Event venue contract

This Contract is made effective as of ______(date) by and between

Twisted Ranch Weddings Inc. and______(CLIENTS).

The "CLIENTS" represent that they desire to hold a special event or wedding on the date

______at The Twisted Ranch Weddings Inc. Therefore, the parties agree as follows:

1. VENUE RENTAL FEE(S)

The CLIENTS agree to pay a non-refundable SECURITY DEPOSIT of $1000.00 dollars when booking. Half of the total payment is due 180 days before the event and the balance is due 90 days before the day of the event.This payment is for the use of the venue for the specified date of event / wedding and is payable at the time of contract signature. The contract must be signed and returned within 72 hours of receiving the deposit. If for any reason the contract is not returned in the time specified your date will not be confirmed and will be open for booking.This contract will hold the date of your event and keep Twisted Ranch Weddings inc. from booking another event for the same date. If for any reason, Twisted Ranch Weddings Inc. is unable to fulfill its contractual obligation under this contract, the entire deposit will be returned with no further penalties or liabilities.

• A refundable DAMAGE DEPOSIT of $500.00 is due two weeks before the event.(to be paid by separate check or money order, returnable to the CLIENT(S) up to two (2) weeks after the event has been held once property has been inspected for any potential damage from special event or wedding.

2. Ranch Time

The ranch will be open for showings Monday - Friday from 10:00am to 5:00 pm by appointment only.

You may request that theranch be open the day before the event from 10:00 AM to 5:00 PM for any deliveries and all decoratingif the venue is not already booked for another event for that day, there is a small staffing fee of $350.00 for the day. “PLEASE NO ALCOHOL” on this day.

The ranch will be open the day of the event at 10:00 AM to 12:00 midnight unless other times agreed by management.

The start time of your event may not exceed 8 hours max. Although, you will have use of the facility to decorate and get ready at 10:00 AM.

The grooms cabin and in-law cabin will be locked from the point the wedding starts till the end of the night. No one will be allowed in these cabins after the wedding has started. You can leave your belongings in the cabin till the end of the night or take them out to your vehicle. “TWESTED RANCH IS NOT RESPONSIBLE FOR ANY LOST OR STOLEN PROPRTY“

The ranch gates lock at 12:00 am (midnight) the night of your event.

PLEASE NOTE: After 12:00 AM midnight there will be a $250.00 per hour fee to cover our staff and will be removed from your deposit.

3. DATE CHANGES:

In the event the CLIENT(S) is forced to change the date of the event or Wedding, every effort will be made by Twisted Ranch Weddings inc. to transfer reservations to support the new date. The CLIENT(S) agree that in the event of a date change, any monies or deposit are non-refundable and are the sole responsibility of the client.

4. CLIENT(S) CANCELLATIONS:

In the event of a cancellation, for any reason the client decides not to use the venue the client must inform Twisted Ranch Weddings inc. in writing 180 days prior to date of event to release the client from the contract. In the event of acancellation by the CLIENT of this special event this deposit and any other monies paid toward the wedding will be non-refundable.

5. ACCOMMODATIONS:Twisted Ranch Weddings Inc. venue does not have overnight accommodations.

6. Twisted Ranch Venue:

The Twisted Ranch Weddings Inc. is an "as is venue." We are not responsible for decor of any kind, catering, flatware, glassware, cake, photographer, transportation, flowers, special lighting, music, Bar, alcohol, TABC certified servers, ceremony Officiates etc. We represent ourselves as the venue only, which shall include the property and buildings associated with your package.

Twisted Ranch is a working ranch we do have ranch hands and staff that we pay and they will be on property working at all times for the ranch "PLEASE DO NOT ASK THEM TO HELP WITH YOUR SPECIAL EVENT". We do employ a parking staff for your special day. They will help in any way they can when parking services don't take priority.

7. OUTDOOR LOCATION:

The CLIENT(S) understands that they and their invited guests will abide by the requirements while on the property of Twisted Ranch Weddings Inc. This includes the following:

• Placement of tables, tents, catering equipment, etc., must be approved by Twisted Ranch Weddings Inc. management.

• Parking in designated areas only. Absolutely no parking on the grass.We have sprinklers!

• All music must end by 10:00 pm to comply with Burnet City County Sound Ordinances. We will let you go to 11:00 unless a neighbor would complain. We sit on 300 acres and have never had a problem. Please keep in mind clean up and site closure is still by 12:00 AM midnight.

