UNAPPROVED MINUTES OF

April 24, 2012

The Moody County Commissioners met in regular session on Tuesday, April 24, 2012 in the County Commissioners' Room in the Courthouse at 9:00 AM, with the following members present: Tom Peper, Chairman, Jerry Doyle, Dan Miles, David Stenberg, and Rick Veldkamp, with Lori Schaefers, Auditor as Clerk of the Board. Also present: Brian Gebhart with the Moody County Enterprise.

Chairman Peper called the meeting to order. Motion by Stenberg, seconded by Miles to approve the agenda. All voted “aye”. Motion by Doyle, seconded by Veldkamp to approve the minutes of April 3, 2012. All voted “aye”.

Schaefers presented the General Fund Surplus Analysis as of March 31, 2012, as required by the Department of Legislative Audit. The total unreserved, undesignated fund balance of the General Fund as of March 31, 2012 was $990,020.96. This represents 24.57% of the total appropriations for the 2012 Annual Budget. Motion by Miles, seconded by Veldkamp to approve and file the General Fund Cash Surplus Analysis with the Department of Legislative Audit. All voted “aye”.

Motion by Doyle, seconded by Stenberg to approve the automatic budget supplement to the Water System Budget in the amount of $739.35 due to unanticipated grant revenue. All voted “aye”.

Motion by Veldkamp, seconded by Miles to approve the following resolution, with all members voting “aye”:

RESOLUTION 12042401

WHEREAS, general accounting practices allow for inter-fund transfers of equity between funds, and

WHEREAS, Moody County maintains a journal containing General Ledger account balances and history, and

WHEREAS, review of fund balances reveals funds in the 2011 Flex Spending Account in the amount of $665.00 as a result of unused funds.

NOW, THEREFORE, BE IT RESOLVED, that Moody County authorizes the Residual Transfer of cash from the 2011 Flex Spending Account to the General Fund in the amount of $665.00.

Motion by Miles, seconded by Stenberg to conduct business as Drainage Board at 9:05 AM. All voted “aye”. Motion by Stenberg, seconded by Miles to resume regular session at 9:40 AM. All voted “aye”.

Marc Blum, Highway Superintendent met with the Board. As advertised, the bids for the sale of the 1991 Champion 730A Series III Motor Grader were opened. One bid was received from RDO Equipment for the amount of $24,000.00. Motion by Doyle, seconded by Veldkamp to approve the sale of the 1991 Champion 730A Series III Motor Grader (SN 22033) to RDO Equipment of Sioux Falls for the amount of $24,000.00. All voted “aye”. The Board received and opened bids for crushed gravel at 9:50 AM. The following bids were received:

Motion by Doyle, seconded by Veldkamp to accept all bids, with use depending on location. All voted “aye. Blum presented the bid for the Rehabilitation Project for Bridge BRF-6319(03), PCN(00Z0). Motion by Stenberg, seconded by Doyle to award the low bid for BRF 6319(03), PCN 00Z0, Moody County Bridge Railing Rehabilitation to Sioux Falls Construction Company of Sioux Falls, SD for $60,187.00 from the April 4, 2012 Bid Letting. All voted “aye”. Motion by Doyle, seconded by Veldkamp to approve the automatic budget supplement to the Highway Repair Budget in the amount of $49.95 due to unanticipated insurance reimbursement revenue. All voted “aye”.

Motion by Doyle, seconded by Veldkamp to enter into executive session, pursuant to SDCL 1-25-2 at 10:35 AM. Reason: personnel. All voted “aye”. Motion by Doyle, seconded by Miles to resume regular session at 10:47 AM. All voted “aye”.

Troy Wellman, Sheriff met with the Board to discuss the policies and procedures of the Sheriff’s Office.

Commissioner Jerry Doyle discussed the meeting center project.

Discussion was held on County property, parcel 24.52.01.06C.

Motion by Doyle, seconded by Miles to authorize Auditor Schaefers, ROD Gail Meyer, and Treasurer Linette Christensen to attend the SDACO Spring Workshop in Pierre May 9-11, 2012. All voted “aye”.

