The outbreak of civil war in Somalia in 1990 has not only destroyed the public infrastructures but also harshly devastated the lives and the future of many thousands of children, young boys and girls who otherwise would have been the most productive segment of the society. The majority of children lack the basic rights- the right to education, the right to access health and safe drinking water, the right to be protected against violence, abuse, discrimination, and exploitation and the right to engage in recreational activities which can significantly contribute to their healthy physical, mental, moral and social development. Youth unemployment, low school enrolment, lack of recreational facilities, insecurity and volatility of the political environment are all factors which contribute to put young people at risk of engaging in negative actions and behaviour.
To contribute towards the healthy development of young people, and to enhance their access to sports and recreational services, the Youth Participation and Development Programme of UNICEF Somalia will collaborate with GTZ to provide additional recreational opportunities to the youth of the Bay and Bakool regions.
In the past years GTZ has been actively engaged in providing recreational opportunities to young people in the regions of Bay and Bakol. The strategy implemented by GTZ in the delivery of this programme will focus on PICD (Participatory Integrated Community Development) and on equipping young people with the opportunity to actively contribute in the social development processes of their communities.
Furthermore UNICEF will collaborate with GTZ in the restoration of the sport-fields, while the main restoration work (cleaning, measuring, fencing, etc.) will be done by the teams in order to assure their genuine ownership of the sports-grounds. The whole process will end with a fencing day, where the team-members and GTZ will work together to build-up a natural fence for the sports grounds. Members of the teams therefore will receive training in tree-planting and caretaking. While GTZ-DEA in cooperation with UNICEF is donating the tree-seedlings, the team-members are fully responsible for care-taking and protecting the trees. The underlying idea is not only to bring all team-members together for realizing a common goal, but also to raise awareness on the importance of environmental protection and re-forestation. In other words, interested youth will be involved form the words go through the PICD methodology, what gives them the opportunity to actively participate in all decisions made.
After the teams are organised and the sports-grounds restored, it is envisaged to assist the sports-groups in organizing an inter-regional football cup for peace. Such sport-events are means to bring people together in an enjoyable atmosphere and also constitute a media for community members to freely express their views on peace.
UNICEF will only fund 12,000 USD of the project while GTZ will contribute to fund the remaining activities.

Objectives:
The project has the following key objectives:
·  Organize and hold 1 tournament of football matches in all the mentioned districts specified in the Project Plan
·  Rehabilitate 10 sport facilities (football pitches) utilising participatory integrated community development approaches in the districts specified in the Project Plan
·  Organize and hold two leadership training for young people per sports association (group) with 12 trainees per group and training.
Indicators:
·  1 inter regional tournament involving 30 youth soccer teams held
·  10 sport facilities rehabilitated
·  2 leadership trainings and 120 of young people who attended it
·  At least 5,000 youth reached through the inter-regional soccer tournament.

Project Cooperation Agreement (PCA)

Project Cooperation Agreement

between

UNICEF, the United Nations Children's Fund

and

[GTZ]

THIS PROJECT COOPERATION AGREEMENT and its annexes (this “Agreement”) is made on [insert date]

BETWEEN: UNICEF, THE UNITED NATIONS CHILDREN’S FUND ("UNICEF"), an international inter-governmental organization established by the General Assembly of the United Nations, having its office in [name of country] at [address of country office]

AND: GTZ –Somalia, Improvement of Livelihood in Bay Region, an organisation having its offices at P. O. Box 41607, GTZ Regional office, Lenana Road, Kilimani, Nairobi / Kenya

GENERAL PRINCIPLES

A.  UNICEF works with governments, civil society organisations and other partners worldwide to advance children’s rights and is guided by the Convention on the Rights of the Child and the Convention on the Elimination of All Forms of Discrimination Against Women. GTZ shares UNICEF’s commitment to the principles enunciated in these Conventions.

B.  The Country Programme Action Plan (CPAP) establishes the agreed framework within which UNICEF may cooperate with non-governmental partners and local authorities in the country. The Project Plans of Action provide the more detailed annual programmatic framework for UNICEF’s cooperation in projects with partners.

C.  Within these frameworks, UNICEF and GTZ have developed the [name of project] project (the “Project”). The Project is covered by this Agreement and is more fully described in the project document attached to this agreement as Annex A (the “Project Plan”).

D.  Both UNICEF and GTZ are committed to the principles of participatory and sustainable development and to providing assistance impartially. They are mindful of culture and custom, and of building local capacity, and of their respective accountabilities to their funding partners and to those whom they assist. They will not expose intended beneficiaries, including children to any form of discrimination, abuse or exploitation. Sexual activity with children (persons under the age of 18) is prohibited regardless of the local age of consent. Sexual exploitation and abuse of children by personnel of the parties to this agreement constitutes gross misconduct and will cause immediate termination of this agreement.

E.  GTZ affirms that it is not profit-oriented and non-partisan, and that it has the capacities to carry out the activities outlined in this Agreement.

F.  UNICEF and GTZ have agreed to cooperate to implement the Project, in accordance with the Project Plan and the agreed-upon budget which is attached to this agreement as Annex B (the “Project Budget), and [any other document of relevance, i.e. list of equipment], attached to this Agreement as Annex(es) --

G.  They will carry out their respective responsibilities in the spirit of partnership and in consultation.

GENERAL PROVISIONS

1.  UNICEF and GTZ will work together in the implementation of the Project, and complete the tasks identified as their respective responsibility in the Project Plan, in conformity with the Project Budget.

