3. This Application for Product Safety Evaluation , together with the purchase order constitutes our request to ETL for
US; Canadian v US and Canadian(please tick as appropriate)product safety evaluation and testing of our product identified in said documents.ETL is authorized to perform all tests and evaluations necessary as specified in the attached ETL Quotation ReferenceNo. QHZ170324038 dated 2017-03-24 .
4. The purpose of the evaluation is to determine if the submitted product complies with the pertinent requirements of the applicable safety standard(s) for the product .If the product is found to comply with these requirements, ETL will issue a formal listing report describing the product(s), and indicating the standard(s) used, procedures, instrumentation, results of inspection(s) and test(s) and conclusions. If the product(s) is (are) found not to be in compliance with the requirements of the applicable safety standard(s), a letter report may be issued which will describe the constructional features and/or test results which indicate noncompliance.
5. After compliance has been determined, it is understood that the product(s) will be listed in the " Directory of ETL Listed Products " and will be eligible for safety labeling provided that the ETL Labeling, Listing, and Follow-up Service Agreement" has been properly executed by both parties and all of its provisions and requirement adhered to.
6. It is acknowledged that the fee quoted by ETL is an estimate based upon information supplied to ETL. When a sample of the product(s) is (are) receive by ETL, additional requirements for evaluation , testing or handling may be indicated. Under such circumstances ETL will re-estimate the cost of the project and will await approval from us before proceeding.
7. It is further acknowledged that the fee quoted by ETL is for the evaluation and testing of the product(s) as receive. If constructional features and/or test result of the product which are not in compliance with the requirements of the standard(s) or acceptable engineering practices are observed and changes in construction, design or components are necessitated by the these observations, which require additional evaluation or testing, ETL may require an additional fee.
8. We understand that ETL, in performing its functions as requested by us, does not assume or undertake to discharge any responsibility of ours to any other party. It is recognized that the opinions and finding of ETL, with regard to the request made by us, represents its judgment given after due consideration to the attendant limitations opinions, or that there will be universal agreement with, or acceptance of, such findings.
9. It is understood that some of the required tests are inherently hazardous to persons and property. It is understood by the applicant, as a result thereof ,that ;
(a) During testing in an ETL facility, the applicant may arrange to have a representative on hand to observe or consult with ETL regarding test procedures in an effort to avoid or minimize damage to applicant's product. In no case will ETL be responsible for damage to the applicant's product or property as a result of the testing. If the applicant decides to have a representative present during the testing in the ETL facility, ETL will not be responsible for any injuries to the applicant's representative as a result thereof.
(b) For testing performed at the applicant's request in a location other than an ETL facility, the applicant must have a representative present with knowledge sufficient to assemble, operate, and if necessary, dismantle the product to be tested . ETL will not be responsible for injury to any persons or property as a result of the tests when these tests are performed outside of an ETL facility, nor will ETL operate or be responsible for the operation of any of the applicant ¸s products tested outside the ETL facility.
10. All products to be tested in an ETL facility will be shipped prepaid. At the conclusion of testing, all products will be returned to the applicant at the applicant's expense , unless other disposition is specified. ETL will not be responsible for damage to, or loss of products, during shipment, nor are shipping costs included in any job estimates. The risk of loss for products during shipment to or form ETL shall be borne by the applicant.
11. For testing performed at the applicant's request in a location other than an ETL facility, it is understood that travel, maintenance and miscellaneous expenses will be billed in addition to the testing fee.
12. Applicant will not use, nor refer to the ETL name or logo on labels, product nameplates, brochures, advertising or sales promotion material which indicates or implies that a product is listed or approved by ETL until written authorization has been received by applicant for such use.
13. ETL will not voluntarily disclose any information obtained by it during the investigation of the applicant's product , without prior written authorization of the applicant.
