TRAFFIC ORDINANCE NO. 220
AN ORDINANCE ESTABLISHING A SCHOOL SPEED ZONE AND FIXING THE MAXIMUM SPEED AT WHICH VEHICLES MAY BE OPERATED OVER CERTAIN ROADS IN LEWIS COUNTY, WASHINGTON: DEFINING OFFENSES AND PROVIDING PENALTIES FOR THE VIOLATIONS THEREOF
WHEREAS, RCW 46.61.415 authorizes local authorities to determine the maximum speeds permitted on roadways based on an engineering and traffic investigation; and
WHEREAS, RCW 46.61.440(2), allows a county to create a school speed zone on a roadway bordering a marked school or playground; and
WHEREAS, WAC 468-95-330, states no school or playground speed zone may extend less than 300 feet from a marked school or playground crosswalk, but may extend by traffic regulation beyond 300 feet based on a traffic and engineering investigation; and
WHEREAS, an engineering and traffic investigation of the following roads has been prepared and the report thereon attached; and
WHEREAS, after consideration of the engineering and traffic investigation reports and all other facts pertinent to this proposed traffic ordinance,
NOW THEREFORE, BE IT HEREBY ORDAINED:
SECTION 1: No person shall operate any vehicle in the school speed zones over the following county roads, or portions of county roads at a speed in excess of twenty (20) miles per hour:
91023 – Borst Avenue, between the intersections of Eshom Road and Cowlitz Road.
13022 – Eshom Road, between the intersections of Borst Avenue and Mt Vista Road.
91016 – Eshom Road, between the intersections of Borst Avenue and Mayberry Road.
13017 – Mt Vista Road, between the intersections of Eshom Road and Cowlitz Road.
SECTION 2: The County Engineer is hereby directed to erect and maintain all necessary maximum speed limit signs on the above roads and upon erection of such signs, the provisions of this Ordinance shall become effective and shall remain in full force until such time as may ordered by the Board of County Commissioners (BOCC).
SECTION 3: Violation of any provision of this Ordinance shall be a traffic infraction and shall be subject to assessment of the monetary penalty set by RCW 46.63.110 – Monetary Penalties and Infraction Rules for Courts of Limited Jurisdiction (IRLJ) 6.2 – Monetary Penalty Schedule for Infractions, now or as hereafter amended.
This Ordinance will not be codified in the Lewis County Codes, but will remain on file with the Clerk of the BOCC.
PASSED IN REGULAR SESSION this 12th day of September, 2016, after a hearing held this date pursuant to notice published in the East County Journal on August 31, 2016 and The Chronicle on September 1, 2016.
