TIME AND PLACE: The informal conferences held before an Agency Subordinate of the Board of Nursing were convened at 9:03A.M., on November 10, 2015 in Hearing Room 5, Department of Health Professions, 9960 Mayland Drive, Suite 201, Henrico, Virginia.

STAFF PRESENT: Linda Kleiner, R.N., Case Manager

OTHERS PRESENT: David Kazzie, Adjudication Specialist

CONFERENCES

SCHEDULED: Kelly Vargas, R.N. 0001-248732

Ms. Vargas did not appear.

Based upon information provided by Mr. Kazzie, Dr. Elliott ruled that adequate notice was provided to Ms. Vargas.

A recommended decision will be made and mailed to Ms. Vargas within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall be a Final Order.

CONFERENCES

Ms. Johnson did not appear.

Based upon information provided by Mr. Kazzie, Dr. Elliott ruled that adequate notice was provided to Ms. Johnson.

A recommended decision will be made and mailed to Ms. Johnson within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall be a Final Order.

Ms. Brantley did not appear.

Based upon information provided by Mr. Kazzie, Dr. Elliott ruled that adequate notice was provided to Ms. Brantley.

A recommended decision will be made and mailed to Ms. Brantley within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall be a Final Order.

CONFERENCES

Ms. Hicks appeared.

Ms. Hicks was informed that a recommended decision will be made and mailed to her within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall become a Final Order thirty days after service of such order on Ms. Hicks unless a written request to the Board for a formal hearing on the allegations made against her is received from Ms. Hicks within such time. If service of the order is made by mail, three additional days shall be added to that period. Upon such timely request for a formal hearing, the Order shall be vacated.

Ms. Tusing appeared, accompanied by her attorney Margaret Hardy.

Ms. Tusing was informed that her case will be closed due to insufficient evidence to warrant disciplinary action by the Board of Nursing.

Ms. Jacobs appeared.

Ms. Jacobs was informed that a recommended decision will be made and mailed to her within ninety days.

This recommendation will be presented to the full Board; if accepted, an Order will be entered. As provided by law, this decision shall become a Final Order thirty days after service of such order on Ms. Jacobs unless a written request to the Board for a formal hearing on the allegations made against her is received from Ms. Jacobs within such time. If service of the order is made by mail, three additional days shall be added to that period. Upon such timely request for a formal hearing, the Order shall be vacated.
