TERMS AND CONDITIONS FOR LEASING OUT MARKFED, MODERN RICE MILLS, MACHIWARA AND BAGHAPURANA FOR THE PERIOD 01.10.2017 TO 30.9.2020.

The tender shall be received as per two bid system i.e.

i)Technical bid.

ii)Financial bid.

Technical bid shall be opened first to evaluate the eligibility by the committee. Financial bid of the technically eligible tenderer shall be opened subsequently. Financial bid of only those tenderer shall be opened who quality the technical bid.

Technical bid:

  1. The technical bid shall include the following documents:-

i)Earnest moneyfor each rice mill Rs. 1,00,000/- (One Lakh) through online mode over e-tender portal.

ii)The proof of constitution of firm/company/partnership.

iii)Affidavit signed by all concerned that there is nodissolution/change in the constitution of firm.

iv)Photo copy of VAT/ST/CST no. issued by the concerned department.

v)Residence proof of authorized person.

vi)PAN Card of firm/company.

vii)The tenderer shall abide by the terms and conditions of the tender(To attach scanned copy of the tender terms).

viii)Proof as authorized signatory of firm.

ix)The party should not be a defaulter for delivery of custom milled rice of any Government agency for which they shall attach an affidavit with the tender. Likewise they will have to certify that no court case is pending between Markfed and the party in any court of Law.

x)A party which is financially sound and having paddy-milling experience will be eligible for selection. The party will produce credit worthiness certificate for minimum Rs. 50 Lacs from banker for each mill.

The tenderer shall upload the required documents in the technical bid on technical bid proforma.

Financial bid:

