MAY 7, 2015

Mayor Moslowski Jr. called the meeting to order at 7:02 p.m. and requested the Clerk to call the roll. The following Committee Members were present: Stephen J. Alexander, Robert Faber, Dr. Robert A. Frascella, LoriSue H. Mount and Mayor Stanley Moslowski Jr. Also present at the dais: Dana L. Tyler, Municipal Clerk, Dianne Kelly, CFO/Administrator and Dennis A. Collins, Township Attorney, Esq.

Following the Flag Salute, the Clerk announced that the Notice requirements of R.S. 10:4-18 for an "Annual Notice" had been satisfied by the publication of the required advertisement in the Asbury Park Press and the Messenger Press January 15, 2015, posting the notice on the Board in the Upper Freehold Township Municipal Building and filing a copy of said notice with the Municipal Clerk.

NOTICE OF PUBLIC MEETING: Notice requirements of R.S. 10:4-18 for an "Annual Notice" has been satisfied by the publication of the required advertisement in the Asbury Park Press and the Messenger Press on January 15, 2015 posting the notice on the Board in the Upper Freehold Township Municipal Building and filing a copy of said notice with the Municipal Clerk.

  • JCP&L will be conducting Spring Transmission Aerial Patrol. The inspections are scheduled to
    begin May 4th and typically require approximately 2 weeks to complete depending on the
    weather. The helicopter will be flying slowly (20-30 mph) along the lines, and may hover at any
    time for a closer inspection. The helicopter scheduled for these patrols is a black MD500 with
    Red Letters, with registration (tail) number N8330P.

Land Use Notices:

  • State of NJ, Department of Environmental Protection – Application No. 2620P to divert water

from 8 existing and 14 new wells, in Upper Freehold Township, Monmouth County.

  • Plumsted Township submitted an application to the Joint Land Use of Plumsted for a Preliminary & Final Major Site Plan approval regarding Block 60, Lot 22 803 Route 539 in Plumsted. This is for construction of 10 high rate grid battery system housed in 53’ containers

ORDINANCE 269-15 – PUBLIC HEARING

AN ORDINANCE AMENDING CHAPTER IIA (FEES) SECTION 2A-4.1

(FEES FOR RECREATION) OF THE REVISED GENERAL ORDINANCES

THE TOWNSHIP OF UPPER FREEHOLD.

PUBLIC HEARING: Mayor Moslowski Jr. opened the public hearing on Ordinance 269-15. There being no comments from the Public a motion was offered by Dr. Frascella, moved and seconded by Mr. Alexander to close this hearing; this motion was carried by the following vote: Ayes, all; Nays, none. Motion Carried.

Ordinance 269-15 was offered for adoption on second reading by Dr. Frascella, moved and seconded by Mr. Alexander. This Ordinance was adopted by the following vote Mr. Alexander, aye; Mr. Faber, aye; Dr. Frascella, aye Ms. Mount, aye; and Mayor Moslowski Jr., aye.

RESOLUTION108-15A RESOLUTION AUTHORIZING PAYMENT OF BILLS

The following Resolution was offered by Mr. Alexander, moved and seconded by Ms. Mount.

RESOLUTION 109-15 A RESOLUTION TO HIRE ADDITIONAL PER DIEM

FIREFIGHTER EMPLOYEES TO BE ON-CALL

The following Resolution was offered by Dr. Frascella, moved and seconded by Mr. Alexander.

WHEREAS, Upper Freehold Township adopted an Ordinance to create the position of Firefighter for Hope Fire Company #1 to fill a need in the community to have permanent employees available during the day to insure efficient response to emergency calls; and,

WHEREAS, this effort is being funded through a Shared Services Agreement with the Borough of Allentown; and,

WHEREAS, it is necessary to have several qualified Per Diem Firefighters on-call to fill in during vacation days, sick days, or under other circumstances that may arise; and,

WHEREAS, Supervisor of the Fire Department has recommended Mr. Nicholas Jakelsky to be hired by Upper Freehold Township on an on-call basis to be paid a per diem salary based on an hourly rate of $ 13.00 per hour, and;

WHEREAS, funds for this purpose are available in the 2015 Budget in the appropriation known as Fire: Salary & Wages , Account Number 5-01-25-265-013 and the Chief Financial Officer/Treasurer has so certified in writing.

NOW, THEREFORE, BE IT RESOLVED, that Mr. Jakelsky are qualified applicants and are hereby hired on an on-call basis at a per diem salary based on an hourly rate of $13.00 per hour:

RESOLUTION 110-15 A RESOLUTION ESTABLISHING SALARIES FOR CERTAIN
EMPLOYEES AND CERTAIN TOWNSHIP OFFICIALS FOR THEYEAR 2015

The following Resolution was offered by Dr. Frascella, moved and seconded by Mr. Alexander.

WHEREAS, Ordinance -15 of the Township of Upper Freehold as adopted June 5, 2014 established salary ranges for Employees and Township Officials of the Township; and,

WHEREAS, the Township Committee of Upper Freehold Township wishes to set the salary for certain Employees and Township Officials that hold specific titles, except as otherwise noted; and,

WHEREAS, funds for this purpose are available in the 2015 Budget, and the Chief Financial Officer has so certified in writing.

