SectionI:

Noperson,firmorcorporationshalloperatealunchwagon,icecreamtruck,mobileortemporarystandonpublicpropertyforthepurposeofafoodorcraftsaleuntilalicensehasbeenobtainedfromtheMorristownSelectboard.Prescribedlicensefeeandcertificateofinsurancewithaminimumcoverageamountof$1,000,000shallbepaidandpresentedtotheTownAdministrationOfficepriortoissuanceofalicense.

A.NolicenseshallbesoissuedwithouttheapprovalinwritingoftheSelectboard.

B.LicensesshallbevalidfromApril1-November15.WrittenapplicationsforlicenseshallbefiledwiththeTownAdministration onorbeforeMarch1eachyearby personsthenengagedinsuchbusinessandtherequiredfeeshallbedepositedwiththe applicationalongwithacopyoftheircertificateofinsuranceandacopyoftheirState HealthPermit. WrittenapplicationbypersonsbeginningsuchbusinessafterApril1 shallbemadeatleast30(30)daysinadvanceofbusinessstartdate.

C.SuchLicenseisnottransferable.

D.ForeachLicenseperiodorfractionalpartthereof,thelicensefeeforalunch wagon,icecreamtruck,mobileortemporarystandshallbe75.00($75.00).

E.LocationofService(s)shallbeindicatedonLicense.AswellasvehicledescriptionandPlate#.

F.Uponapprovaloftheapplication,alicensecertificatesignedbytheauthorizedrepresentativeoftheMorristownSelectboard,shallbeissuedtothelicensee,whoatalltimesshallkeepsaidcertificatepostedinaconspicuousplaceintheplaceofbusinessanduponnoticeofsuspensionorrevocationoflicense,shallsurrenderforthwithsuchlicensecertificatetotheSelectboard.

G.TheMorristownSelectboardreservestherighttorevokesaidlicenseafterawarnedpublicmeeting.

H.TheTownofMorristownSelectboardshallhavetheauthoritytolimitthenumberofpermitsunderthisordinanceiftheSelectboarddeemsthatanuisanceisbeingcreatedbysaidvendors.

I.Allvendors,peddlersandotherpersonscoveredbythisordinanceshallonlybeallowedtodobusinessindesignatedareas.TheoperationonschoolgroundsisregulatedbyLamoilleSouthSchoolDistrict.

Exemptions:

Exemptedfromthisordinancearethosesellingfruits,vegetablesorotherfarmproduceandthoseutilizingprivatepropertywithavalidzoningpermitforoperationsdescribedinSection1ofthisordinance.

Violation:Penalty

Everypersonwhoshallviolateanyoftheprovisionsofthisordinancemaybepunishedbyafineofnotlessthan$25.00,nomorethan$50.00perviolation.
