  1. Service Description.

Customer understands and agrees that ThinkTel is not providing a local service. Accordingly local services such as but not limited to 911 emergency calling are not included and will not be routed through ThinkTel’s network. Customer agrees that all associated DIDs and/or charge numbers may not ever be used to originate 911 calls via ThinkTel’s network. Customer understands and acknowledges their responsibility to obtain 911 emergency services from another provider and ensure full and continued compliancy with all applicable governing laws, regulations, and obligations.

  1. Registering with the Commission.

Customer agrees to abide by Telecom Decision CRTC 2005-28, 12 May 2005 (Decision 2005-28) and register with the Commission as a reseller.

  1. Nomadic VoIP 911 Call Routing.

Customer agrees to abide by Telecom Decision CRTC 2007-44, 15 June 2007 (Decision 2007-44) and Telecom Decision CRTC 2005-21, 4 April 2005 (Decision 2005-21), when acquiring 911 emergency services from another provider. It is the Customer’s responsibility to ensure that its chosen provider is capable of providing nomadic 911 services in accordance with industry standards and government regulations.

  1. Express Consent.

Before service commencement Customer agrees to obtain each end user’s express consent by which the end user acknowledges his/her understanding of the 911/E911 service limitations as directed in Telecom Decision CRTC 2005-21, 4 April 2005 (Decision 2005-21), and using one of the approved methods of obtaining express consent as detailed Telecom Decision CRTC 2005-15, 17 March 2005 (Decision 2005-15).

  1. End User Notification.

Customer agrees to adhere to the end user notification obligations as set out in Telecom Decision CRTC 2005-61, 20 October 2005 (Decision 2005-61). The Customer agrees to submit all proposed customer notification texts, prior to their use, to the Commission for review as per Telecom Decision CRTC 2005-61, 20 October 2005 (Decision 2005-61).

  1. End User’s Physical Address.

Customer agrees to adhere to Telecom Decision CRTC 2010-387, June 17 2010 (Decision 2010-387).

  1. Applicable Governing Laws, Regulations, and Obligations.

Customer acknowledges their responsibility to ensure it and its chosen provider’s continued compliance with governing laws, regulations, and obligations. Customer will ensure immediate complete compliance with all newly established and/or modified laws, regulations, and/or obligationsincluding those which may supersede an existing law, regulation, and/or obligation.

  1. Resellers.

Customer understands and agrees to bind all subsequent resellers to each above noted CRTC Decision without exclusion.
