THIS SUMMER SEWER RATE AGREEMENT is made and entered into as of

(date)______, 2018, by and between the Town of Plainfield, Indiana and(name)______owners of the real estate at (address)______, Indiana.

WITNESSETH

WHEREAS, the Town Council of the Town of Plainfield, Hendricks County, Indiana established a summer sewer rate to provide relief for single-family residential customers by passing a Summer Sewer Rate Ordinance.

NOW THEREFORE, in consideration of the mutual promises contained herein, the parties hereby agree as follows:

Section 1. Single-family residential sewer service, as applicable to the sprinkler rate, shall apply to each lot, parcel of real estate or building, which is used as a single-family residence. Said sprinkling rates shall not apply to any premises used wholly or in part as commercial, industrial or multi-family (two units or more).

Section 2. The summer value will be the unmetered rate of $40.39 per month for the year 2018.

Section 3. For 2018, the summer sewer rate will begin with the June due July 15th billing and end with the October due November 15 billing.

Section 4. For 2018 summer sewer rates, single-family residential customers shall be required to pay a $50.00 non-refundable application fee at the Plainfield Municipal Building, 206 W. Main St., Plainfield, Indiana. Deadline to sign up is May 15th. Customers signing up after May 15 will pay a $10 penalty. Summer sewer rates paid after May 15 will commence with the next bill cycle after payment is received. Summer sewer rates will not be retroactive.

Section 5. The term of this agreement shall commence upon the date this agreement is signed by all parties and shall terminate upon the earlier of (a) the termination of this agreement by the customer, in writing to the Plainfield Municipal Building, 206 W Main St, Plainfield. IN or (b) December 31, 2018.
