In January 2002The No Child Left Behind Act of 2001 reauthorized the Elementary and Secondary Education Act.
This application has been revised to be in compliance with the intent and purpose of the statute.
Purpose of Title I, Part D, which is entitled Prevention and Intervention Programs for Children and Youth who are Neglected, Delinquent, or At-Risk is:
•to improve educational services to children in local and State institutions for neglected or delinquent children and youth so that such children and youth have the opportunity to meet the same challenging State student performance standards that all children in the state will be expected to meet;
•to provide such children and youth the services needed to make a successful transition from institutionalization to further schooling or employment; and
•to prevent at-risk youth from dropping out of school and to provide dropouts and youths returning from institutions with a support system to ensure their continued education.
Purposeof Title I, Part D, Subpart 2 – Local Agency Programs -- is to support the operation of local educational agency programs that involve collaboration with locally operated institutions -
- to carry out high quality education programs to prepare children and youth for secondary school completion, training, employment, or further education;
- to provide activities to facilitate transition of such children and youth from correctional program to further education or employment; and
- to operate programs in local schools for children and youth returning from correctional facilities and other institutions, and programs which may serve at-risk children and youth.
Use of Funds- may be used, where appropriate for the following:
- programs that serve children and youth returning to local schools from correctional facilities, to assist in the transition of such children and youth to the school environment and help them remain in school in order to complete their education;
- dropout prevention programs which serve at-risk children and youth, including pregnant and parenting teens, children and youth who have been in contact with the juvenile justice system, children and youth at least one year behind their expected grade level, migrant youth, immigrant youth, students with limited English proficiency and gang members;
- the coordination of health and social services for such individuals if there is a likelihood that the provision of such services, including day care, drug and alcohol counseling, and mental health services, will improve the likelihood such individuals will complete their education;
- special programs to meet the unique academic needs of participating children and youth, including vocational and technical education, special education, career counseling, curriculum-based youth entrepreneurship education, and assistance in securing student loans or grants and postsecondary education; and
- programs providing mentoring and peer mediation.
Local Educational Agency Applications
Each LEA must detail the following:
- a description of the program to be assisted;
- a copy of formal agreement regarding the program to be assisted between the LEA and the institutions;
- as appropriate, a description of how participating school will coordinate with facilities working with delinquent children and youth to ensure that such children and youth are participating in an education program comparable to one operated in the local school such youth would attend; (This applies mainly to correctional institutions that operate their own school or day programs for delinquent children and youth.)
- a description of the program operated by participating schools for children and youth returning from correctional facilities and, as appropriate, the types of services that such schools will provide such children and youth; (Special Rule – applies only to LEAs that serves a school operated by a correctional facility. In this case, the LEA is not required to operate a program of support for children and youth returning from such school if more than 30% of the children and youth attending the school operated by the correctional facility will reside outside the boundaries served by the LEA.)
- a description of the characteristics (including learning difficulties, substance abuse problems, and other special needs) of the children and youth expected to be served by the program, and a description of how the school will coordinate existing educational programs to meet the unique educational needs of such children and youth;
- as appropriate, a description of how schools will coordinate with existing social, health and other services to meet the needs of students served by these funds;
- as appropriate, a description of any partnerships with local business to develop training, curriculum-based youth entrepreneurship education, and mentoring services for participating students;
- as appropriate, a description of how the program(s) will involve parents in efforts to improve the educational achievement of their children, assist in dropout prevention activities and prevent the involvement of their children in delinquent activities;
- a description of how the program(s) under this subpart will be coordinated with other Federal, State and local program(s);
- if applicable, a description of how the program(s) will be coordinated with programs operated under the Juvenile Justice and Delinquency Prevention Act of 1974 and other comparable programs;
- as appropriate, a description of how schools will work with probation officers to assist in meeting the needs of children and youth returning from correctional facilities;
- as appropriate, a description of the efforts participating schools working with correctional facilities will make to ensure that all are aware of a child’s or youth’s existing individualized education programs; and
- as appropriate, a description of the steps participating schools will take to find alternative placements for children and youth interested in continuing their education but unable to participate in a regular public school program.

4.STUDENT SELECTION
The district must design a processforidentifyingthose students most in need of academic support. - At-risk students who attend local schools and those who also reside in institutions for delinquent students qualify for consideration for participation in the program. However not all children require supplemental support to the same degree as others. The most important step in selecting children who will be included in the Title I Part D, Subpart 2 program is determining if they are among the most in need of services. These students should be identified on the basis of the school district and/or separate institutional school data.
