Theactivities,controlsandassessmentcriteriaintheunderlyingzoneapplyinthefollowingprecinctandsubprecinctsunlessotherwisespecified.Refertoplanningmapsforthelocationandextentoftheprecinctandsubprecincts.TheapplicableunderlyingzonesinrelationtoAlbanyCentreprecinctincludetheMetropolitanCentrezone(includingsubprecinctsA,BandC),BusinessParkzone(includingsubprecinctD),andPublicOpenSpace–CivicandCommunityzone.

2.Land usecontrols
2.1DwellingsinsubprecinctA
1.AnynewdwellingmustbesubjecttoanocomplaintcovenantenteredontothetitleandregisteredinfavouroftheNorthShoreStadiumandNorthShoreDomainTrust.
2.Thenocomplaintcovenantwillrequireanylandowneroroccupanttoforegoanyrighttolodgesubmissionsinoppositionto,orotherwiserestrict,noisefromconcertsatthestadiumwhichareinaccordancewithanyapprovedframeworkplan,anylawfullyestablishedactivities,anyapprovedresourceconsentforacontrolledorrestricteddiscretionaryactivityorliquorlicenserenewal.
3.Developmentcontrols
1.ForpermittedactivitiesintheAlbanyCentreprecinctandsubprecincts,thedevelopmentcontrolsin
theMetropolitanzoneortheBusinessParkzoneapplyintheprecinctorsubprecinctunlessotherwisestatedbelow.
3.1Compliancewith Precinct Plan 1
1.Developmentmustprovidethestreets(arterial,collectorandlocal)within20moftheirlocationasshowninPrecinctPlan1,exceptthat:
a.localstreet(mainstreet)mustjoinDonMcKinnonDriveinthesamelocationasthecollector(mainstreet)
b.localstreet(mainstreet)mustbeprovidedwithin10mofitslocationasshowninPrecinctPlan1.
2.Thedesignofallstreets,includingdimensionsanddesignfeatures,mustbeinaccordancewiththerelevantfiguresinAppendix11.5.1.
3.AllstreetsshowninPrecinctPlan1mustbetransferredtothecouncilaspublicroadsexceptthoseshownaslocalstreets(public/private).
4.ReservesmustbeprovidedinaccordancewithPrecinctPlan1.
5.Openairpedestrianonlyareaslongerthan50mmusthaveaclearwayof3.5mtoenableaccessbyemergencyvehicleswithanoverallminimumwidthbetweenbuildingsof12m.
6.Infringementofthiscontrolisadiscretionaryactivityexceptforthefollowingwhicharerestricteddiscretionaryactivities:
a.variationstothelocation,widthanddesignoflocalstreets
b.variationstothelocationofthelocalstreet(mainstreet),providedthatthealignmentfollowsthesecondaryaxisandisnomorethan20mfromthealignmentattheboundarywiththelandzonedPublicOpenSpaceCivicandCommunity
c.variationstothelocation,sizeanddesignof:

2.Buildingsonsiteslocatedalongthelocalstreetconnectingcollector(mainstreet)withMunroeLanemustnotbesetbackmorethan3mfromtheroadfrontageforthefulllengthofthebuilding.
3.BuildingsonsitesinsubprecinctCfrontingMunroeLaneandAppianWaymustnotbesetbackmorethan12mfromtheroadfrontageforthefulllengthofthebuilding.
4.Anydevelopmentnotmeetingthebuildingsetbackcontrolsisanoncomplyingactivityexceptforthefollowingwhicharerestricteddiscretionaryactivities:
a.Buildingsonsitesfrontingacollector(mainstreet)orlocalstreet(mainstreet),where:
i.
ii.
thebuildingsetbackisprovidedtoaccommodateplazas,eatingareas,arcadeentrancesandpedestrianthroughroutesassociatedwithagroundflooruseandisnomorethan12m,or

5.BuildingsonsitesinsubprecinctDmustbesetbackinrelationtothesetbacksshowninPrecinctPlan4.
6.SitesinsubprecinctDmustprovide10myardsetbacktoPublicOpenSpacezoneboundaries.
3.4Locationofparking
1.Groundfloorparkingwithinabuildingmustnotbelocatedadjacenttothestreetfrontageoranyspaceinpublicownership.Buildingsmustbedesignedtoaccommodateabusinessorresidentialactivity,dependingonthezone,betweenanygroundfloorparkingandthebuildingfrontage.
2.OnsitesinsubprecinctA,theremustnotbeparkingbetweenanybuildingandthefrontboundaryofthesite.Parkingmustbelocatedtothesideof,therearof,withinorunderbuildings.
3.OnsitesinsubprecinctCfrontingMunroeLaneandAppianWay,nomorethanoneaisleofparkingmaybelocateddirectlybetweenabuilding’sfrontageandthefrontboundaryofthesite.Allotherparkingmustbelocatedtothesideof,therearof,withinorunderbuildings.
4.Anydevelopmentnotmeetingthelocationofparkingcontrolsisanoncomplyingactivity,exceptforthefollowingwhichisarestricteddiscretionaryactivity:
a.groundfloorparkinglocatedadjacenttothestreetfrontagewithinabuilding,providedthatitdoesnotoccupymorethan20percentofthestreetfrontageofthatsite.

4.AssessmentDevelopment controlinfringements
4.1Mattersofdiscretion
Inadditiontothegeneralmatterssetoutinclause2.3ofthegeneralprovisionsandtherelevantassessmentcriteriaintheMetropolitanCentrezone,thecouncilwillrestrictitsdiscretiontotherelevantmatterslistedbelowwheninfringingadevelopmentcontrolintheprecinct:
1.CompliancewithPrecinctPlan1
2.Frontyard.
4.2Assessmentcriteria
1.CompliancewithPrecinctPlan1
a.LocalstreetsshouldbeprovidedtoensuregoodamenityandthesamelevelofconnectivityforpedestriansandmotoristsasthatindicatedonPrecinctPlan1.
b.ReservesandopenspacesshouldbeinasimilarlocationandofasimilarscaletothoseindicatedinPrecinctPlan1.
2.Frontyard
a.Anyreductionofthefrontyardshouldensurethat:

Theprivacyofresidentsisprotected
Thesafetyandamenityofthestreetismaintained.
b.OnsitesadjacenttoOtehaValleyRoad,anyreductionofthefrontyardshouldensurethatavisuallyappealingfrontagetoOtehaValleyRoadisachieved.
