UNDERTAKING BY FOREIGN JOCKEYS LICENSED UNDER R.W.I.T.C. LTD RULES OF RACING

Dear Sir,

I acknowledge having received copy of the Rules of Racing, Notifications etc. I have read and understood all the implications of the said Rules and notices and accept the legality and validity thereof and I further hereby consent to be bound by all such Rules and notifications etc, which are in force from time to time. My particular attention has been drawn to Rules 49 (d) and 51 (G) (i) of the Rules of Racing of the RWITC Ltd, which read as under:

RULE 49 (d):

In any Appeal heard by the Board, the aggrieved person, i.e. the Appellant, shall be entitled to appear in person and/ or along with his spokesman (not being a practicing Lawyer) and to represent him and plead his Appeal before the Board. The Board shall not, in any event, call any Stewards of the Club or Stewards of the Meeting to give evidence or assistance in person.

RULE 51 (G) (i)

In any enquiry/appeal before the Stewards of the Meeting/ Stewards of the Club (as the case may be), the person against whom such enquiry/appeal is pending shall be entitled to appear in person and/or along with his spokesman (not being a practicing Lawyer) to represent him and plead on his behalf. PROVIDED HOWEVER, that such spokesman will not be permitted where such person is called upon to appear before the Stewards of the Meeting/Stewards of the Club (as the case may be), at any enquiry/ appeal/ proceeding conducted on an Objection taken on a race. PROVIDED FURTHER, that, the concerned person shall have to appear alone and no such spokesman shall be permitted in any enquiry/proceeding, (including preliminary enquiry), conducted by the Stipendiary Stewards or any other duly authorized Official/s of the Club.

It is clarified that when a Spokesman is permitted, as mentioned above, a person with a legal background/ qualification may appear but not a practicing Lawyer.

I hereby consent that no grievance shall be made by me on any ground whatsoever as regards the validity and/or applicability of the said Rules, notifications etc before any Racing Authority/ Turf Authority (in India or abroad) as by virtue of my request to RWITC Ltd for grant of a License, I hereby consent to be bound by RWITC Ltd Rules, notifications etc in the event of a License being granted to me by the RWITC Ltd. I have also been made aware that the RWITC Ltd has reciprocal arrangement with Racing/ Turf Authority in India and abroad and I hereby agree to abide by implications of such reciprocal arrangement between various Racing/ Turf Authorities here and abroad and specifically accept not to make out any grievances with any Racing/ Turf Authority about lack of Natural Justice due to any variations that may occur between the Rules of Racing of RWITC Ltd and the Rules of Racing of any other Racing/ Turf Authorities in India or abroad.

I further undertake that since I have been granted an “A” Jockey’s License to ride in RWITC Ltd, I shall make myself available to ride at Mumbai/ Pune on most Race Days during my stay in India, failing which the Stewards of the Club may cancel my “A” Jockey’s License.

I further agree and undertake that, during the pendency of any punishment imposed by RWITC Ltd., I shall not apply for or obtain a License from any other Racing Authority/ Turf Authority with which RWITC Ltd has a reciprocal arrangement. Any breach of this undertaking voluntarily given by me for effective enforcement of the punishment (if any) shall entitle the Stewards of the Club of the RWITC Ltd to refuse me the grant of License for such period as may be decided by them entirely at their sole and absolute discretion.