2.  UNICEF and GTZ will each designate a person who will be given authority for overseeing the Project on its behalf. UNICEF and GTZ will jointly designate the Project Manager, if any.

3.  UNICEF and GTZ will keep each other informed on the progress of their work in connection with the Project. Consultation meetings will take place at least every three (3) months or more frequently as circumstances demand. UNICEF will make all relevant information and advice available to GTZ.

4.  GTZ may use the UNICEF name, logo, and emblem, but only in connection with the Project and only with the prior written consent of UNICEF. The UNICEF name, logo, and emblem may only be reproduced in ways set out in UNICEF's "Identification Standards Manual".

SUPPORT TO THE PROJECT

5.  The Project Budget identifies certain inputs that will be funded by UNICEF. UNICEF will meet the costs of those inputs through cash transfers to GTZ ("cash input").

CASH INPUT

6.  The amount of cash input to be provided by UNICEF is set out in the Project Budget. UNICEF will provide the agreed amount of cash input in a number of instalments. UNICEF will transfer the first instalment, equal to 60 percent (7,200) of the total costs to GTZ within two (2) weeks after both UNICEF and GTZ have signed this Agreement and GTZ has provided a written request for this transfer indicating the amount and a breakdown of how the funds will be spent. A subsequent instalment covering the remaining 40 percent (4,800) of the costs will be made at the completion of the project and only after GTZ has accounted for the previous instalment and provided a written statement indicating the breakdown of how funds will be spent.

7.  GTZ will account for each instalment of cash input within from the date it is received. It will do so by providing UNICEF with original accounting documents (receipts, bills of payment etc.) that confirm the use of funds. UNICEF may review the acceptability of the documents as proof of the use of the funds as agreed. Further transfer of funds will not normally be made if any instalment of cash input has not been accounted for

8.  GTZ can vary the budgeted cost of any single input in the Project Budget to be funded by UNICEF, provided that (a) the variation is no more than ten percent (10%); (b) the variations are within the scope of the Project Budget objectives; and (c) the total Project Budget is not exceeded. Any variations exceeding ten percent (10%) require the prior written consent of UNICEF.

9.  UNICEF will fund the GTZ’s Project Support Costs, but for no more than two (2) years from the day this Agreement becomes effective regardless of the term of this Agreement, unless this period is specifically extended by the Parties through written agreement. In any year, the total of GTZ’s Project Support Costs will not exceed twenty-five percent (25%) of the total funds provided by UNICEF that year.

10.  Within three (3) months of either the termination of this Agreement or completion of the Project, whichever happens first, GTZ will return to UNICEF the balance of any funds provided by UNICEF to GTZ under this Agreement.

SUPPLIES AND EQUIPMENT

11.  The supplies and equipment (including vehicles, if any), to be provided by UNICEF to [GTZ] are listed in the Project Plan and the Project Budget [and [any other document, i.e. list of equipment] attached to this Agreement as Annex _ ].

12.  UNICEF and [GTZ] will each be responsible for meeting the costs of insurance on the supplies and equipment (including vehicles, if any) it uses in connection with the Project.

13.  UNICEF reserves the option to provide any vehicle to [GTZ] by way of loan, in which case the vehicle loan agreement will specify the conditions of the use, insurance, maintenance and care of the vehicle. This agreement, where applicable, will be attached to this Agreement as a further Annex. At the end of the loan period the Parties will agree on whether or not title will be transferred to [GTZ].

14.  UNICEF will normally undertake all international, off-shore procurement of supplies and equipment to be provided under this Agreement.

15.  When [GTZ] uses UNICEF funds for the local purchase of supplies and equipment it will select the supplier on the basis of competitive bids or quotations, unless otherwise agreed between the Parties on an exceptional basis (documented justification is then required), taking account of the principles of quality, economy and efficiency. Products will only be purchased from companies that meet the standards that have been established by UNICEF in relation to the protection of children’s rights.

16.  Within four (4) weeks of either the termination of this Agreement or completion of the Project, whichever happens first, [GTZ] will return to UNICEF any unused supplies which UNICEF provides to [GTZ] under this Agreement, and any usable equipment which UNICEF provided to [GTZ] under this Agreement. UNICEF may decide that these supplies and equipment are to be dealt with in a different way.

PERSONNEL

17.  GTZ is responsible for all work and services which its personnel, and any contractors, perform. It affirms that its employees and any contractors, also technical experts and consultants, meet the standards of qualification and technical and professional competence necessary for the achievement of the Project objectives. GTZ will ensure that all relevant national labour laws are observed.

18.  Employees of GTZ, its contractors or anyone else working for GTZ in the execution of the Project or otherwise, are not employees of UNICEF and are not covered by the privileges and immunities applying to UNICEF and its staff pursuant to the Convention on the Privileges and Immunities of the United Nations or otherwise. UNICEF is not liable for any claims of death, bodily injury, disability, damage to property or any other hazards which an employee of GTZ may suffer in connection with the execution of the Project. Where legally required to do so, GTZ will obtain and maintain all appropriate workmen's compensation and liability.

RECORD KEEPING and FINANCIAL REPORTING

19.  GTZ agrees to keep separate records with respect to funds provided to it by UNICEF. They will be accurate, complete, and up-to-date in respect to funds received and expenditures incurred with funds provided by UNICEF, and show that all disbursements are made in conformity with the Project Plan and the Project Budget. Original bills, invoices, receipts and any other pertinent documentation will be submitted to UNICEF.
