MINUTES of the REGULAR MEETING

May 24, 2016

The Regular Meeting of the Somers Village Board was called to order at 5:30 p.m. by President George Stoner at the Somers Village Hall, 5511 12th Street.

Present: President George Stoner, Trustees Al Brokmeier, Richard Heinisch, Jack Aupperle & Joe Cardinali. Excused: Trustees Dave Geertsen & Karl Ostby. Also present: Administrator William Morris, Attorney Jeff Davison & Clerk-Treasurer Tim Kitzman.

All Stood for the Pledge of Allegiance.

Consent and Approval of Minutes of Village Board meeting on May 10, 2016 & Vouchers dated 5-12-16 & 5-19-16

Trustee Brokmeier moved to approve Minutes of the Village Board meeting on May 10, 2016 & payment of Vouchers dated 5-12-16 & 5-19-16, second by Trustee Cardinali. Motion carried 5-0.

Citizen Comments

Gregg Sinnen, 3190 100th Avenue, urged the Board to contact Representatives Barca & Kerkman regarding an interstate exit sign for Somers as the incorporation is complete. He also questioned the lack of citizen comments on the Special Board meeting agenda & asked for more discussion. Attorney Tony Dunn indicated he would speak under item # 16. Gina Davis, 1239 3rd Avenue, asked for an Ordinance revision to allow backyard chickens.

Trustee Comments

Trustee Cardinali thanked citizens for their comments this evening. He also thanked Wal-Mart for donating mulch, Yutka Fence for the chain link fence at the soft ball diamond & Tree Solutions for removing the ash tree on the Village Hall campus.

Action on proposed Agreement with Safe Harbor Humane Society

Trustee Cardinali moved to approve Agreement with Safe Harbor Humane Society, second by Trustee Aupperle. Motion carried 5-0.

Action on proposed Animal Control Agreement with Pawz & Clawz/Robert Melby, Jr.

Trustee Brokmeier moved to approve Animal Control Agreement with Pawz & Clawz/Robert Melby, Jr., second by Trustee Cardinali. Motion carried 5-0.

Action on proposed Resolution No. 16-015 Authorizing Resolution for DNR Recycling

Trustee Aupperle moved to adopt Resolution No. 16-015 Authorizing Resolution for DNR Recycling, second by Trustee Brokmeier. Motion carried 5-0.

Motion to approve amendment to First Industrial Developers Agreement

Trustee Aupperle moved to approve amendment to First Industrial Developers Agreement,

second by Trustee Cardinali. Motion carried 5-0.

Motion to award bid for Lift Station No. 1 Rehabilitation-Carthage College

Trustee Cardinali moved to award bid for Lift Station No. 1 Rehabilitation-Carthage College to Staab Construction, Marshfield, WI in the amount of $1,794,700.00, second by Trustee Aupperle. Motion carried 5-0.

Motion to award bid for Force Main Rehabilitation on 12th Ave

Trustee Aupperle moved to award bid for Force Main Rehabilitation on 12th Ave to Michaels Pipe Services, Brownsville, WI in the amount of $194,880.00, second by Trustee Brokmeier. Motion carried 5-0.

Action on proposed Resolution No. 16-016 Authorizing the Issuance of a Tax Incremental Project Revenue Bond of the Village of Somers, Wisconsin (Tax Incremental District No. 2)

Trustee Brokmeier moved to adopt Resolution No. 16-016 Authorizing the Issuance of a Tax Incremental Project Revenue Bond of the Village of Somers, Wisconsin (Tax Incremental District No. 2), second by Trustee Heinisch. Motion carried 5-0.

Motion to approve CTH “E” Relief Sewer Project Progress Payment No. 8 to Reesman’s Excavating & Grading in the amount of $5,000.00

Trustee Cardinali moved to approve CTH “E” Relief Sewer Project Progress Payment No. 8 to Reesman’s Excavating & Grading in the amount of $5,000.00, second by Trustee Aupperle. Motion carried 5-0.

Motion to award Sewer & Water contract to DeNoble Sewer & Water Construction Inc., DePere, WI in the amount of $81,842.00

President Stoner tabled this item.

Public Hearing & action on 6-month Probationary Cabaret License applications from: Kenosha Country Club, 500 13th Avenue; Paradise Lounge LLC d/b/a Upper Deck Bar, 1558 Sheridan Road; Geebo LLC d/b/a Somers House, 1548 Sheridan Road, Cortese Supper Club Inc. d/b/a Cortese Restaurant, 1300 Sheridan Road; M&R Inc. d/b/a Hob Nob Restaurant, 255 S. Sheridan Road; Icky Rickys, 8526 38th Street

President Stoner opened the public hearing. Attorney Mike McTernan, 6633 Green Bay Road, representing Somers House, objected to the speaker time limit & stated the Sheriff call reports show 4 noise calls. Attorney Tony Dunn, 6633 Green Bay Road, representing Upper Deck Bar, stated his client had abstained from conducting cabaret activities. The hearing was closed. Motion by Trustee Cardinali to grant all licenses except Somers House & Upper Deck failed for lack of second. Motion by Trustee Heinisch to grant all licenses was withdrawn. Trustee Cardinali moved to grant 6-month probationary licenses to Kenosha Country Club, Cortese Restaurant, Hob Nob Restaurant & Icky Ricky’s, second by Trustee Brokmeier & passed 4-0-1 with Trustee Aupperle abstaining. Trustee Cardinali moved to deny Somers House & Upper Deck’s applications, second by Trustee Brokmeier. Chris Gochis, 1514 Sheridan Road addressed the Board regarding use of scanner devices at Somers House. Neil Kaisani, 1778 Sheridan Road, addressed the Board regarding the shooting incident & stated he wanted to work with the Board.

Trustee Heinisch moved to separate applications, second by Trustee Brokmeier. Motion carried 5-0. Trustee Heinisch moved to grant Somers House a 6-month probationary cabaret license, second by Trustee Brokmeier. Motion carried 4-1 with Trustee Cardinali voting no. Trustee Heinisch moved to grant Upper Deck 6-month probationary cabaret license, second by Trustee Aupperle. Motion failed 1-4 on roll call vote with Trustee Heinisch voting aye.

Public Hearing & Action on Original & Renewal License Applications for “Class A” Combination Fermented Malt Beverage & Liquor, Class “A” Fermented Malt Beverage, “Class B” Combination Fermented Malt Beverage & Liquor, Cigarette & Tobacco Product Licenses, Amusement Device Licenses. (list attached)

President Stoner opened the public hearing. No one spoke & the hearing was closed. Trustee Cardinali moved to grant all licenses listed, second by Trustee Brokmeier. Motion carried 5-0.

Approval of Operator Licenses: None

There being no further business, the meeting was adjourned at 6:35 p.m.
