TOWN BOARD MEETING AND PLANNING COMMISSION MEETING

JULY 27, 2015

Public Hearing:

Planning Commission chairman, Jim Weinbauer, called the Public Hearing to order at 7:30 p.m. Planning Commission members present were Al Gross.

The purpose of this hearing is to consider granting a conditional use permit to Kevin & Victoria Gassner at W8280 Forest Drive in Section 33 South so they may have a driveway longer than the 150’ that is stipulated in our driveway ordinance. The driveway will use the existing path that the Gassner’s used to get back to their home. They have at least two areas where a fire truck or other emergency vehicle could pass one another. Supervisor Klahn did state that the last corner as you approach the home has a sharp corner that the fire truck could not get through. He also stated that no gravel was in the final 200’ that would connect to the house / garage. Planning Commission Chairman Weinbauer stated that due to the fact that they did not have a quorum, no recommendation would be given to the Town Board but they could make a decision at the Town Board Meeting.

Planning Commission Meeting:

Planning Commission chairman called the Planning Commission Meeting to order at 7:43 p.m.

To consider granting a conditional use permit to John & Stephanie Rodgers on Summit Road in Section 26 South so that they may have a driveway longer than the 150’ that is stipulated in our driveway ordinance. The Rodgers’ plan to use the existing driveway entrance that has been there for many years. They feel that the driveway could be 200 – 215’ long depending on where they decide to put the home on the property. Planning Commission Members recommended an area up by the home where a fire truck or other emergency vehicle could turn around and go back out the driveway.

Town Board Meeting:

Chairman Limberg called the Town Board meeting to order at 8:00p.m. Board members present were Dan Klahn, Beth Lagacy, Ken Stemper and Paul Eischen.

Motion Stemper / Eischen to approve the clerk’s report with the change made by Supervisor Eischen to June’s minutes “that he disagreed with how the motion for re-appointment of Clerk / Treasurer Phipps was written in the April minutes and felt that Chairman Limberg changed the May agenda against his motion”. Motion carried. Lagacy opposed.

Motion Eischen / Klahn to approve the treasurer’s report as presented. Motion carried.

Bill Boesel talked about contacting Advanced Disposal about closing the tops of the garbage trucks so that all the garbage does not blow out of the top and onto the sides of the roadways making it look very dirty. Possibly put a notice in the newsletter stating that people still need to use garbage bags for both garbage and recyclables. It just doesn’t matter what color they are.

Jim Weinbauer stated that the trees were removed on Plank Road by the power lines although he stated there is still a large oak that is low hanging over the road on the south side which is not near any power lines.

Bill Boesel also talked about signs being put in the right of way, such as realtor, builders, etc. Will contact the realtor to discuss.

Motion Klahn / Eischen to approve the conditional use permit to Kevin & Victoria Gassner at W8280 Forest Drive in Section 33 South so they may have a driveway longer than 150’ that is stipulated in our driveway ordinance. The driveway needs to be completed all the way up to the garage with gravel and the final corner needs to be a sweeping one and wider so that the fire truck or other emergency vehicle can get through. Motion carried.

Craig Goeser said that they have had an engineer in to look over what they felt needed to be done to bring the Country Crafts Barn up to code for having a Banquet Hall. He said the cost from this engineer was outrageous. He wanted time to contact two other engineers so that he could get some bids and report back to the town by no later than September 28th meeting. Motion Eischen / Klahn to agree to these terms. Motion carried.

Steve Dickman, Fire Chief, was unable to attend the meeting but did send his monthly financial statement and fire calls for 2015. This year’s picnic was once again a huge success. The fire department would like to thank everyone who attended, purchased raffle tickets, or donated their time. The car show was smaller than expected but was well received and we hope to build upon this in the years to come. The county will soon be sending out the radio agreements to the local municipalities. You received a sample copy of the agreement several months ago. I informed them that the Town Board is the governing body that would sign our agreement. After the municipality signs the radio agreement, the two county radio technicians will start installing the new radios in the fire trucks. The BP gas card for brush truck #6 did not work in St. Cloud this weekend and I had to charge the gas to my card. The card does not expire until June 2017, so I have asked Brenda to look into this. The majority of our current pagers are 6 years old and the warranty has expired 1 year ago. Motorola no longer supports the Minitor 5 and will no longer service these pagers. Our current pagers are failing at a rate of one every other month and I have one spare pager left. We are looking into several different brands of pagers to help us determine which pager will be the most reliable when it is time to purchase replacements. Board members also saw that the Wade House had another false alarm.

Gene Liebe asked that a conversation be started concerning the town’s roadside mower. He feels that the town spends all the money cleaning out the ditches of brush and then the town mower does not make at least two passes on theses ditches and all the brush grows back up. Is the mower getting old and not working properly? Do we need to invest in a new mower? Do we hire more individuals to help John Kline do the mowing? Do we see if the county can mow our town roads? All felt that the roadside mowing could be started earlier so that the weeds do not get so tall or big that the mower just knocks them over. Will continue this discussion and get some quotes or ideas from other townships.

Chairman Limberg received a quote of $615 from the Sheboygan County Highway Department to paint the lines in the parking lot at the town hall. Motion Klahn / Lagacy to have the county do the lines on the town hall side as well as the handicap signs on the fireman’s side. Motion carried.

Chairman Limberg also received a quote from the Sheboygan County Highway Department to blacktop Penny Lane which is 1050’ for $24,781. Motion Stemper / Klahn to have the lawyer send a letter to Craig Bogart letting him know that we will have the county surveyor take a look at where the right of way is on his property and remove everything that is in it so that a ditch may be put back in so all water runs off the road. Motion carried. To do 2000’ of Hillcrest Drive from CTH-S to the west will cost $65,228. Chairman Limberg stated that he will need to put this as a class 1 notice in the paper and talk to Northeast Asphalt, Sheboygan County Highway Department and Scott Construction to see how much it would cost to get road fixed.

Chairman Limberg still has not received a quote from Scott Construction concerning the damage to Sunrise Road. Will have to contact Scott Construction again.

Rural Insurance is unable to help the Town Board get the money from Wallace Gierach concerning the damage to Glen Road and Cherry Road. Chairman Limberg contacted Mike Bauer, town attorney, and he sent a letter out to RAC Adjustments stating that it will not accept the $8,656.81 that was last offered but will accept there calculation of damages at $8,656.81 and triple the damage as required by Wis. Stat. 86.02 resulting in a settlement of $25,970.43. Have not heard anything from lawyer or Gierach insurance and the letter was sent July 17th. Attorney Bauer did say that we should go ahead and fix the roadway so that it looks like we are intending to do the work.

Supervisor Eischen received a complaint from Gerry & Tami Vater concerning the large berm of dirt and sand that is to the west of their house. Northeast Asphalt is continuing to remove gravel from the pit and has exposed another area leaving the dirt in a very tall mound to the west of Vater’s. A representative from Northeast did say that they are aware of the situation and have talked to the Vater’s about the eyesore. Northeast has promised to remedy the situation by the beginning of November depending on the weather. Bill Boesel also talked about his continued frustration with the gravel pit across the road from his house.

The culvert on the north end of Division Road close to CTH-C is the responsibility of the Town of Marshfield. Chairman Limberg did say that he had talked to them and they hoped to get the heaving culvert fixed before the end of summer.

Chairman Limberg reported building permits issued since last month’s meeting.

Motion Stemper / Lagacy to approve bills for payment. Motion carried.
