AGREEMENT

  • This agreement is made between Environmental Protection Agency Punjab (hereinafter called Party No.1) and NGO named “______”through its Chairman/President and General Secretary (hereinafter called Party No.2).
  • Whereas Party No.1 is willing to grant a sum of Rs. 2.00Lacto the Party No. 2 for the execution of environment project.
  • And whereas party No. 2 is desirous to obtain the grant money Rs. 2.00Lacto execute the project titled “______”within the duration of three months after the receipt of first installment.
  • Now both the parties agree, accept and undertake to execute the following provisions.
  1. The EPA, Punjab (Party No.1) will provide financial assistance amounting to Rs. 2.00Lacin advance through two installments of equal amount to the Party No.2 for implementing the project approved by theProject Scrutiny Committee of the EPD Punjab.
  2. The grant will be released after signing the agreement between the Parties and after completing all requirements/formalities.
  3. The Party No.2 shall implement the project as per mutually agreed conditions and submit monthly progress report to the Party No. 1. The progress report must reach the Party No.1 within one week after expiry of each month.
  4. The Party No.2 shall contribute in the project in the shape of kind/cash/labour/others at least equivalent to 20% of the EPA’s contribution. The Party No.2 shall not spend grant money for purchase of vehicles, equipments, furniture and payment of salaries/establishment charges/utility bills.
  5. The Party No.2 shall maintain accounts/records of the expenditures and submit to party No.1 in proper format/form.
  6. While making procurement of different items, the NGO will pay all applicable Govt. Taxes.
  7. The representative(s) of Party No.1 will inspect, evaluate and monitor the project to be implemented by Party No.2 as and when Party No. 1intends to do so during execution and till one year after the execution of project.
  8. In case Party No.2 fails to implement the project or the grant money remains fully or partly un-utilized or diverted to some other purpose/use other than the project, the amount released by the EPA, Punjab shall be recovered from party No.2.
  9. If Party No.2 fails to return entire grant money to party No. 1, in spite of calling it to do so, the money shall be recovered from Party No.2 as arrears of land revenue along with initiation of criminal proceedings against it and Party No.2 shall also stand “blacklisted”;
  10. The Party No.2 shall welcome and facilitate spot visit (s) by the representative (s) of the Party No.1.
  11. In case of disagreement between the Parties, the decision of the Secretary, Environment Protection Department, Punjab shall be final and binding on both the Parties.
  12. The Party No.2 hereby indemnifies the Party No. 1 (Government of Punjab/EPA, Punjab or any Officer of the Government) of any breach of law, default or the termination of thisAgreement.
