WESTERN PROVINCE YOUTH CRICKET ASSOCIATIONCONSTITUTION

  1. NAME

The body shall be called the Western Province Youth Cricket Association (WPYCA), hereinafter referred to as the Association.

  1. LAWS OF CRICKET

The laws of Cricket (as adopted by Cricket South Africa, and applied by WPYCA) together with the authorised interpretations and decisions thereon, shall be adopted.

  1. COLOURS AND EMBLEM

The colours of this Association shall be royal blue and white. The emblem shall be as decided upon by the Western Province Cricket Association. The Executive shall have the power to decide on colours to be worn by any representative side.

  1. OBJECTIVES

The objectives shall be:

4.1To provide for the development of the game of cricket among those of school-going age;

4.1.1to regard the development of those who have not previously played as of equal importance to the development of those with experience and proven skills;

4.1.2to engage actively in the provision of cricket, including coaching and playing opportunities, to all who wish to play;

4.1.3to provide for representative cricket in order that the best players should develop their abilities and fulfil their aspirations;

4.1.4to extend playing opportunities to those who aspire to representative honours but need exposure to the game in order to fulfil their ambitions.

4.2To advance the interests of cricket in South Africa generally.

4.3To advance the interests of schools sport in South Africa and, particularly, the welfare of its national schools sport governing body.

4.4To collaborate and liaise with primary/high school counterparts, as well as organisations for cricket at the tertiary level, in order to facilitate the development of cricketers along a continuum.

4.5To represent regional affiliates to which the task of giving effect to the Founding Principles and Objectives must devolve.

4.6To control the establishment and organisation of regional/zonal competitions, festivals and tournaments.

4.7To provide for the selection of representative teams, and to control all matters concerning these teams.

4.8To raise funds either by sponsorship or other means and to spend such funds in pursuit of the Objectives and in accordance with the Founding Principles.

4.9To settle any disputes which may arise within, between, or among affiliates of the Code.

  1. PRINCIPLES

5.1The Code shall be non-racial and permit no discrimination, except on the grounds of ability, within its structures as well as those of it its affiliates.

5.2In its zones and operation, the Code shall reflect a commitment to the democratic right of members to be consulted and to participate as fully as possible in the policy-making process.

5.3In addition to its role in respect of cricket, the Code shall recognise the significance of its social and educative roles, and actively pursue the promotion and development of ethics of justice, tolerance and understanding and a spirit of common humanity among the players it represents.

5.4Transformation

5.4.1The Code acknowledges the extent to which the majority of Western Cape inhabitants have been disadvantaged in the past. Accordingly, it shall engage in affirmative action and work towards redressing the inequities.

5.4.2Recognising that there will always be talented players and administrators disadvantaged by their circumstances, the Code shall subscribe continuously to the principle of affirmative action.

  1. BOUNDARIES

The boundaries of the WPYCA shall be determined by Cricket South Africa and/or the national schools sports governing body and shall be reflected in the constitution of the WPYCA.

All clubs/schools outside these boundaries, as at the date of the adoption of the constitution, be allowed to continue playing in the Western Province until such time as they wish to join another provincial body or until the Executive decides otherwise.

  1. MEMBERSHIP AND AFFILIATION

7.1The Association shall consist of the following members:-

  • Affiliated Schools
  • Affiliated Clubs
  • Clubs and Schools which may hereafter become affiliated

7.2The WPYCA is affiliated to the provincial and national schools sports governing body.

7.3The WPYCA is a full member of the Western Province Cricket Association.

7.4Any new affiliate (club) must have a minimum of two (2) teams and one (1) field.

  1. ANNUAL FEE

The maximum annual fee payable by members shall be as determined by the Executive Committee. Specific adjustments to such fees must be proposed at Annual General Meetings for members’ approval.

  1. OFFICE BEARERS

9.1The Executive Committee

9.1.1Subject to the Constitution and to the rules, bye-laws and regulations of the Association, the administration of the Association shall be vested in an Executive Committee.

9.1.2An additional co-opted person from the Girls Cricket Sub-Committee will serve on the Executive Committee.

9.1.3The Executive Committee shall consist of the Chairperson, Vice-Chairperson and eight (8) additional membersthat shall be elected at anAnnual General Meeting. The term of office of Executive members will be two (2) years

9.1.4Not more than two members shall be from any one club/school.

9.1.5No member of the Executive Committee, including the Chairman and Vice Chairman, shall be elected to office who is not a full member of a club/school affiliated to and in good standing with the WPYCA.

9.1.6Nominations for election to the Executive Committee shall be in writing and shall reach the Secretary no less than seven days before the Annual General Meeting. All nominees must indicate acceptance of their nomination in writing and such written acceptance is to accompany the nomination.

9.1.7Should any vacancy on the above Committees occur, the Executive Committee shall have the power to fill the vacancies provided that 9.1.3 is not thereby abrogated.

9.1.8In the event of the position of Chairman or Vice Chairman falling vacant, the Executive Committee shall fill such position at the next meeting.

9.1.9Meetings of the above Executive Committee shall be held as required.

