TOWN OF MANTEO RULES AND REGULATIONS FOR TOWN OWNED CEMETERY.

EFFECTIVE DECEMBER 15, 2012

All burials/urns must have a vault/outer burial container

All markers for all sections of the cemetery shall be made of granite, marble or bronze.

Planting of trees, shrubs or plants are prohibited in any section of the cemetery.

Pets must be on a leash.

Other Rules and Regulations that are already in Effect:

Sec. 2-225. General rules and regulations.

(a)All persons when within the cemetery are reminded that the grounds thereof are sacredly dedicated to the interment and repose of the dead and strict observance of the decorum due to such a place will be expected and required by all.

(b)The cemetery board reserve the right to determine, establish, modify, alter or change the grade of each and every lot, road, driveway, pathway or part thereof, and they shall not be liable to anyone for any such action.

(c)No lot owner shall make any changes or alteration in or on any lot including the removal or change in position of any memorial of any kind without the written consent of the cemetery board and if so made, the cemetery board will restore such lot to its former condition without notice and at the expense of the owner of such lot.

(d)No trinkets, toys, shells, pickle jars, tin cans, sand, artificial material, or anything, which in the opinion of the cemetery board is unsightly, will be allowed on any lot or single grave, and all such articles, materials, and things will be removed without notice, and the cemetery board shall not be responsible for the loss or destruction of the same.

(e)The following persons and things are forbidden to enter the cemetery grounds and are subject to be removed or ejected therefrom:

(1)Children under 12 years of age unless attended by an adult person responsible for their conduct.

(2)Delivery trucks, wagons, and vehicles or any conveyance generally used for hauling goods, except vehicles delivering to the cemetery, flower trucks bringing flowers for interment or to be place on a grave and trucks of a licensed memorialist, and any vehicles the cemetery board authorizes.

(3)Persons passing through the cemetery, except for the bona fide purpose of visiting a grave or lot, or to attend to cemetery business matters with an authorized representative of the cemetery.

(4)Persons carrying firearms, except officers of the law or members of a military detail, in attendance upon an interment.

(5)Material of any description, except cut flowers, wreaths and potted plants at times permitted.

(6)Bicycles and motorcycles unless a special permit is first issued therefor by the cemetery board or persons authorized by the cemetery board. This rule shall not apply to motorcycle police officers.

(f)The following things are not permitted in or on the cemetery grounds:

(1)Loud, boisterous or obscene language or whistling and singing except when part of a memorial or interment service.

(2)Improper conduct or unseemly noise.

(3)Picnicking, lunching, camping, hunting, playing, loitering, lounging or other recreational activities.

(4)Cutting, picking or pulling flowers or plants whether cultivated or wild; breaking branches from any shrub or tree, scratching, marring, defacing, injuring or disturbing any monument or head or foot stone, building or any other thing being a part of or placed or used in connection with the cemetery grounds, or any lot, pathway, street, or roadway therein.

(5)Putting or depositing paper, rubbish, dead or wilted flowers, shrubs, plants, branches or any unsightly or unseemly thing on any lot, walk, drive or other part of the cemetery, except in receptacles provided for that purpose.

(6)Sitting or climbing on a marker, monument, or fixture of any kind, without permission of the cemetery board.

(7)Peddling, begging, soliciting or collection.

(8)The display or distribution of signs, cards, handbills, circulars, or anything relating to any business, profession, office or other matters.

(9)Children (and adults) shall not play on cemetery property.

(10)The placing of flowers, floral or other designs and things in alcohol or other preservatives, or under glass, or other enclosures.

(11)Fishing, hunting, trapping, molesting, or killing of any birds, waterfowl or game of any kind.

(g)Marking of grave sites. Appropriate grave markings shall be erected within 12 months of internment.

(1)Placing of headstones/memorials shall be no taller than three feet in the new section of the Manteo Cemetery located on the east side of Lord Essex.

(h)Removal of floral arrangements. All cut flowers or artificial arrangements shall be removed when they become wilted, impaired or unsightly. If flowers are not removed by the owners then they shall be removed by the town.

(i)No more than two sets of remains may be placed in any plot.

Sec. 2-226. Cars and other vehicles in cemetery.

(a)The following things are prohibited:

(1)The driving of cars or other vehicles through the gates or in the cemetery grounds at speeds in excess of ten miles per hour.

(2)Driving any motor car or vehicle across or upon any grave, lot or lawn, or parking and leaving the same thereon.

(3)Parking or leaving any motor car or vehicle in any driveway within the cemetery grounds at such location or in such position as to prevent any other car or vehicle from passing the same, and if so parked or left, the cemetery board will have same removed.

(4)Leaving a motor car or vehicle parked on the grounds of the cemetery between the hours of 8:00 p.m. and 8:00 a.m., or any other time when not visiting the cemetery or at the cemetery for authorized business.

Sec. 2-227. Penalties for violation.

(a)Whenever a member of the police department, or other person charged with the enforcement of the ordinances of the town regulating town owned cemeteries, shall find that any of such provisions are being or have been violated by a person, such officer or person may issue a civil penalty citation or ticket which shall require the person to pay the town within 72 hours after such citation the civil penalty provided below in paragraph.

(b)Any person notified, as provided in this article, shall within 72 hours, present the civil penalty citation and $10.00 for each violation involving this division. Such civil penalty is hereby imposed for such violations under authority of G.S. 160A-175.

Alternatively or if the violator does not appear in response to the described civil penalty citation and the civil penalty is not paid within the period described, the town may refer the matter to a private collection agency for collection or an infraction citation or summons may be issued against the violator of this division and, if found responsible, the violator shall be punished as provided by G.S. 14-4(b).

Sec. 2-228. In-ground cremated remains/urn regulations.

(a)Flat markers no greater than two feet by one foot by four inches.

(b)All markers must be placed centered both horizontally and vertically on the gravesite.

(c)Markers shall be made of granite, marble or bronze and must be placed on a base.

(d)Base may not be larger than two feet two inches by one foot two inches.

(e)All markers must be flush with ground.

(f)All remains must be placed in an vault.
