Re: Procedure to file under 52 Pa. Code Section 75.17; Second Amended Final
Rulemaking Order at Docket Number L-2014-2404361entered October 27, 2016
Pursuant to Section 75.17 entitled “Process for obtaining Commission approval of customer-generator status,” all electric distribution companies (EDCs) regulated by the Pennsylvania Public Utility Commission must use the following procedure when an EDC submits a completed net metering application for approval to net meter alternative energy systems with a nameplate capacity of 500 kilowatts or greater.
The EDC must file with the Secretary of the Commission, the completed Application made to the EDC by the Applicant under sections (a) and (b) of Section 75.17 within twenty (20) days of the EDC receiving a complete Application.
The EDC must also file with the Secretary of the Commission a recommendation which explains why the Application is or is not compliant with the Commission’s Regulations and the EDC’s Tariff and recommend approval or rejection of the Application in accordance with Section 75.17(b). The EDC shall serve a copy of its recommendation on the Applicant and include a certificate of service with its filing.
Therefore, the Commission is directing all EDCs subject to this regulation to file an Application submitted to the EDC by an Applicant along with the EDC’s explanation and recommendation to the Secretary, and to email a confidential courtesy copy to Joseph Sherrick () and Scott Gebhardt () of the Bureau of Technical Utility Services at the time the utility files its original submission to the Secretary of the Commission.
To expedite these filings, each EDC has been assigned a docket number (listed below). When filing with the Secretary, the EDC shall use the docket number assigned to it.
