UTA ATV RIDE LIABILITY WAIVER

TERMS OF PARTICIPATION:

The Undersigned hereby represents and/or acknowledges:

1. As organizer of the UTA ATV Ride (“the Event”), the Utah Trucking Association, its employees, officers, directors, affiliates, volunteers, sponsors, guides, agents and assigns (collectively referred to as “the UTA”) is acting as a facilitator of the Event, and makes no representation or warranty regarding the hazards associated with participation. These risks include but are not limited to the operation of the motorcycle and/or vehicle, the condition of the roads used, the presence or risk of confrontation with other vehicles, the knowledge or expertise of the guides, and the level of any expertise or personal physical condition required to participate;

2. The UTA makes no representation or warranty that the Event will not be cancelled, rescheduled, abbreviated or modified in any way. Any monies paid by the Undersigned to the UTA associated with the Event are a voluntary contribution to a non-profit organization, and as such are non-refundable in whole or in part;

3. The Undersigned is solely responsible for furnishing: a. His/her own vehicle for use in the Event, and any maintenance repairs to the vehicle required during the event; b. Any and all safety equipment associated with operating a vehicle and/or participating in the Event, including helmets, sunglasses, face masks, safety pads, etc.; c. Liability and Medical insurance covering the Undersigned, any passengers accompanying the Undersigned, and any minor family members accompanying the Undersigned during the Event; d. A valid Operator’s license, permitting the Undersigned to operate his/her vehicle under the laws of the State of Utah; e. Transportation to and from the Event, at the locations designated by the UTA.

4. The Undersigned has legal authority and hereby executes this Release on behalf of any and all minor children accompanying the Undersigned at the Event In consideration of his/her participation in the Event, the Undersigned hereby agrees to indemnify, defend and hold harmless the UTA from any and all claims of liability for personal injury or property damage suffered by 1) the Undersigned while participating in the Event, or 2) Third Parties who may be injured by the Undersigned while participating in the Event.