  1. The tenderer shall offer its quotation in the financial bid proforma.

Other Conditions

  1. Markfed Rice Mills, Machiwara & Baghapurana shall be leased out initially for 3 (Three) yearsfor the period from 01.10.2017upto 30.9.2020. The lease period would not be extended.
  2. The lessee will be bound to deliver the rice of KMS 2017-18, 2018-19 and 2019-20 upto rice delivery date fixed by Government of India/FCI whichever is earlier, failing which Markfed will be at liberty to dispose-off balance unmilled paddy at his riskand costof the party (if the paddy is allotted to Markfed).
  1. A party which is financially sound and having paddy-milling experience will be eligible for selection. The party will produce credit worthiness certificate for minimum Rs.50 Lacs from banker for each mill.
  1. The party should not be a defaulter for delivery of custom milled rice of any Government agency for which they shall attach an affidavit with the tender. Likewise they will have to certify that no court case is pending between Markfed and the party in any court of Law.
  1. The party should have its VAT No./TIN No. and Food Grain License No. and PAN No. etc. etc..
  1. All the Terms and Conditions mentioned in the tender form must be fulfilled and signed by the individual/firm/company and offer should be quoted in the Financial Bid.
  1. In case rice mills are allotted to Markfed by the Food & Supply Department then the lessor will provide the paddy stock as per paddy policy of Government of Punjab as per the capacity of the mill.
  1. The tenderer/party will have to make payment of lease money/milling charges on MTbasis and have to clearly mention in Financial Bid against the name of Rice Mill.The lease money will be enhanced by 5% every year.
  1. The party will be free to make additions like Sortex/Packing Machine etc. etc. in consultation with Markfed at his expenses. He shall remove the said machinery within 15 days from date of expiry of the contract.
  1. Markfed will hand over the charge of Rice Mills to the allotted party/parties and lessee will ensure the handing over of the same as per inventory duly signed by him at the time of taking over after the completion of contract successfully in running condition.
  1. That the party will arrange his own technical staff/labour, watch and ward staff to run the allotted rice Mills. Markfed will not provide any manpower in any manner to lessee. Markfed reserve the right to post any officer/official having access to plant and machinery for inspection at any point of time.
  1. In case the lessee arrange extra quantity at his level, Markfed shall charge the lease money at the same rate per MT for that paddy as quoted by the tenderer and accepted by Markfed. In this case, the paddy of Markfed shall be milled first.
  1. That all office expenses such as telephone, stationery, power and water charges etc. etc. shall be borne by the lessee. However, Markfed shall provide necessary connections of electricity/water supply etc. etc.
  1. All type of State and Central taxes, (excluding house tax), PF, ESI,SSS etc. etc. if any, will be borne by the lessee.
  1. Markfed will arrange the insurance of plant and machinery for theft, fire and flood and any other insurance will be arranged by the lessee.
  1. That the party to whom Markfed Rice Mill is allotted will have to deposit the security to the tune of Rs. 10 Lacs (Ten Lacs Only) (including EMD) in respect of each rice mill. The security amount to be deposited through Demand Draft/Bank Guarantee issued by the Nationalized Bank only to Markfed Head Office, Chandigarh in the name of “The Punjab State Cooperative Supply and Marketing Federation Ltd., payable at Chandigarh”, within the ten days from the acceptance of offer/allotment. The earnest money will be accounted for towards security after the acceptance of offer/allotment. No interest will be paid on security deposit. In case the tenderer fails to deposit the security the earnest money shall be forfeited & Tender shall be initiated at his Risk & Cost.
  1. As per the Paddy Milling Policy, Markfed cannot guarantee any volume of work.
  1. The security amount shall be released after the completion of contract successfully and submission of “No Due Certificate” byconcerned District Manager of Markfed.
  1. No covered capacity/godowns, surplus open space shall be handed over to lessee by the lessor except plant and machinery building, rice room and one rice packing godown having storage capacity of 1000 MT to 1500 MT. However, Markfed shall provide open space for the storage of paddy stock.
  1. The party is free to submit the bank guarantee issued by Nationalized Bank equivalent to security amount which will be valid for Six (6) months more from the expiry of lease period. The lessee shall be bound to hand over the charge of Markfed Rice Mill to the lessor on the date of expiry of lease period after vacating the same completely. In case premises are not vacated, Markfed shall be free to take possession of the premises in the presence of two witnesses independent.
  1. As per Paddy Milling Policy, owner is to provide guarantee and he will arrange guarantee of two owner Pvt. Rice Mills at his level.
  1. Markfed will provide polythene sheets, cover nets etc. etc. only if mill is allotted to Markfed for storage of minimum guaranteed quantity as per paddy policy of state government. However, wooden crates for the storage of paddy stock would be arranged by the Lessee.
  1. The offer should be valid for a minimum period of 45 days from the opening of the tenders. In case the party back out from this mandatory period then the earnest money shall be forfeited.
  1. The paddy storage, milling of the paddy and delivery of rice to the FCI shall be governed as per paddy policy of Government of Punjab and policy of Government of India for the relevant period & the lessee shall be entirely responsible to deliver the total due rice to FCI as per laid down policy/instructions of Govt. of India/FCI.
  1. The tenderer shall be bound to pay the lease money to Markfed at accepted rate at minimum guaranteed quantity as per paddy policy of Government of Punjab. The successful party/tenderer shall deposit Rs. 10 Lacs(Ten Lacs Only)for each mill in advance towards the lease money for the whole year through Demand Draft/Banker Cheque at Markfed HO, Chandigarh to be prepared in favour of Punjab State Cooperative Supply and Marketing Federation Ltd., payable at Chandigarh, with in fifteen (15) days after the allotment of contract and the balance on monthly basis in the form of postdated Cheques (in seven-seven months up to 31st March in equal proportion).
  1. In case the tenderers back out from the milling of the paddy during the pendency of agreement, the security amount shall be forfeited and remaining lease money for un-milled paddy shall be recovered from the tenderer by legal process.
  1. The failure or omission to carry out or to conserve any of the stipulation of this agreement shall not give rise to any claim against the seller i.e. Markfed and cannot be deemed as breach of this agreement, if the same shall arise from any of the causes namely political or administrative acts of any recognized or defacto Governments, epidemic, fires, accidents, caused by inundation of works, erruption and earthquakes, landslide, strike, lockups, go-slow tactics, electricity break down or power shedding affecting the godowns or office or the Markfed restrains restrictions of Governments to such extent as to render performance of the agreement impossible.
  1. Markfed will not be responsible for any omission caused by lessee.
  1. MD, Markfed, reserves the right to accept or reject any/all the offers with or without assigning any reason.

Arbitration

In case of any dispute arising out of the contract, the matter shall be referred to the Managing Director, Markfed, Chandigarh to arbitrate in the matter, who can arbitrate himself or appoint anybody as his nominee to arbitrate in the matter. The said arbitration proceedings shall be held under the jurisdiction of Chandigarh court only & as per provision of the Arbitration & conciliation ACT 1996.
