Dear Sir,
This has reference to our import shipment from ______to ______with details mentioned in the subject.
Whereas we intend to transport the above said containers by road from______premises to our factory/ godown/office situated at ______and hereby undertake to comply with the below-mentioned requirements in order that you may affect delivery of the container(s) to us as aforesaid.
We undertake to bear all cost(s) including but not limited to cost related to Transportation, Handling charges for the said Containers from the time of Lifting / discharging from container yard or shipside (whatever applicable) till the time of re-delivery of the said container/s to the premises designated by you. Wefurther confirm to currently have and maintain throughout the duration of this Agreement all licenses and permits necessary for the due performance of our obligations hereunder, including but not limited to those necessary to undertake the responsibility of fulfillment of all formalities of Customs, Port Authorities or any other related authority, prior to such transportation after settlement of all related costs by us.
We further undertake to redeliver the container/s to you within ____ days ( or changes as maybe indicated from time to time prior delivery of such container/s ) calculated from the date of lifting the container/s from ______, Place. We also undertake to ensure that utmost care will be taken by us for the said container/s while in our custody till the time of redelivery of the Container/s. We hereby agree and undertake to inform you in writing as soon as the container/s is returned by us at the designated site and in any event no later than 12 hours from the time the said container is returned at the above site. Within 48 hours of the receipt of such written information, we request you to carry out the survey of the container/s and damages assessed, if any. The findings of such survey with respect to any cost due for undertaking the repairs arising out of damages to the container whilst our custody, shall be final and binding and borne by us. On receipt of the said survey report, we hereby agree and undertake to pay you such sum as may be due assessed by your surveyor, no later than 7 days after such redelivery of container/s. Incase of any dispute, the same shall be informed to you immediately and if necessary joint survey of the damages and its assessment shall be done to the satisfaction and confirmation of both parties.
We undertake to pay Rs 3,00,000.00 for 20’DV and Rs 5,50,000.00 for 40’ DV , Rs ______for 40’ HC and Rs ______for Special Container/s which includes the value of Container/s and Custom levy , in case we fail to return the Container within the requisite time or due to total loss of your Container/s.

In addition to the above, we undertake to pay a refundable security deposit of Rs 10,000.00 for 20’DV and Rs20,000.00 for 40’ DV, Rs 20,000.00 for 40’ HC and @ Rs ______for Special Container/s prior to pick up of the container/s, which will be refunded upon redelivery of container/s at the designated site. We hereby agree that any costs incurred including but not limited to repair costs and or misdelivery of container/s to any other sites other than your designated site indicated at the time of pick up , can be deducted or adjusted against our security deposit without prior intimation to us.
We also confirm that the import cargo does not contain any contraband articles listed and included in Indian Customs Act. We also undertake to clear all the outstanding charges as mentioned herebelow prior submission of the receipt {to} your Head Office for cancellation of the Guarantee.
We hereby agree and undertake to indemnify and hold you , ( employees, servants and agents included) harmless from and against any and all cost, expense, liability, fine, penalty, etc. arising from or related to the death due to accident to any person and / or damage caused to property arising out of the use and operation of the container/s while in our or our
(agents, servants or representatives included ) possession.. Any and all cost, expense, liability, fine, penalty, etc. arising from or related thereto shall be borne solely and exclusively by us.
We will be liable for the payment of container detention charges besides demurrage and all duties and levies.Time to commence at 0.00hrsof the day following the date on which the containers were unloaded at the port. If you do not receive the containers within the said period allowed, we shall be liable for container detention as per the agreed tariff indicated below to be paidin Indian currency, converted at the rate of exchange prevailing at the relevant time.
US $ 8.50/20’ & $17.00/40’ per calendar day or part thereof the first 7 days.
US $ 13.50/20’ & $ 27.00/40’ per calendar day or part thereof the first 7 days.
US $ 17.50/20’ & $ 35.00/40’ per calendar day or part thereof the first 7 days.
US $ 48.00/20’ & $ 96.00/40’ per calendar day or part thereof thereafter.
In any event, we hereby agree and undertake to return the container at your designated site within a period not exceeding 30 days from the date of delivery of containers to our custody.
In support of our undertaking to pay such above mentioned dues, Cheque no.______dtd______issued from bank ______for Rs.______in favour of M/s ______signed by ourselves / our custom house agent M/s. ______is being handed over to your office, to be presented for collection should we fail to fulfill our obligation..
