In consideration of your allowing us to remove the above mentioned import loaded full container/s to our premises, we , the undersigned, hereby undertake and guarantee you the
following:-
1. We shall at our cost and risk remove the above container/s (after payment of customs duty) from nominated site to our premises situated at ______within 5 days and return the same to your storage yard within 15 days from the date of its removal.
2. We shall at our cost arrange to survey the container/s by your surveyors before removal from nominated site and after returning at your storage yard.
3. In case of any damages to the container/s whilst in our custody, we shall pay the repair cost of damage as estimated by your surveyors.
4. We shall pay you the container detention and other charges as and when demanded by you.
5. In case we fail to return the container/s within 15 days from the date of removal, we shall obtain necessary permission from you and customs authorities to retain the container with us beyond 15 days.
6. In case the container/s is / are lost whilst in our custody we shall pay you the cost of the container/s and customs duty applicable on the container/s. (Rs.2,71,000/-aprox per 20’, Rs. 5,42,000/ per 40’ & Tank Rs 13,00,000/- In case of Reefer cont. 20’ Rs. 16,26,000/- & 40’ Rs. 32,53,000/-) The cost of the said lost container will be as determined by your Principal to whom the said containers belong.
7. We shall produce the original triplicate copy of Bill of Entry duly signed endorsed by the gate officer of______(our storage yard), within 7 days from the date of returning the container/s along with survey reports.
8. We shall keep you and the carriers completely indemnified and harmless from and against all consequences, which may arise from your complying with our request.
9. This bond will remain in force till such time we comply with our above under takings and
fulfill all your / customs authorities requirement.
10. We hereby confirm that the import cargo does not contain any contraband Articles, in terms of Indian Customs regulation and that the Shippers have not tampered with the containers for any purpose or for concealment of any information to any government/statutory authorities. We, as consignee of the cargo would be fully responsible for all the cost consequences for the same. We further confirm that the containers would only be taken to our premises at ______and that we would approximately take ______days to return the said container back to your empty storage yard after removal from the nominated site.
11. We also undertake and pay you all cost and charges towards containers damages/repairing, If it is proved and established that the damage has been caused due to inherent vice and/or Nature of cargo and/ or improper/ insufficient packing or excess weight of the cargo.
12. You may deposit the security cheque given by us to recover any charges, which we undertake to get honored by our bank and clear the funds.