9.1.10At any meeting of the above Committee, fifty percent of the members, plus one, shall constitute a quorum.

9.1.11Absence from three consecutive meetings without apologies having been made shall ipso facto be considered as resignation from the Committee.

9.1.12The Committee shall have the power to co-opt where necessary. Co-opted members shall not have a vote unless they have been co-opted to fill a specific vacancy caused by a resignation or in terms of 9.1.10.

9.1.13Serving members of the WPYCA Executive Committee shall be automatically re-nominated for election to said committee on condition that all conditions for eligibility are met. Serving members must inform the committee before 30th March in each year if they are not seeking re-election.

9.1.14The region (WP) shall be divided into FOUR /FIVE Districts as per the WCED Districts.

9.1.15Each District Committee shall be represented by ONE (1) member on the executive committee of WPYCA.

9.1.16Each District Committee shall consist of 8 elected members and shall serve for a period of 2 years in line with the term of office outlined in the Constitution of WPYCA.

9.1.17The District Committee shall comprise of:

-Chairperson

-Convenor: Coaches Committee

-Convenor: Team Selection

-Convenor: Leagues, Competitions, Tournaments

-General Secretary

-Treasurer

-PRO

-Convener: Technical Officials

9.1.18The District Committee shall hold the following meetings:

-TWO Executive Committee meetings per year;

-TWO General Council Meetings per year;

-An ELECTIVE General Council Meeting 14 days before the Regional Annual General Meeting

9.1.19Each of the following sectors SASAII, SAPD, DEAF Sport and LSEN shall have ONE (1) representative within the EIGHT (8) member Executive Committee, provided that they cater for Cricket.

9.2Life Members

Life members may be elected at the Annual General Meeting. Nominations must be made through the Executive Committee. A life member shall be a person who has, over a along period of time given meritorious service to Youth Cricket in the WesternProvince.

9.3Delegates to the WPCA/ Delegates to other relevant bodies

9.3.1 Two delegates from the Association to the WPCA shall be appointed at the first meeting of

the Executive Committee following the Annual General Meeting.

9.3.2 Delegates to the SA Schools Committee, Western Cape Cricket, WP Sports Council and any other relevant body shall be appointed at the first meeting of the Executive Committee following the Annual General Meeting.

9.4Selection Committees

9.4.1Nominations for selection to the respective selection committee shall be received by the secretary in writing.

9.4.2The Executive Committee shall ratify an Appointments Committee each year after the AGM. This Committee will include members from the senior body as well as from the WP Cricket Coaches Association.

9.4.3The Appointments Committee shall scrutinise, interview and if deemed necessary and recommend to the Executive Committee the various age group selection panels.

9.4.4The Executive Committee appoint the selector as well as the convenor.

9.4.5The Selection Committee shall be responsible for selecting teams to play in representative matches as authorised by the Executive Committee or trial games connected therewith, in the ensuing calendar year.

9.4.6A minimum of six members shall be appointed annually, no more than one member representing the same club/school.

9.4.7No one other than a full member of an affiliated club/school, as defined in 9.1.4, may serve on a Selection Committee.

9.4.8The convenor shall have the power to co-opt additional selectors in an advisory capacity.

9.5Girls Cricket

9.5.1To advance the interests of Girls Cricket at the age group levels of U13, U15 and U19.

9.5.2To engage actively in the provision of cricket including coaching and playing opportunities to all those girls wishing to play in the age groups stipulated in 9.5.1.

9.5.3The eligibility clauses 13.1 and 13.2 will apply to girls cricket.

9.5.4Only bona fide members of any club/school, which is affiliated to and in good standing with the WPYCA, shall qualify to represent the WPYCA at any national or regional tournament. Only those girls still in attendance at school will qualify.

9.5.5A selection committee shall be responsible for selecting teams to play in representative matches authorised by the Executive Committee.

9.5.6Girls cricket will be bound by all other clauses found in the Constitution of the WPYCA.

9.5.7The Girls Cricket Sub-committee will function as a sub-committee of the Executive Committee and will be constituted as follows :

  • Convenor – appointed from the Executive Committee.
  • Convenor of Selectors – to be appointed by the Executive Committee.
  • Representative from Women’s Cricket.
  • Representative from Senior Youth Cricket.
  • Representative from Junior Youth Cricket.
  • WPCA representative.
  • Secretary.

10.MINUTES AND REPORTS

10.1The Secretary shall keep minutes of every Annual General Meeting or Special General Meeting and of every Executive Meeting or Committee Meeting. Such minutes should be presented to the next appropriate succeeding meeting for confirmation and signature.

10.2An annual report shall be presented to the Annual General Meeting each year.

10.3The WP Youth Cricket Co-ordinator shall act as secretary at Executive meetings.

  1. COMPETITIONS AND LEAGUES

11.1The following divisions shall be organised annually:

Junior Youth-U10, U11, U12, U13

Senior Youth-U14, U15, U17, U19

11.2The division for which a player is eligible corresponds with the age reached during the year i.e. if a player turns 15 in 1996, he is under 15 for the whole of that year.

