NOW COMES this Petitioner, Private Citizen, Walter J. Burien, Jr., to the Arizona Court of Appeals and does affirm that the statements made herein are true, in substance and in fact, and does give to this Court and all parties to this action his CURTOSY REPLY TO Kristen Wurr’s “REPLY” DATED AUGUST 11th 2006;
PRESENTMENTS
1. Petitioner, Walter J. Burien, Jr., became aware that a change of council notice was filed in this case when he looked at the online Arizona Court of Appeals web site on or around July 25th 2006. Online it did not specify, “who’s” council was being noticed for change, Troy Brown or Paula Cotitta. I then called the clerk of the court; she did not know the answer to that question. I then received in the mail the notice for change of council on July 28th 2006 at my Box 42, East Brunswick, NJ 08816. I subsequently filed in several days with the court my OBJECTION to this change and sent Ms. Wurr a courtesy copy. I use USPS delivery confirmation that shows delivery to the other parties to this action and suggest they do the same if they want to make unsupported claims of when they mailed or when someone “received a copy” of what they sent.
2. I received a “REPLY” to my OBJECTION not from the “RESPONSIBLE PARTY” as listed from the beginning in this Court of Appeals action, Paula Cotitta, but a reply from Kristen Wurr. Ms. Wurr’s presentation as eloquent, but misplaced as it may be is irrelevant and must be ignored by the court and this Appellant awaits response from the Responsible Part Paula Cotitta..
3. Ms. Wurr is not the responsible party and her attempt for a forced “revolving door” entry to this case is improper as clearly noted in my OBJECTION filed with the court. Would the court allow a notice from this petitioner for change of Appellant to another individual? No, it would not. Ms. Cotitta’s or DES’s attempt to substitute what appears to be a hired top gun that has no responsibility in her action that lead to this case is improper and should be denied.
4. If Ms. Cotitta’s actions at the hearing of 04/20/06, has lead to her suspension from the Arizona AG’s Office, her response to her actions, testimony of the influences on her to perpetrate said actions; assurances made to her by any parties that she could violate standing law and statute without repercussion can be established through deposition and subpoena, and Petitioner would have no objection for or to council being substituted to represent DES. But in the alternative, if Ms. Cotitta is still operating in her same capacity for DES, Appellant requires her response, statements, justifications, and presence in reply to her actions, of which moved this Appellant to required and initiate this court of Appeals case. A clear and obvious conflict exists with the removal of the Respondent Paula Cotitta as was already objected to by this Petitioner, Appellant.
5. This Petitioner, the Appellant, is still awaiting the listed Respondent to this action, Paula Cotitta’s reply or response as is required by the Arizona rules of Appellate procedure.
CONCLUSSION
It is now August 19th 2006, and Petitioner awaits rulings from the Court of Appeals – Div. 1, and prays that the relief / remedy he has requested be granted in the interests of justice, further discovery, and much needed accountability.
