PresidingOfficer,JoannMessinamovedtoagendaitemE.5.StaffReports–FieldOperationsDivision.TanyaGauthreaux,DirectorofFieldOperations,reportedontheTop10MostCommonViolationsfoundduringinspections,personnelchanges,technologybeingusedtoenhancetheinspectionprocess(route optimization and Einspections), and inspection statistics.

PresidingOfficer,JoannMessinamovedtoagendaitemE.6.StaffReports–LicensingDivision.LauraHernandez,ProgramSpecialist,reportedonlicensingstatisticsandtheagency’seffortsinstreamliningtheprocesstoregisteraused tow truck. There was board discussion about the process.

stackingofcomplaints.PresidingOfficer,JoannMessinareferredtheenvironmentalhazardfeeissuebacktotheworkgrouptodevelopsomethinginwritingfortheboardtodiscussandpossiblyapproveatthe next meeting.

PresidingOfficer,JoannMessinamovedtoagendaitemsF.2.WorkGroupReport,EducationWorkGroupBoardmember,JeanetteRashgaveanoverviewoftheissuesdiscussedattheEducationWorkGroup–safetytraining.Rulesweredraftedandareontheagendaforreviewandapprovalforpublication.

PresidingOfficer,JoannMessinamovedtoagendaitemG.1.PrivatePropertyOwnerswhoarerestriping,repavingorhavingemergencyworkdoneontheir properties are considered non-consent towsand the vehicles should not be left on the propertybut impounded. There was board discussed about thisissue. Executive Director, Bill Kuntz toldthe board hewouldtake their discussion under advisement.

PresidingOfficer,JoannMessinamovedtoagendaitemG.2.RuleSimplification.ExecutiveDirector,BillKuntzaskedtheboardtotakeanextensivelookattherulesandseewhatcouldberemoved,specificallybusinesspractices.LeadProsecutor,CharlotteMelderreportedthattheprosecturosaregoingthroughtherulesandexpecttoreducethembyathird.ProgramSpecialist,ToddForresterreportedthatComplianceisgoingthroughtherulesaswellbasedonthetelephoneinquiriestheyarereceiving.

PresidingOfficer,JoannMessinamovedtoagendaitemG.3.AmendVSFandBootingrulestomirrortheemailrequirementsin16TAC86regardingthetowingprogram.AssistantGeneralCounsel,Charles Johnson reportedthatthis has been completed andwill be ontheagendaforthenext meeting.

PresidingOfficer,JoannMessinamovedtoagendaitemH.PPIRateReviewUpdate.ComplianceManager,LeeParhamgaveanupdateonthePPIRateReview.TherewasboarddiscussionregardingusingtheCPItodoananalysisforaratechange.PresidingOfficer,JoannMessinareferredthemattertotheAdministrativeWorkgrouptodevelopaformulausingspecificcategoriesoftheCPItobediscussedandpossiblyapprovedatthenext meeting.

PresidingOfficer,JoannMessinamovedtoagendaitemI.Discussionandpossiblerecommendationonproposedamendmentstorulesat16TexasAdministrativeCode(TAC),Chapter86.250.LicenseRequirements–TowingOperatorContinuingEducationtoprovideflexibilitytoincludetheSHRPIIsafetytrainingcourses.CharlesJohnson,AssistantGeneralCounsel,gaveanoverviewofthedraftrules.Boardmember,JeanetteRashmadeamotiontorecommendtherulesforpublicationtotheTexasRegister.Boardmember,JohnStinnettsecondedthemotion.Themotionpassedwithaunanimousvoteinfavor.Boardmember,JeanetteRashmadeamotiontowaivetherulescomingbackbeforetheboardifnochangesweremadeafterthecommentperiod.Boardmember,ChrisConfersecondedthemotion. The motion passed with a unanimous vote in favor.

PresidingOfficer,JoannMessinamovedtoagendaitemJ.Recommendationsforagendaitemsfornextmeeting.Theboardrequestedthatthecrossagencymeeting,vehiclerelocationissue,PPIratereviewformula,AdministrativeWorkgroupreport,rulesforenvironmentalhazardfee,printingoflicensesissueforTowandVSFoperators(issuedatevs.expirationdate),andreportonstackingcomplaintsissuebeonthenextagenda.CharlesJohnson,AssistantGeneralCounselrequestedthattherulestoreconcile email languageinthevehicle storage facilities and bootingrulesbeonthenextagenda.