Auditor Schaefers presented the Amendment to the Joint Cooperative Agreement with the First District Association of Local Governments. Motion by Stenberg, seconded by Doyle to wait to sign the Amendment to the Joint Cooperative Agreement with the First District Association of Local Governments until a specific fee schedule is presented by the First District Governing Body. All voted “aye”.

Discussion was held on annual employee reviews.

Kay Peterson, Deputy Auditor met with the Board to review pending poor relief cases. Motion by Doyle, seconded by Veldkamp to approve case #20120405 in the amount of $618.00. All voted “aye”. Motion by Miles, seconded by Stenberg to approve case #20120406 in the amount of $162.50. All voted “aye”. Motion by Veldkamp, seconded by Miles to approve case #20120407 in the amount of $162.50. All voted “aye”. Motion by Stenberg, seconded by Doyle to deny case #20120302 as the patient did not respond to the request for information. All voted “aye”. Motion by Veldkamp, seconded by Miles to deny case #20120303 as the patient did not respond to the request for information. All voted “aye”. Motion by Doyle, seconded by Stenberg to deny case #20120305 as the patient did not respond to the request for information. All voted “aye”. Motion by Miles, seconded by Stenberg to deny case #20120402 as the patient did not respond to the request for information. All voted “aye”. Motion by Veldkamp, seconded by Doyle to deny case #20120404 due to the hospital not sending the notification of hospitalization within fifteen days. All voted “aye”.

Commissioner David Stenberg discussed the Egan City Patrol hours and informed the Board of a request to have a flag flown in honor of Bob Gill’s service to the County.

Brenda Duncan, Director of Equalization met with the Board. Motion by Stenberg, seconded by Miles to authorize Deputy DOE Curtis Brooks to attend the Pictometry User Group Meeting in Bellevue, NE. All voted “aye”.

Motion by Miles, seconded by Veldkamp to conduct business as Joint Board of Commission and Planning and Zoning at 11:40 AM. All voted “aye”. Also present was Brenda Duncan, DOE. Two plats were reviewed. Motion by Doyle, seconded by Stenberg to approve the following resolution, with all members voting “aye”:

Motion by Miles, seconded by Stenberg to approve the termination of full-time Dispatcher Lonnie Gruneich effective April 19, 2012 and to authorize Sheriff Wellman to advertise the full-time Dispatcher position opening. All voted “aye”.

Motion by Miles, seconded by Veldkamp to conduct business as Board of Equalization at 1:00 PM. All voted “aye”. Also present was Director of Equalization Brenda Duncan and Treasurer Linette Christensen. The Commissioners signed oaths as equalization members.

Motion by Veldkamp, seconded by Doyle to approve the DOE to make any changes for those applications approved by the County Treasurer for the elderly/disabled tax freeze. All voted “aye”.

Leon Blackwell of Egan met with the Board. Motion by Stenberg, seconded by Miles to deny the Local Board’s decision to raise the value of parcel 23.01.27.07 owned by Leon & Kathy Blackwell, and to adjust the value back to the DOE’s original value of 52,318 NAD1S. All voted “aye”.

Motion by Doyle, seconded by Veldkamp to approve the DOE to make any changes due to discretionary reduction, veteran exemption, renewable resource credit, local industrial development per SDCL 10-4-8.1, inundated land reduction, application for property tax exempt status, and Local Board changes. All voted “aye”.

Motion by Stenberg, seconded by Veldkamp to uphold the Local Board’s decision to leave the value of parcel 108.49.03.250 at 28,725 AgC. All voted “aye”.

Motion by Miles, seconded by Stenberg to remove the value from parcel 24.52.01.06C as the property has been taken by tax deed. All voted “aye”.

Motion by Veldkamp, seconded by Doyle to remove 55,497 from class AgC1 from parcel 105.47.32.325 due to the property having a fire in January 2012. All voted “aye”.

Motion by Doyle, seconded by Veldkamp to remove 478,832 from class AgA from parcel 107.48.16.300 due to the property becoming exempt as of March 1, 2012. All voted “aye”.

The Board reviewed countywide assessed values and the 2012 Moody County averages on AgA, AgA1, and NaA1 values and Crop Soils and Non-Crop Soils.
