Elk Point, S.D- State’s Attorney Jerry A. Miller announced today that Kristyna Dishman, a 35 year old Noblesville, IN resident was resentenced on November 18, 2013 on the two original felony charge of possession of controlled substance (“Bath Salts”) and forgery, a class 4 & 5 felony offense respectively. Dishman’s admitted to violating the terms and conditions of her supervised probation. Dishman failed to make any payments on her financial obligations and absconded from her probation officer. After Dishman absconded, her probation officer in Indiana filed a report with South Dakota, and a warrant for Dishman’s arrest was issued on August 1, 2013. Dishman was arrested on October 31, 2013.
Dishman was originally sentenced to a suspended 7 year sentences and placed on probation for 5 years. This is Dishman’s first probation violation since being sentenced originally on August 22, 2012. The facts of the original file indicated that Dishman was high on “Bath Salts” and stole a vehicle and made fraudulent use of a stolen credit card. Dishman fell asleep in the stolen vehicle in Beresford, SD and was reported to law enforcement. Following her arrest, Dishman became uncontrollable and paranoid due to the “Bath Salts” (a controlled substance which has nothing to do with salts that are used in bathing) and broke a window out of the Beresford police vehicle and jumped out of the police vehicle while it was still in motion on interstate 29. Dishman was treated for her self-inflicted injuries and caused $5,700 in damage to the Sanford Vermillion hospital emergency room equipment. Dishman’s history includes domestic assaults; Battery charges; public intoxication; and Dishman had admitted to also being a prostitute.
The Court took Dishman’s history and probation performance into account and sentenced her to 7 years in the penitentiary with 4 years suspended on the class 4 felony of possession of controlled substance. The Court sentenced Dishman to 2 years in the penitentiary on the class 5 felony for forgery consecutive to controlled substance sentence. Dishman will be incarcerated approximately 14 ½ months prior to being parole eligible. This is Dishman’s first career felony conviction.
