Any person wishing to keep chickens on residential property on a lot that is one acre or larger shall apply for a chicken license from the New Castle Town Clerk. Issuance of a license will be contingent upon successful receipt of a Certificate of Compliance from the Building Department for the chicken coop and enclosure.

a)A license for the keeping of chickens is $25.00 . This fee will be paid after proof of certificate of compliance from the New Castle Building Department is provided.

b)Fees for coop and enclosures are related to the cost of construction. ($100.00 for the first $1,000.00 of construction cost)

c)A Certificate of Compliance Fee is $50.00. To be paid to the New Castle Building Department.

STANDARDS FOR THE KEEPING OF CHICKENS

In accordance with Section 60-410N of the New Castle Town Code:

  1. On lots of at least one acre in a Residential Zoning District no more than 6 chickens shall be kept or raised. Up to 12 chickens may be kept or raise on lots of at least two acres.
  2. Only female chickens, or hens may be kept. The keeping of roosters is prohibited.
  3. Chickens shall be provided with adequate food and water at all times.
  4. Composting of chicken manure and the use of such manure shall comply with the best practice management guidelines. The use of any compost containing chicken manure and all manure-based operations shall be subject to a 20’ setback from all property lines. Run-off shall not encroach neighboring properties. Any composting of chicken manure and use of such manure shall not create a public or private nuisance, as determined by the Building Inspector. The use of raw chicken manure is prohibited.
  5. All persons who keep, possess or maintain chickens must comply with the Town Noise Ordinance and shall not permit the chickens to make noises of such nature as to be heard beyond the property on which such chickens are harbored between 10:00 P.M. and 6:00 A.M. Noise is enforceable by the New Castle Police Department.
  6. All feed must be kept indoors in metal containers with metal covers, with securely fastened covers, at all timesto minimize infestation of rodents or problems with predators.
  7. Chickens must be confined at all times to the chicken enclosures.
  8. The coop and enclosures shall not be located in any front yard. Coops and enclosures must be located a minimum of 100’ from any residence situated on an adjacent lot and outside the minimum setback of the district in which they are located.
  9. A person constructing a coop or enclosure must obtain a building permit (application, fee and inspection) from the Building Department. If the coop and/or enclosure is pre-existing a building permit must also be applied for.
  10. The coop shall be covered and ventilated, and a fenced enclosure/ runis required. The coop and enclosure must be completely secured frompredators, including all openings, ventilation holes, doors and gates.
  11. The coop must have litter such as straw or shavings on the floor at alltimes generally at least four inches in depth. This litter must beregularly changed to prevent unsanitary and unhealthy conditions.
  12. The coop must be easily accessible for cleaning and maintenance.
  13. The coop shall be constructed using durable materials designed for permanent outdoor use.
  14. The coop and enclosure shall be kept clean and free of noticeable odors across property lines.
