Regular Town Council Meeting

April 9, 2013

Council Members (C/M) present: C/M B. Moss, V/M Paige, C/M K. Moss, C/M Jones, C/M S. Moss, and C/M Walker (7:10)

C/M absent: Mayor Toney

Others present: Peggy Johnson, Clerk; Tana Knott, Farmville Herald

The meeting was held at the Dillwyn Town Hall located at 1030 Main Street, Dillwyn, VA, on April 9, 2013, at 7:00 p.m. The invocation was given by C/M B. Moss and the Pledge of Allegiance was led by V/M Paige.

The Vice Mayor opened the meeting and declared there was a quorum in attendance.

The Vice Mayor asked the council if there were any changes or corrections to the March 2013 minutes. Motion made by C/M K. Moss and seconded by C/M S. Moss to accept the minutes as presented. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

Transportation Enhancement:

. The Clerk advised that she has talked to Karl Carter, Buckingham County Assistant Commissioner concerning using Lyn Hill. Waiting on VDOT to approve the plans.

Revitalization Project:

Round 1: The Clerk stated that this phase has been completed with the exception of one of the buildings for Buckingham Branch (BBRR). Two pay requests from Keith Barber Construction for BBRR corporate office.

Round 2: The Clerk advised that the town is still waiting on the signatures from the Fords.

Additional charges for the architect: the budget change was not allowed by DHCD, but DHCD approved up to $80,000 for Engineer and Architect charges. Budget change submitted for this. Also Hurt & Proffitt would not adjust their agreement with Frazier Associates.

Future use of Dillwyn Primary: The Clerk advised that no respond from SVCC has been received.

Parking: The Clerk again advised that the town really needs parking lots for many reasons: to attract new businesses, customer use, etc. Three lots could be rented or purchased from LP Gilliam: behind the library, behind the town hall/drug store, next to the ABC store; one lot from Shirley Seay, between the dry cleaners and The Price is Right. V/M Paige will call Mr. Gilliam to discuss this with him.

Friday night events: C/M S. Moss has concerns that there is not enough help to do these events. V/M Paige asked to keep this item on the agenda.

Motion made by C/M B. Moss and seconded by C/M K. Moss for the Clerk to take the necessary steps (Ford) to make sure that the project moves forward. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

Street Maintenance Committee:

- Street lights: Main & White, Hancock (Dominion has been called)

- Yards:

Logan: Motion made by C/M K. Moss and seconded by C/M B. Moss for the Clerk to call Mr. Powell to come cleanup brush and get wood and notify Mr. Logan and send him a bill if given. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

Quentin Booker property: C/M Jones asked what could be done about this property. Motion made by C/M Jones and seconded by C/M K. Moss for a letter to be sent addressing the property and removing all items from front and back yards by a date. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

- Town cleanup: C/M S/ Moss advised date set for last Saturday in April. $618.00 was received from the bake sale.

- Clean yard contest: C/M Walker advised that the committee agreed to four cash prizes of $25.00 each. A list of criteria will be used to determine the winners. Motion was made by C/M Walker and seconded by C/M K. Moss that the 2013 Clean Yard Contest would give four (4) $25.00 cash awards to yards (residence) most deserving. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

Tourism Committee: C/M S. Moss advised that the Chamber is donating to Historic Buckingham for June Jubilee.

Cemetery Committee: Motion was made by C/M K. Moss and seconded by C.M B/ Moss that C/M K. Moss to ask Justin Ayers if he would attend to the entrances of the cemetery. . Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, and C/M Jones. Nays: none. Motion was amended to include: if Mr. Ayers is not interested, to contact Mr. Phillips, Central VA Landscape, about doing this work. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, and C/M Jones. Nays: none. C/M Walker was not present in room for the vote.

UNFINISHED BUSINESS

Street Sweeper: Motion was made by C/M K. Moss and seconded by C/M S. Moss to remove this item from future agendas. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, and C/M Jones. Nays: none

NEW BUSINESS:

Refund penalty on BPOL, $3.00: Motion made by C/M K. Moss and seconded by C/M Walker to refund the BPOL penalty paid in error. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, and C/M Jones. Nays: none

Refund real estate adjustment, $8.00: The house was removed, but the prior owner did not fill out the paperwork at the county to remove the improvements from the tax bill. Motion made by C/M K. Moss and seconded by C/M Walker to refund the adjustment to the property owner. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, and C/M Jones. Nays: none

Bid from Jamerson-chimney repairs: Motion was made by C/M K. Moss and seconded by C/M B. Moss to accept bid from Jamerson Construction. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

Mayors Day of Recognition for National Service: resolution presented for national service workers. Resolution signed.

Cemetery:

. Bobby Shumaker: plaque to be placed in cemetery. Motion was made by C/M K. Moss and seconded by C/M S. Moss for the town to purchase the plaque. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

. Edward LeSueur: plaque to be placed on bench in front of the town hall (Chamber purchased bench and will purchase plaque). Town to purchase plaque to be placed on a stone stand at the cemetery flag.

. Samuel Ranson: plaque to be placed on bench in front of the town hall (town to purchase the bench and plaque). Motion made by C/M K. Moss and seconded by C/M Walker to obtain plaque for Samuel Ranson. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker, and C/M Jones. Nays: none

Motion amended by C/M K. Moss and seconded by C/M Walker to include a plaque for Edward LeSueur to be placed at the base of the flag in the cemetery. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker and C/M Jones. Nays: none

Disposal site: The Clerk advised that additional posts are needed on each side of the gate. Motion was made by C/M K. Moss and seconded by C/M B. Moss to ask Larry Walker to put up whatever is necessary at the gate. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker and C/M Jones. Nays: none

CD renewal: BOA 9 month—Motion made by C/M K. Moss and seconded by C/M B. Moss to renew at BOA. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker and C/M Jones. Nays: none

OTHER ITEMS:

BOA Franchise fees: The fees are much lower than anticipated.

Relay for Life sponsorship: Motion made by C/M K. Moss and seconded by C/M B. Moss for the Clerk to check with Mrs. Toney to see if their church donated, if not then submit at $100 donation in honor of the Mayor. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker and C/M Jones. Nays: none

Meetings:

--VML Town Section Meeting: Farmville, May 9, 10a.m – 3 p.m. Motion made by C/M S. Moss and seconded by C/M K. Moss for the Vice Mayor and the Clerk to attend. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker and C/M Jones. Nays: none

seconded by C/M B. Moss for the Clerk and C/M K. Moss to attend. Motion passed unanimously. Ayes: C/M K. Moss, C/M B. Moss, C/M S. Moss, C/M Walker and C/M Jones. Nays: none

- DHCD Housing, Richmond, July 9 or Oct 10 or Dec 19: the V/M and the Clerk to attend July 9.

C/M S. Moss stated that she was asked about a walk-a-thon for St. Jude on the sidewalks. V/M Paige asked the Clerk to check the ordinances.

The Clerk advised that WFLO asked about getting an ad for Buckingham County cleanup day. C/M S. Moss advised that the Chamber did this.

Tana Knott suggested doing a Friday event maybe on Sept 20 or 22 –celebrating Autumn and leaving Summer

The Vice Mayor asked for a sign of standing to adjourn the meeting. Meeting adjourned at 8:20 p.m.
