The Sports Councils: Recognition process: Privacy notices

Data Protection

1.  Your application will be assessed by one of the Home Country Sports Councils. These are Sport England, Sport Scotland, Sport Wales and Sport Northern Ireland. UK Sport will also be involved in the assessment of the application. Regardless of which Home Country Sports Council you apply to, that Council may share your information with the other Sports Councils for the purposes of assessment, moderation or compliance.

2.  The Sports Councils may also share your information with individuals and organisations they consult when assessing applications or when considering compliance issues. These organisations may include other teams within the Sports Council itself, accountants, external evaluators and other organisations or groups involved in the recognition process and its application and the self-assurance process;

3.  The Sports Councils may also share your information with other lottery distributors, government departments and other organisations and individuals with a legitimate interest in the recognition process and its application and in the self-assurance process;

4.  In addition, the Sports Councils may also disclose any information that you have given us to any body or person with statutory powers to demand it or to any other body or person for the prevention or detection of fraud;

5.  The Sports Councils may use the data you provide for their own research and to fulfil statutory reporting requirements. They recognise the need to maintain the confidentiality of vulnerable groups, and their details will not be made public in any way, except as required by law.

6.  The information which may be shared includes:

·  the information you give us on the application form;

·  any documents supporting your application;

·  the information you give us in connection with the self-assurance process; and

·  any documents you provide in connection with the self-assurance process.

7.  If you are successful in your application, the Sport Councils may publicise the fact that your sport or organisation has received formal recognition. The published information will not include personal information.

Freedom of Information

1.  Please note that the Home Country Sports Councils are subject to Freedom of Information Legislation. This means that anyone can request information held by them. This includes information supplied to the Sports Councils by third parties, such as yourselves. The Sports Councils are obliged to disclose the information unless one of the exemptions in the legislation applies. A list of the exemptions can be viewed here: http://www.foi.gov.uk/guidance/exsumm/index.htm.

2.  If you believe that any of the information you send us is confidential, or that one of the exemptions applies, you should indicate this when sending usthe information. Please indicate which particular parts of a document are confidential or exempt (please note that it is very difficult to exempt entire documents under the Act) and give reasons why you think this is the case. You may do this by completing the form below or you can write a letter or email with the information you are sending.

3.  You should note that any Home Countries Sports Council in receipt of a request will consideranyexemptionsbut must draw its own conclusions as to whether the information is, in fact, exempt. In relation to certain exemptions, the Sports Council in receipt of the request is also required to carry out the “public interest test”. This means that, even if the information falls within an exemption, the Sports Council must still consider whether the public interest in withholding the information outweighs the public interest in releasing it.

4.  If any of the Sports Councils receives a request for information which you have supplied, they will inform you prior to disclosing any information.

I have read and understood that the Home Country Sports Councils are subject to Freedom of Information legislation and may be obliged to discloseour information to other people.
