnotaffectthefollowingpowerstoamendlocalstatutoryprovisions,thatistosay—
(a)thepowerconferredbysection317ofthe[1936c.49.]PublicHealthAct1936;
(b)thepowerconferredbysection12ofthe[1937c.40.]PublicHealth(DrainageofTradePremises)Act1937andsection69(2)ofthe[1961c.64.]PublicHealthAct1961;

(3)Sub-paragraph(2)aboveshallnotapplyif—
(a)thedateoftheelectionfallslessthan6monthsafterthebeginningoftheperiodforwhichtheunpaidratewasmade;or
(b)thelandwasoccupied,whentheamountwasdemanded,byapersonwho,asbetweentheownerandtheoccupier,wasliabletopaytheowner'sdrainagerate.
(4)Inparagraph4(1)ofSchedule1totheLandDrainageAct1991,areferencetotheassessablevalueoflandis,inrelationtoarelevantdatebefore1stApril1993,areferencetotheannualvalueonwhichanysuchadrainageratewouldbeassessableinaccordancewithsection64ofthe1976Act.

Qualificationformakingcertainapplications—pre-1993rates
19.—(1)Subsections(2)and(3)ofsection72oftheLandDrainageAct1991(qualificationformakingcertainapplications)shallhaveeffectinrelationtoqualificationbyreferencetoadrainageratemadeinrespectofafinancialyearbeginningbefore1993,asifareferenceinthosesubsectionstotheoccupiersofanylandincludedareferencetotheownersoftheland.
(2)Inparagraph(b)(iii)ofsubsection(2)ofthatsection,areferencetotheassessablevalueoflandis,wheretheratereferredtointhatparagraphwasmadeforayearbeginningbefore1993,areferencetotheannualvalueonwhichanysuchdrainageratewouldbeassessableinaccordancewithsection64ofthe1976Act.