No exceptions to these age limits are to be made.

11.3The Executive Committee shall have the power to divide any playing division into sections and to decide in which division or playing section a team shall play and to organise additional divisions.

11.4Any affiliate leaving our borders to play cricket must inform the Association of a such intended tour.

11.5Fixtures against clubs/schools outside the jurisdiction of the WPYCA must be approved by the Executive Committee. Permission to participate in such fixtures must be requested in writing.

  1. ELIGIBLITY OF PLAYERS

12.1Players eligible for matches under the control of the WPYCA shall be those players who are bona-fide members of any club or school which is a member of and in good standing with the WPYCA.

12.2Players shall be eligible up to and including the year in which they turn 19.

  1. REPRESENTATIVE GAMES

13.1Only players eligible under section 13 shall be eligible for representative games, always providing that their clubs/schools are in good standing with the Code.

13.2A representative match shall be deemed to be one if a team taking part is drawn from more than one club or school and which bears a name, title or designation which implies or suggests that it is representative of the Code, or any of its divisions and which is organised under the auspices of the Code.

13.3Managers and Coaches of such teams shall be appointed by the Executive Committee or an officially designated “Appointments Committee”.

13.4Eligibility of players participating in specific tournaments or weeks shall be subject to the rules and conditions of such weeks as determined by the bodies controlling such weeks.

13.5Managers and coaches of the teams participating in the major weeks shall be appointed by the respective Committees. No one shall serve as manager or coach of a particular team for more than 3 consecutive years.

  1. GENERAL MEETINGS AND SPECIAL GENERAL MEETINGS

14.1General Meetings and Special General Meetings shall be summoned as hereafter provided:

14.2Annual General Meeting

There shall be one Annual General Meeting for the WPYCA. This will deal with business affecting Junior Youth and Senior Youth Cricket in the province.

14.3Special General Meetings

14.3.1It shall be competent for the Executive Committee to call a Special General Meeting of the Code for any purpose which it deems fit.

14.3.2It shall be further competent for a Special General Meeting of the WPYCA to be called at the request of ten or more clubs/schools which are members of and in good standing with the WPYCA, in order to discuss any business specified by such clubs/schools, such specified business to be stated on the notice of such Special General Meeting. No other business may be discussed at such a Special General Meeting.

14.4Twenty-one day’s notice of any General or Special General Meeting shall be given in writing to all clubs/schools affiliated to the WPYCA. In the case of a Special General Meeting held at the request of ten or more clubs/schools as provided for in 15.3.2, such meeting shall be held not later than twenty-eight days after such request is received by the Secretary.

14.5Fourteen days notice of proposed motions to be dealt with at an Annual General Meeting shall be given in writing to the Secretary. Such motions must be accompanied by a Memorandum. Such motions must appear on the agenda of the Annual General Meeting which shall be circulated with the notice of meeting.

14.6In introducing a motion at any General Meeting, the speaker shall be allowed 8 minutes, and all subsequent speeches, including the introducer’s reply, shall be limited to 5 minutes.

14.7Each club/school in good standing with the WPYCA shall be allowed one delegate per five teams (or part thereof) participating in divisions controlled by the Code. Each delegate as well as each committee member shall be entitled to a vote at a General Meeting, provided that no-one can vote twice (i.e. as a committee member and as a delegate).

14.8Any interested person is entitled to attend a General Meeting of the WPYCA.

14.9A quorum shall be made up of those present at the meeting.

  1. CHANGES OF CONSTITUTION

15.1This Constitution shall only be changed, altered, amended, repealed or added to by means of a majority vote at a General Meeting of the WPYCA.

15.2Notwithstanding 16.1 this Constitution may be changed, altered, amended, repealed or added to by means of an unopposed motion at any Annual General Meeting of theWPYCA.

15.3Such change, alteration, amendment, repeal or addition shall become effective as from the date to be fixed by the General Meeting.

  1. DISSOLUTION

Should the WPYCA for any reason cease to function, all assets will revert to the Western Province Cricket Association.

  1. DISCIPLINARY ACTION

The Executive Committee shall have the right to react appropriately to any report of misconduct, misdemeanour, breach of Rules and By-laws by players, officials, schools, clubs, brought to the Code’s notice.

The Committee will, in most cases, refer all cases of misconduct to the relevant authorities managing, controlling and administering the clubs/schools which are involved.

The Committee will however, reserve the right to suspend, reprimand, or caution any school/club for any period it seems fit. Such a decision will only be made in the most extreme of circumstances and will be conveyed in writing to the party concerned.

  1. TRANSFER OF PLAYERS

In the event of a player, attending a school which is affiliated to the WPYCA, wishing to play for a club, the school shall have first option on the services of such a player. By mutual agreement between club and school, however, the player may play for a club.

  1. INDEMNIFICATION

All members of the Executive Committee, elected members of regional and other officially appointed Committees, are hereby deemed to be indemnified by the WPYCA in respect of any liability incurred by them (or any of them as individuals) in the due and proper performance of their delegated powers.