NOW, THEREFORE, BE IT RESOLVED, that in accordance with Ordinance 200-08 the following salary schedule be and the same is hereby established in accordance with the salary ranges and conditions in the aforementioned ordinance. Retroactive where applicable to 01/01/15 except where noted differently below.

BE IT FURTHER RESOLVED, that two certified copies of this resolution be filed forthwith in the office of the Director of the Division of Local Government Services.

resolution 112-15 a resolution authorizing an overpayment of taxes be refunded on block 47.01 lot 33

WHEREAS, the Tax Collector has certified that an overpayment has been made by the Sterling Title Agency, 2662 Nottingham Way, Hamilton, NJ 08619 on Block 47.01 Lot 33 for the homeowner Robert & Barbara Baker at 54 Minuteman Circle Allentown, NJ 08501 of $628.39 on the second quarter 2015 taxes, and

WHEREAS, Sterling Title is requesting that the duplicate overpayment be refunded.

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of Upper Freehold Township that the Tax Collector be and hereby authorized to refund $628.39 as stated above, and

BE IT FURTHER RESOLVED, that a certified copy of this Resolution be forwarded to the Upper Freehold Finance Office and the Tax Collector.

WHEREAS, applications have been submitted and applicable fees, by Amusements of America to the Township of Upper Freehold for licenses for various amusement games in accordance with Title 13:3-1.13 (a) 3 to be held at the Horse Park of NJ, 626 Route 524, in Upper Freehold Township on July 7 - 12, 2015.

NOW THEREFORE BE IT RESOLVED that the Township Committee of Upper Freehold Township does hereby approve Amusement Game Licenses (non-draw raffles) to Gerald F. Moss as listed and to be held at the Freedom Fest at the Horse Park of NJ, 626 Route 524 in Upper Freehold Township on July 7-12, 2015.

RESOLUTION 116-15 A RESOLUTION AUTHORIZING the CONTRACTING OF TWO REAL ESTATE APPRAISERS FOR THE WRIGHT FARM, BLOCK 24, LOT 12

WHEREAS, the State Agriculture Development Committee (SADC) has received an individual farm application for the sale of a development easement for the Wright Farm, Block 24 lot 12: and,

WHEREAS, the SADC staff has reviewed the application pursuant to N.J.A.C 2:76-17A.9 and determined that the application is complete and accurate and meets the minimum criteria referenced in N.J.A.C. 2:76-6-20:and,

WHEREAS, the SADC provided a “Green Light Approval” report to Upper Freehold Township for the purpose of authorizing the contracting of two real estate appraisers for appraisals on this farm; and,

WHEREAS, the SADC provided a list of approved real estate appraisers eligible to perform these services; and,

WHEREAS, Upper Freehold Township prepared a RFP and sent it to thirteen approved appraisers based on general geographic proximity to the Wright farm on March 30, 2015 ; and,

WHEREAS, Upper Freehold Township opened the Bids on the designated date of April 29, 2015 and read aloud the proposals for the services; and,

NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Upper Freehold that:

  1. The Township Committee of Upper Freehold Township and its Mayor and Clerk are hereby authorized and directed to engage the services of:

BE IT FURTHER RESOLVED, that a certified copy of this Resolution be forwarded to the Chief Financial Officer, the SADC, and the above listed professionals.

ORDINANCE 270-15 – INTRODUCTION

A BOND ORDINANCE AMENDING AND SUPPLEMENTING BOND ORDINANCE NUMBERED 262-14 OF THE TOWNSHIP OF UPPER FREEHOLD, IN THE COUNTY OF MONMOUTH, NEW JERSEY FINALLY ADOPTED MAY 8, 2014 IN ORDER TO AMEND THE DESCRIPTION OF THE PROJECT AND TO INCREASE THE APPROPRIATION.

The following Ordinance was offered by Mr. Faber, moved and seconded by Dr. Frascella.

BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF UPPERFREEHOLD, IN THE COUNTY OF MONMOUTH, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:

Section One.Section 3(a) of Bond Ordinance numbered 262-14 of the Township of Upper Freehold, in the County of Monmouth, New Jersey (the “Township”), finally adopted May 8, 2014 is hereby amended to read as follows:

“Various road improvements, consisting of Burlington Path Road from Meirs Road to Emley’s Hill Road, Wygant Road from Burlington Path Road to the end of the currently paved portion and the eastern section of East Branch Road beginning at County Route 524 and continuing past the two existing residential properties on that road, Breza Road (north end), Breza Road (south end), Walnford Road (north end), Walnford Road (south end), Davis Station Road from Meirs to County Route 526, and guide rail improvements along sections of Sharon Station Road, Hill Road and Yellow Meeting House Road, including all work and materials necessary therefor and incidental thereto.”

Section Two. $100,000 is hereby appropriated from the Capital Improvement Fund as a supplemental appropriation in addition to the original appropriation of $1,625,000 for the purpose described in Section 1 hereof.

Section Two.The Township hereby certifies that it has adopted a capital budget or a temporary capital budget, as applicable. The capital or temporary capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with the adopted capital or temporary capital budget, a revised capital or temporary capital budget has been filed with the Division of Local Government Services.
