The Moody County Commissioners met in regular session on Tuesday, September 3, 2013 in the County Commissioners' Room in the Courthouse at 9:00 AM, with the following members present: Chairman Rick Veldkamp, Jerry Doyle, Tom Ehrichs, Dan Miles, and Tom Peper, with Lori Schaefers, Auditor as Clerk of the Board. Also present was Billy Stitz of the Moody County Enterprise.

AUDITOR'S ACCOUNT WITH THE COUNTY TREASURER

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of August 31, 2013, which includes money collected for schools, cities, townships and state:

Chairman Veldkamp called the meeting to order. Motion by Ehrichs, seconded by Peper to approve the agenda. All voted “aye”. Motion by Miles, seconded by Doyle to approve the minutes of August 20 & August 28, 2013. All voted “aye”.

Kay Peterson, Deputy Auditor met with the Board. As advertised, a hearing was held at 9:00 AM to consider the application submitted by Bar X Bar of Flandreau for a Temporary Special Beer License Permit and Special License for Consuming or Blending Alcoholic Beverages for September 7, 2013 at the Japanese Gardens for the Wede Wedding. Motion by Miles, seconded by Peper to approve the license. All voted “aye”.

Auditor Schaefers presented a travel request. Motion by Peper, seconded by Miles to authorize Schaefers, Deputy Auditor Kay Peterson, ROD Gail Meyer, Treasurer Linette Christensen, and Commissioner Doyle to attend the County Convention in Spearfish September 15-18. All voted “aye”.

Motion by Doyle, seconded by Ehrichs to approve the following resolution, with all members voting “aye”:

RESOLUTION 13090301

WHEREAS, Commissioner Contingency Funds are included in the annual budget, and

WHEREAS, insufficient funds were provided to the General Government Building Budget;

NOW, THEREFORE, BE IT RESOLVED, that pursuant to SDCL 7-21-6.1 it was moved and seconded to approve the following Contingency Transfer:

101-4-161-4330 General Government Building 35,000.00 CR

101-4-112-4297 Total Contingency Transfer 35,000.00 DB

Paul Lewis, State’s Attorney met with the Board to discuss the County implementing a nuisance ordinance.

Harvey Shafer, Soil Conservation met with the Board to invite them to a Rain Simulator Demonstration.

Brenda Duncan, Director of Equalization met with the Board. Motion by Peper, seconded by Doyle to approve the 6-month step increase of Deputy Director DeAnna Berke to a Grade 12B at $13.29/hour effective September 23, 2013. All voted “aye”.

Motion by Doyle, seconded by Miles to authorize Chairman Veldkamp to sign the 24 month Service Agreement with Tech Solutions of Mitchell, SD effective September 3, 2013 to provide Network Support Services, Security, and Networking Solutions to the Moody County Courthouse, Sheriff, Highway and Extension. All voted “aye”. Motion by Ehrichs, seconded by Peper to approve the Courthouse Wiring and Sheriff’s Office Wiring Cleanup quote from Tech Solutions of Mitchell, SD in the amount of $21,345.00. All voted “aye”.

Buddy Tye, Weed Supervisor and Extension Custodian met with the Board. Motion by Peper, seconded by Miles to authorize the Weed Department to purchase a 2000 Chevrolet C6500 from the Federal Surplus Property Catalog in the amount of $16200.00, contingent on the vehicle passing inspection by the Weed Supervisor. All voted “aye”. Motion by Miles, seconded by Peper to approve the quote in the amount of $15005.80 from C&R Supply of Sioux Falls to equip the C6500 with spraying equipment. All voted “aye”. Motion by Ehrichs, seconded by Doyle to approve the quote from Brookings Glass & Mirror of Brookings in the amount of $2150.00 to replace the Moody County Extension Office Door. All voted “aye”.

Motion by Miles, seconded by Ehrichs to conduct business as Joint Board of Commission and Planning and Zoning at 10:35 AM. All voted “aye”. Also present was Brenda Duncan - Director of Equalization, Paul Lewis – State’s Attorney, and Todd Kays of First District. Two plats were reviewed. Motion by Miles, seconded by Doyle to approve the following resolution with all members voting “aye”:

BE IT RESOLVED by the County Commission of Moody County, South Dakota, that the plat of BLOCKS 1, 2 & 3, SCHMIDT’S FIRST ADDITION IN THE NORTHEAST QUARTER OF SECTION 4, TOWNSHIP 106 NORTH, RANGE 50 WEST OF THE 5TH PRINCIPAL MERIDIAN, MOODY COUNTY, SOUTH DAKOTA be and the same is hereby approved.

I hereby certify that the above is a correct copy of the resolution duly passed by the County Commission, at a meeting held on the day adopted.

I hereby certify that the above is a correct copy of the resolution duly passed by the County Commission, at a meeting held on the day adopted.

Discussion was held on the proposed changes to the Moody County Zoning Ordinance. Motion by Doyle, seconded by Ehrichs to resume regular session at 11:40 AM. All voted “aye”.

As advertised, the Board conducted the public hearing at 1:00 PM for the consideration of the Provisional Budget for 2014. Schaefers reviewed the County valuation and the County levy for 2013 payable 2014. The Board agreed on the following initial changes to the provisional budget: General Fund: increase Coroner Budget to $6500, increase Cash Applied by $1947, and increase Property Tax revenue by $158 due to the final County value/growth calculation; Fire Fund: decrease Cash Applied by $923, and increase Property Tax revenue by $923 due to the final County value/growth calculation Auditor Schaefers will prepare the revised budget for the Board’s review on September 24th.

The following reports for August were received and filed in the Auditor’s Office: Civil fees $1250.80, and Register of Deeds fees $6502.50.
