PRIVILEGE OF THE FLOOR

The Village of Blasdell appreciates input from the General Public during the Privilege of the Floor which is offered at each Regular Meeting of the Board of Trustees, the following policy will be enforced at every meeting: Speakers must state their name, address and organization, if any. Speakers must be recognized by the presiding officer. Speakers will be limited to five (5) minutes per person per meeting. Speakers may not yield any remaining time they may have to another speaker. All remarks must be addressed to the Board of Trustees as a body and not to any member thereof. Speakers shall observe the commonly accepted rules of courtesy, decorum, dignity and good taste. Unacceptable behavior will not be tolerated and may result in removal from the building. Interested parties or their representatives may address the Board of Trustees by written communication. The public shall only be allowed to speak during the Privilege of the Floor period of the meeting.

NEW BUSINESS

Motion to accept the resignation of Jeffrey L. Devinney from the position of part-time Police Officer effective January 17, 2013.

Motion to add Trisha Fitzpatrick to the active rolls of the Blasdell Volunteer Fire Department effective immediately.

Motion authorizing the Mayor to execute an Energy Supply Services Agreement by and between the Village of Blasdell and New Wave Energy Corp. for the purchase of Electricity.

Motion to accept the low bid of $111.36 per unit from Modern Disposal for Year 1, with Alternate, of the Collection and Hauling of Mixed Municipal Wastes, Bulky Wastes and White Goods.

Motion to authorize the Mayor to execute an agreement by and between the Village of Blasdell and Modern Disposal for Year 1, with Alternate, of the Collection and Hauling of Mixed Municipal Wastes, Bulky Wastes and White Goods in an amount not to exceed $98,000.00.

Motion to appoint Caitlyn J. Ebert to the position of temporary part-time records clerk.

Motion to adopt the following Resolution:

WHEREAS, a Project, for Pedestrian Safety and Streetscape Improvements at the US Route 62, South Park Avenue Intersection with Lake Avenue, in the Village of Blasdell, Erie County, PIN 5757.69, (the Project) is eligible for funding under Title 23 US Code, as amended, that calls for the apportionment of the costs such program to be borne at the ration of 80% Federal Funds and 20% Non-Federal funds; and

WHEREAS, the Village of Blasdell desires to advance the Project by making a commitment of 100% of the Non-Federal share of the costs of the Preliminary Engineering (Design V&VI) and Construction & Construction Inspection phases of the project PIN 5757.69.

NOW, THEREFORE, the Board of the Village of Blasdell, duly convened does hereby

RESOLVE, that the Board of the Village of Blasdell hereby approves the above subject project; and it is hereby further

RESOLVED, that the Board of the Village of Blasdell hereby authorizes the Village of Blasdell to pay the Non-Federal share of the cost of the Preliminary Engineering (Design V&VI) and Construction and Construction Inspection phases of the Project or portions thereof, with the Federal share of such costs to be applied directly by the New York State Department of Transportation (NYSDOT) pursuant to Agreement; and it is further

RESOLVED, that the sum of $72,790 is hereby appropriated from InfraStructure Reserves (in addition to the $17,200 previously appropriated for the Project’s Preliminary Engineering Phase via a Village Resolution adopted April 14, 2010) and made available to cover the cost of participation in the above phases of the Project; and it is further

RESOLVED, that in the event the NON-Federal share of the cost of the project’s Preliminary Engineering (Design V&VI) and Construction & Construction Inspection phases exceeds the amount appropriated, $89,990, the Village of Blasdell shall convene its Board as soon as possible to appropriate said excess amount immediately upon the notification by the New York State Department of Transportation thereof; and it is further

RESOLVED, that the Mayor of the Village of Blasdell be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid on behalf of the Village of Blasdell with the NYSDOT in connection with the advancement or approval of the Project and providing for the administration of the Project and the Municipality’s funding of the local share of Federal-Aid Eligible Project costs and all Project costs within appropriations therefor that are not so eligible; and it is further

RESOLVED, that a certified copyof this Resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project; and it is further

RESOLVED, this Resolution shall take effect immediately.
