Torture Victim's husband and sons implicated in false charges after the complaint was registered with NHRC (NHRC Case no.444/25/13/2017)

Respected Sir,

On 22.03.2017, MASUM lodged one complaint before the Commission for the victims namely Mr. GopalSarkar, Ms. BhabaniMondal and Mr. SudhangshuMondal, all residing at village-Char Rajapur, Police Station-Raninagar, District-Murshidabad. The said complaint disclosed the incident of torture faced by the victims in the hands of the perpetrator BSF personnel. The Commission registered the complaint as NHRC Case no.444/25/13/2017. The case is pending for reports from the state authorities as per the information available on the Commission’s website against the said case.

Be it mentioned that the victims had lodged written complaint before the Superintendent of Police, Murshidabad against the aforesaid incidents of torture committed upon them by the perpetrator BSF personnel.

In a recent development of the situation another incident happened on 11.07.2017 at about 7pm at the residence of the victim Ms. BhabaniMondal. On that day at the mentioned timewhen Mr. ShibnathMondal, husband of Ms. BhabaniMondal, and his two sons with their wives were sitting on the courtyard of the house, Mr. K. K. Das, Company Commander of Rajanagar BSF Camp, Battalion-83 entered with another BSF officer in civil dress. The said Company Commander tortured them physically and verbally abused them with filthy languages accusing them as they were cattle smuggler. When Mr. ShibnathMondalprotested, the said Company Commander took out his revolver and made threatenings by saying that he will kill Mr. ShibnathMondal. Even he fired one round in the air and told Mr. ShibnathMondal saying that he and his family members will be implicated in false criminal case and left the house.

On 19.07.2017 at about 6pm in the evening the police personnel of Raninagar Police Station came to the house of Ms. BhabaniMondal in search of her husband Mr. ShibnathMondal and three sons namely Mr. SarajitMondal(age-22years), Mr. AbhijitMondal(age-19 years) and Master BiswajitMondal(age-17 years).

Later, Ms. BhabaniMondal and her family came to know that Raninagar Police Station registered one criminal case on 18.07.2017 being FIR no.431/2017 under section 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act on the complaint of BSF. In the said case Ms. BhabaniMondal’s husband and the aforesaid three sons were implicated as accused persons.

Mr. ShibnathMondal lodged written complaints before the Superintendent of Police, Murshidabad on 21.07.2017 and 01.08.2017 describing the incident but till date no action took place on the complaint.

I request for proper intervention of the Commission in my present complaint and direction to related authority for necessary protection to the victims.
