Waste Facility Permit Regulations

WASTE MANAGEMENT (FACILITY PERMIT AND REGISTRATION) REGULATIONS 2007, AS AMENDED.

The new Waste Management (Facility Permit and Registration) Regulations S.I. 821 of 2007 and Waste Management (Facility Permit) (Amendment) Regulations S.I. 86 of 2008 came in to effect on the 1st June 2008.

Dublin City Council is responsible for issuing Waste Facility Permits and Certificates of Registration in the Dublin City Council administrative area.

3. APPLICATION FORM

The EPA has designed the one application form, which may be used for applying for a Waste Facility Permit or Certificate of Registration. This form has been adopted for use by applicants to Dublin City Council and is available upon request by email from:

4. NUMBER OF COPIES OF APPLICATION TO BE SUBMITTED

When applying for a Waste Facility Permit, please submit the original and three copies of the entire application.

If applicable, include an additional copy or copies of the entire application for the Minister of Agriculture and Food (e.g. if handling animal by-products) and / or The Minister for Environment, Heritage and Local Government.

5.FEES

Application fees are detailed in the 5th Schedule of the Regulations. Once the Waste Facility Permit is issued a fee ranging from €3500 to €5000 will be payable to Dublin City Council towards the cost of administering the facility permit and monitoring the activity for the performance of it’s functions under the Regulations for the duration of the permit.

Waste Facility Permit Application Check List

Complete the application form in full – answer all questions.
The correct application fee in accordance with article 42 and as specified in the fifth schedule of the Regulations.
A copy of the relevant page from the newspaper(s) in which notices in accordance with articles 7 & 8 have been published
A copy of the text of the notices erected or fixed in accordance with articles 7 & 8 must also be supplied
Details of any court hearing, case, nature of the offence and any penalty or requirements imposed by the court
Where the applicant is a person or partnership, include details of any such conviction where the person or partner was at any time within the last 10 years prior to this application, a director, manager, company secretary or similar officer for a body corporate
Site location plan, with clearly marked site boundaries in red, and North point indicated, Ordnance survey reference sheet number(s), the site elevation with reference to the ordnance datum used must be included
Proposed site layout must be included, with the North point indicated and site dimensions in metres. This plan should include all necessary monitoring and sampling point locations, and any emission point(s) clearly marked. There should be a clearly legible key for the identification of the relevant points. Ordnance survey reference sheet number(s), the site elevation with reference to the ordnance datum used must be included.
All maps/drawings/plans must be no larger than A3 size and scaled appropriately such that they are clearly legible. In exceptional circumstances, where A3 is considered inadequate, a larger size may be requested
An additional copy of the site location plan, detailing the site boundary in red, with the locations of the notice erected or fixed in accordance with article 8 clearly marked on it
A copy of the current tax clearance / C2 certificate issued to the applicant(s) by the Revenue Commissioners, or appropriate certificate from the relevant tax authority for non-domiciled applicants.
Where applicable, a copy of proof of the company registration (copy of Certificate of Incorporation).
Where applicable, a copy of proof of the registration of the trade name (copy of Certificate of Registration of Business Name).
Provide the name of the Planning Authority in whose functional area the activity is or will be situated and complete the relevant tables in the application. Please give the planning permission number or the planning application number, or if applicable copy of the Certificate of Exemption issued by the relevant planning authority
Proof of the interest you hold in the land where the facility is located (freehold, leasehold, tenant etc.).
Original signed Financial Commitment Discharge Declaration.
Original signed Statutory Declaration.
