Dear Home Seller,
Pursuit to NJAC 5:70-2.3 you are required to have BEFORE any R-3 or R-4 structure is sold, leased, or otherwise made subject to a change of occupancy for residential purposes, you the owner shall obtain a certificate of smoke detector/carbon monoxide.
This process involves obtaining a Smoke Detector application from the Office of the Fire Marshal, located at 67 Quakertown Rd, Pittstown NJ 08867, applying for said inspection, paying the appropriate fee (depending on time frame of closing), scheduling said inspection, and passing said inspection.
To successfully pass the inspection you need the following:
● 2A10BC Fire Extinguisher mounted in the kitchen area
● Carbon Monoxide detector located on the sleeping level, not to exceed 10 feet from ALL bedrooms
● Smoke Detector on each level of the home with the exception of a unfinished attic, but depending on the age of the home interconnected hard wired battery back-up smoke alarms may be required (see below)
Prior to January 1977: Battery operated smoke detectors on all levels
January 1977-Spetember 1978: Electric smoke detectors on sleeping levels and battery operated smoke detectors on all other levels
October 1978-January 1983: Electric smoke detectors on sleeping and basement levels
Battery operated smoke detectors on all other levels
February 1983-July 1984: Electric smoke detectors on all levels
August 1984-February 1991: Electric smoke detectors on all levels, all detectors must be interconnected. A smoke detector is required on every level
March 1991-Present: Electric smoke detectors on all levels and inside each bedroom, all detectors must be interconnected and equipped with battery back up
Should you chose not to have the inspection you will be in direct violation of this act and be subject to a monetary penalty.