• The CLIENT(S) must comply with all Twisted Ranch Weddings Inc. and Burnet county regulations and policies.

• Absolutely no under-age drinking.

8. UNFORSEEN EVENTS:

The CLIENT(S) cannot hold Twisted Ranch Weddings Inc. responsible for failure to provide the basic facilities and services due to emergencies, catastrophes or interruptions of public utilities. Twisted Ranch Weddings Inc. will allow you to reschedule if possible and/or receive a full refund of the Security Deposit. If an Act of God were to occur preventing the event from taking place as scheduled, Twisted Ranch Weddings Inc. will allow for the event to be rescheduled, pending availability, with no penalty. Last minute cancellations of outdoor site due to inclement weather will not be considered for refunds.

9. FOOD & CATERING

• CLIENT(S) may select any caterer from the Preferred Vendor List or an outside caterer may be allowed upon approval by management.

• Your caterer must be a licensed caterer and they must show Twisted Ranch Weddings Inc. listed as an “additional insured” under their policy and a“Certificate of Liability Insurance” with a minimum of $1,000,000 per occurrence/$2,000,000 Policy aggregate of coverageis required to be given to the management before or no later than 2 weeks of event or the management has the right to cancel the caterer for non-proof of insurance.

• Any of our catering equipment can be used at your own risk. Failure of the equipment is not our responsibility. We suggest having backup plan just in case. This should be handled by the client or their caterer.

• ALL vendors must provide a copy of "Certificate of Liabilityinsurance"(florists, bakers, musicians, rental company, etc.) you must show Twisted Ranch Weddings inc. listed as an “additional insured” under their policy and a“Certificate of Liability Insurance” with a minimum of $1,000,000 per occurrence/$2,000,000 Policy aggregate of coverageis required to be given to the management before or no later than 2 weeks of event or the management has the right to cancel the "VENDOR" for non-proof of insurance.

• Please allow appropriate time for break-down and clean-up.The Client and or catering company/is responsible for the set-up, and clean-up of the catered site.

• All event trash must be disposed of by the "CLIENT"/ "CATERER" at the conclusion of the event. We can call a disposal service for an additional $125.00 to remove trash from your event "PLEASE" let us know. If this is not included in your catering please let us know. The service we use is usually cheaper than what the caterer will charge you.

10.Security:

Twisted Ranch requires one Law enforcement officer to be present for all events. For parties with 150+ guestswe will require two law enforcement officers. Law enforcement officer are required for all events where alcohol is served (such as wedding receptions, fundraisers, wine tastings, corporate parties, etc.).

Thisserviceisnon-negotiable.Thecostis $35.00 per hour. Law enforcement must attend for the duration of the event and until the gates are locked. Thisservicemust be retained through our preferred vendor (Steve Allison, a Texas Peace Officere-mail / phone # 512-439-9219) this service willbechargedtotheclient.

11. TENT RENTAL:

If CLIENT(S) should rent any tent,it is their responsibility to put it up and take it down. No stakes in the ground. Barrels only for large tents.

12. LIABILITY:

The CLIENT(S) or their guests cannot hold the Twisted Ranch Weddings Inc., its board of Governors, staff and volunteers, liable from suit, actions, damages, and expenses in connection with personal injury, illness, property damage or theft resulting from the use of any facility at the Twisted Ranch Weddings Inc.

13. ENTIRE AGREEMENT:

This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.

14. ADMENDMENT:

This Agreement may be modified or amended in special notes, if the amendment is made in writing and is signed by both parties.

15. SERVERABILITY:

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

16. WAIVER OF CONTRACTUAL RIGHT:

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.

17. APPLICABLE LAW:

This Agreement shall be governed by the laws of the State of Texas.

18. Alcohol:

Twisted Ranch does not have a beer, wine or liquor license. The CLIENT(S)can bring their own liquor,to be served to their guest but CLIENT(S)must providea TABC licensed certified staff member(s)from our preferred list to serve all guestsand comply to all Texas laws. NO EXCEPTIONS!

All TABC licensed certified servers must have Twisted Ranch Weddings inc. listed as an “additional insured” under their policy and a“Certificate of Liquor Liability Insurance” with a minimum of $1,000,000 per occurrence/$2,000,000 Policy aggregate of coverageis required to be given to the management before or no later than 2 weeks of event or the management has the right to cancel the TABC server for non-proof of insurance and no alcohol will be served.

