Clubhouse Purchase Update

Once a final appraisal established the purchase price for the Clubhouse and two adjacent lots earlier this year, we attempted to contact YDF to finalize details for settlement. Our attorney finally received a fax from YDF Board member, Mary Facella, dated July 25, 2005, stating her opinion that too much time had passed since our contract was signed in November 2003,so the contract is void, and the clubhouse is no longer for sale. This fax confirmed our suspicions that YDF did not intend to abide by the legally binding contract; the letter affirms a breach of contract on their part. Since no response was received from YDF to earlier letters, our attorney had already started to draft a lawsuit for enforcement of the contract.

We filed the lawsuit with the Court prior to our settlement date (scheduled for August 19, 2005) and attempted to serve the lawsuit on YDF hoping that they would choose to settle. Service was attempted on their McLean headquarters and their Maryland agent’s address, both of which were found to be vacant and unoccupied, violating their corporate responsibility to keep us notified as to where they can be reached. The suit was next served on Maryland’s State Department of Assessments and Taxation, a valid service under Maryland procedural rules.

The settlement attorney left a message at YDF’s telephone number a few days prior to settlement, but Mary Facella’s return call stated that YDF would not attend the settlement. We also received a letter from YDF’s president, Mario Facella, stating again that the clubhouse is not for sale and the property will be used as a youth camp. We were advised by our attorney to be present for settlement despite their statements, but settlement did not occur. Members of the SCA were present as were our attorney, a representative from our lending institution, and the court-appointed settlement attorney. YDF, however, did not appear.

We heard nothing more and were not even sure YDF knew of the lawsuit until early October when our attorney was contacted by an attorney who was apparently being interviewed by YDF to represent them. As a corporation, they must be represented by an attorney in court though they have been without one for many months, and we do not know whether they have actually hired someone to represent them. We are currently awaiting a court date.

Nettle Nets

The jellyfish nets were taken down and put away in late September. The damage caused by a vandal(s) earlier in the summer was repaired; therefore, new nets will not need to be purchased next season. Special thanks to the volunteers who helped take down the nets this year and spent extra time repairing the damaged nets: Jerry Brice, Todd Croteau, Bill Harding, Alan Lanier, Bruce and Susan Lanier and Yolande Nanayakkara.

Storm Drain Upgrade

At our Annual Meeting in August, Merrill Plait, Chief of Environmental Engineering for AnneArundelCounty, presented plans for storm drain upgrades in Selby. The area marked for the upgrades is between Selby Boulevard, Hillside Avenue, 4th and 5th Avenues. The outfall of the system will be near SelbyYachtBasin. Approximately 40 to 50 properties will need to grant easements for the system to allow for installing pipes and for maintenance. The County was to survey the necessary area by September 2005, and then the properties would be appraised. Offers to purchase easements from property owners should take place in December 2005. If all goes as scheduled, and there aren’t objections from property owners, construction will start in January or February 2006 and be completed around June 2006. Golf Carts and Go Carts

The use of vehicles resembling golf carts and/or go carts in Selby has proliferated over the past several months. It is illegal to operate these types of vehicles on County roads. The vast majority of streets in Selby are owned by the County, including those which may have been privately owned in the past. (If, at some point, a snowplow has been on your street and/or you don’t have to maintain the street yourself, it means your street is owned by the County.) Most of the golf carts and/or go carts seen in Selby are being operated by youth. Many times the carts are overloaded with passengers and are being driven recklessly, sometimes after dark. Not only are there dangers for the drivers and passengers of these vehicles, but pedestrians (including small children) have been threatened as well. Please consider the risks of operating a vehicle illegally in the community or allowing your child(ren) to operate a vehicle illegally, especially the liability you would have if someone were to be injured (or worse) while driving or riding.

Operation ID

Selby on the Bay is participating in Operation ID. This program involves using an engraver to etch your driver’s license number onto your valuables, or photographing them instead, in order to assist police with locating your belongings if they are ever stolen. You will receive two Operation ID stickers to place on doors or windows of your house to let others know you participate in this program. To borrow an engraver, or for more information, please call Beth Livingston at 410-798-9474.

Selby on the Bay

If any community resident is having a problem on his or her street, please call Dennis Gheen and report it to him as well as to the police. Mr. Gheen will discuss the problem with you and keep a record of it to be compiled in a report to be reviewed by the county police so that problem areas in the community can be addressed. Additionally, the Southern District County Police has an officer available to answer any questions and concerns by any resident through the Police and Communities Together (P.A.C.T.) program, whose goal is to build a working partnership between the citizens of AnneArundelCounty and the police department to improve our quality of life.
