We, [insert booking party company name], the undersigned company, as booking party, have prepared booking order, and tender OOCLL booking of heavy / high density commodities [delete where inapplicable: Stone products, Metal Coils, Steel products ( pipes, sheets, plates )] [specify if others].
We warrant that:
a) we are the Shipper or we have full authority on behalf of the Shipper to make the booking;
b) we understand that the information may be used for preparing bill of lading and declaration to the customs and relevant authorizations, and OOCL's reliance thereon is hereby acknowledged;
c) we shall comply with all rules, laws and regulations of any national or local government and/or other authorities relating to Goods described above, including without limitation, any weight limit;
d) we shall indemnify OOCL and hold OOCL harmless in respect of any liability, loss, damage or expense of whatsoever nature and howsoever arising which you may sustain as a result of our lacking authority to make the booking and/or any of the information provided to OOCLL being untrue, inaccurate or incomplete and/or non-compliance with (c) above and/or any breach of the warranty and undertaking made herein for the proper blocking and bracing and loading of products in the container and the use of a container or trailer that is for any reason suitable for the movement of the products.
e) following inspections took place:
(i) Pre-loading. Inspection of equipment, particularly undercarriage for suitability.
(ii) Loading. Loading specification approved by authority if applicable to the shipment, or loaded on an approved load and roll pallet or similar weight distribution device. Blocking/bracing, gross weight, weight distribution and concentrated weights are complying with authority.
(iii) Post-loading inspection. Inspection of equipment, particularly undercarriage, has been completed and equipment deemed suitable to carry concentrated weights.
We understand that under no circumstance shall this letter constitute a binding agreement to carry or for provision of carriage services by the Carrier. The Carrier may at its sole and absolute discretion at any time and without prior notice change the arrangement or make alternate arrangement. The actual provision of carriage service is subject to the availability of the Carrier’s equipment, vessel, haulage and/or other means of transport and subject to the terms and conditions set out in OOCL’s standard bill of lading.
We further agree that this request/declaration and any undertaking or indemnity contained herein shall be construed and governed in accordance with English law.