At any time, if the staff deems alcohol consumption to be excessive, the "MANAGEMENT" has the authority to close down all alcohol service and/or evict inebriated guests from the premises.

NO B.O.Y.B OR ALCOHOL OF ANY KIND WILL BE PERMITTED ON THE PREMISES OTHER THAN AT THE BAR OF TWISTED RANCH BEING SERVED BY A TABC LICENSED CERTIFIED SERVER. ANY GUEST CAUGHT DRINKING THEIR OWN ALCOHOL WILL BE ASKED TO LEAVE.

19. RULES AND REGULATIONS:

The following is a list of rules and regulations to be upheld by CLIENT(S), which includes all EVENT PLANNERS, WEDDING COORDINATORS, and VENDORS who are involved in the planning and execution of a special event or wedding on the premises of the Twisted RanchWeddings Inc. venue. It is your responsibility to send them a copy of the regulations.

•Event Ending Time: Please try to end the event 1 hour before in order to allow for clean-up and closure of the site.

•Decorations: All decorations must be removed without leaving damages. Be kind and leave the property as you found it.

• We no longer allow movement of tables and chairs. Unfortunately, they are very heavy and clients were breaking them. The cost to fix them was more than the damage deposit in many cases so we no longer allow this. Please know we have seen every arrangement possible and this truly is the best arrangement to maximize space and to enhance the beauty of the space.

•No furniture may be left overnight (chairs, umbrellas, arbors, tents etc.) unless approved by management.

•Placements of tables, tents, live music, catering equipment etc. must be approved by management.

•Parking in designated parking lot area only. No parking on the grass. We have sprinklers!

•Twisted Ranch Weddings Inc. is a non‐smoking venue. "Please no smoking."

•Alcohol may not be served to minors at any time.

•All music must end by 10:00 PM to comply with Burnet County Sound Ordinances.

•Children are not permitted to wander the grounds unsupervised by an adult.

•All electrical outlets on the property are available for use by the wedding parties and their vendors. The parties are welcome to inspect the locations and numbers of outlets prior to booking.

•Any use of candles must be approved by management. All candles must be contained or enclosed in glass. The flame must not reach higher than 2 inches below theheight of the glass.

•All decorations must be removed without leaving damages directly following the departure of the last guest,unless special arrangements have been made.

•No pets allowed on the property.

•All guests must adhere to the terms of our guidelines, and will become the client’s responsibility to share these guidelines with them.

•There is a fee of $10 per person for events over 200 guests.

20. Handicap:

Twisted Ranch Weddings Inc. welcomes the handicap. Please understand it is an"old style" venue. We are notequipped to accommodate wheelchairs. The venue has rough terrain, small restrooms, stairs, and small turn radiuses. If you know that you’re having a handicapped guest, pleaselet us know so that we may accommodate them.

21. COURTSEY PROTOCOL:

The Twisted Ranch Weddings Inc. reserves the right to request any person or group of people acting unruly and contrary to rental regulations to leave the premises. Assistance from law enforcement agencies may be acquired if this request is not met immediately.

"Just some good information to know for your special event".

1.) It's always a good idea to have a person at the front gate to direct your parties where they need to go.

2.) It is always a good idea to hire acoordinator. We can refer some good ones. They tend to work for Twisted Ranch at cheaper rates and their knowledge will save you time and money. If you are looking to have a truly AMAZING wedding let one of our referred coordinators handle the details!

3.) If you are not hiring a staff for set-up and break down of your event make sure to have help. There are many spaces to decorate and you will welcome the help.

4.) Please note our venue is very unique and your guest will have a true experience at the ranch. Please allow time for guests to arrive at the ranch and take pictures with our many unique buildings and ranch animals. We find that people spread out like ants when they arrive and love taking pictures, especially in our jail and uploading them to social media! So go ahead and tell them to arrive 1/2 hour early and let them have fun. Provide a few yard games and they will have a ball!

5.) THE MOST IMPORTANT IS OUR "LOCATION". Please make sure to tell your guests there is a N. FM 243 and W. FM 243 which are located on separate roads. Ask them to follow our map or one that you provide for them and not GPS. If they just plug in FM 243, Google maps and most GPS will take them to the N. FM 243 location. We are actually located right next to Oatmeal, TX down the road from Bertram.
