Board of Trustees Minutes

December 14, 2004 – Treehouse Condo Club Room

Members Present:J C Zalog, Chair; Jim Daily, Vice Chair; Brett Stump, Secretary/Treasurer; Doug Battaglia, Greg Fier

Staff Present:Carl McKinney, Chief of Police; Kathy Isaacs, Village Superintendent

Chair J C Zalog called the meeting to order at 7:00 p.m. with the Pledge of Allegiance. Chair Zalog noted that all members were present.

Approval of Minutes

Jim Daily moved to approve the November 9, 2004 minutes as written. Greg Fier seconded the motion, motion carried.

Treasurer’s Report

Brett Stump reviewed the November financial report. Report was filed for audit.

Chair Zalog reminded everyone about the upcoming budget planning session, Budget Public Hearing, and the Special Trustees meeting to approve the 2005 budget to be held on December 21, 2004 starting at 6:30 p.m., Public Hearing to start 7:45 p.m. and Special Trustee meeting to begin at 8:00p.m.

Old Business

Draft Noise Ordinance

All Trustees reviewed the draft ordinance and discussion was held. Changes, additions and deletions were suggested.

Brett Stump moved to make the changes, additions, and deletions and have the Village Attorney, Tom Motley review the noise ordinance, as well as the Trustees prior to the January meeting. Greg Fier seconded the motion, motion carried.

CommunityBuilding Review

Jim Daily moved to table the review of the CommunityBuilding sketch until Operation and Maintenance costs were determined and source of funding for the building was obtained. Doug Battaglia seconded the motion, motion carried.

Other Old Business

Flags – Jim Daily suggested that the Village consider putting up banners for the various seasons on the poles throughout the Village instead of flying the U S Flag. Discussion was held regarding the banners and the suggestion was made that maybe some of the businesses could “adopt a pole”. It was also noted that all U S Flags have been removed and destroyed in the proper manner by the American Legion.

New Business

Vent Less Fireplaces or Stoves

Arno Wehr II suggested that the Village adopt an ordinance allowing vent less fireplaces or stoves. Further discussion followed regarding the state regulations.

Brett Stump moved to have Planning and Zoning review the vent less fireplaces or stoves and report back to the Trustees their findings. Motion seconded by Greg Fier, motion carried.

Appointment – BransonLakes Area Tourism Community

Chair J C Zalog read a letter from the Branson Lakes Area Tourism Community Enhancement District regarding the appointment of an individual to represent the Village of Indian Point.

Greg Fier moved to appoint Kent Turner to fill the position on the Branson Lakes Area Tourism Community from October 1, 2004 to September 30, 2007. Motion was seconded by Jim Daily, motion carried.

First Reading – Ordinance 04—07 Amend Zoning Document

Chair J C Zalog read Bill Number 84, Ordinance 04-07, an Ordinance approving a recommendation to amend the Zoning Document in its entirety.

First Reading – Ordinance 04-08 Amend Subdivision Document

Greg Maycock read Bill Number 84, Ordinance 04-08, an Ordinance approving a recommendation to amend the subdivision regulations in its entirety.

Committee Reports

Police & Safety Advisory Committee – Brett Stump

Brett reported that the Police Department has received a grant for handheld radio, bulletproof vest, and prisoner restraints. It was noted that the match for the grant will be $137.00. Brett also stressed that all residents and business owners should always call 911 if police services are required, and not to call the Police Chief at home.

Jim Daily moved that equipment received from the grant be ordered at the beginning of January, 2005. Brett Stump seconded the motion, motion carried.

Planning & Zoning Commission – Greg Maycock

Greg reported that two (2) public hearings were held: 1) amendments to the Zoning and Subdivision Regulations and 2) rezoning application for Table Rock Beach Subdivision from R-1 to R-4. He noted that a decision has not been made regarding the rezoning as the Planning and Zoning members will make a visit to inspect the site. Greg also stated that two (2) sketch plans were presented at the meeting and both plans were approved (The Cliffs & Lantern Bay and Stillwaters Resort).

Board of Public Works – Greg Maycock

Greg reported that two (2) meetings were held in November. The special meeting was to discuss information with the Missouri Department of Natural Resources regarding the SRF loan with the engineers, and the regular monthly meeting covered the Jakes Creek Trail project, enforcement of complaint and tax issues. Greg further explained the proposed tax legislation of the 1/8 per cent sales tax for StoneCounty to be utilized to help fund the treatment of the sewage systems. The other tax issue is a state wide issue which will be enacted on the property

taxes for the same purpose. The BPW opposes both issues and ask the Board of Trustees to back the BPW in their endeavors to seek legal assistance to block the 1/8 per cent sales tax in StoneCounty and to opt out of the property taxes imposed by the State of Missouri.

Jim Daily moved to adopt a resolution opposing the 1/8 percent sales tax in Stone County and to encourage other municipalities to work with the Village of Indian Point to fight the proposal and to hire an attorney regarding the property tax law in order to opt out before the law is put into effect and to fight the Stone County 1/8 percent sales tax issue. Greg Fier seconded the motion, motion carried.

Roads – Jim Daily

Jim reported that a gentleman has contacted him as to picking up washers, dryers, refrigerators, stoves, air conditioners, dish washers, copper and aluminum in the Village at curbside. He will do this for the Village the first weekend in March and will continue until all has been picked up at no cost to the Village. It was determined that an article should be placed in the Smoke Signals for notification in January, February and March.

Jim also reported on the road conditions of Hilltop Lane and Long Lonesome Road and advised the Trustees that rock would be ordered for Hilltop Lane and fill would be received to repair Long Lonesome Road. The fill will not cost the Village, but the rock and a backhoe will cost approximately $1600.00. The money will be used out of the road repair budget.

CAAD – Kent Turner

Greg Fier moved to endorse the recycling of the Christmas tree project for the fish habitat improvement project for the Indian Point area and to send letters of appreciation to the appropriate authorities upon completion. Brett Stump seconded the motion, motion carried.

Greg Fier moved to endorse new area annual event for Wilderness Road Storytelling and Music Festival to be held primarily in KimberlingCity, with satellite events in Branson West, Reeds Spring, and Indian Point. Brett Stump seconded the motion, motion carried.

Recycling – Betty Fier

Betty reported that a total of $544.15 has been received from the aluminum can recycling program to be used for beautification of the new community building.

Transportation Coalition – Jan Hoynacki

Jan reported that preliminary work is being accomplished for the proposed future road as well as of estimate of costs for the road and the signalized intersection of 265 at the south end of the Wilderness Campground.

Brett Stump moved to approve the Accounts Payable as submitted. Greg Fier seconded the motion, motion carried.

Executive Session

Greg Fier moved to close the meeting to go into Executive Session at 9:50 p.m. to discuss personnel matters. Brett Stump seconded the motion, motion carried.

Chair Zalog closed the regular meeting at 9:50 p.m. for executive session.

Chair Zalog opened the regular meeting at 10:00 p.m. and stated that the executive session was held regarding personnel and motions were approved.

Comments from the Floor

Kent Turner commented on the meeting with the Tourism Tax Board.

Discussion was held regarding parking boat trailers, cars, etc property leased from the U S Corps of Engineers and the effect this will have on resorts. Requested that this information be placed on the January agenda.

Greg Fier moved the meeting be adjourned. Jim Daily seconded the motion, motion carried. Meeting adjourned at 10:30 p.m.
