2.Notification

3.2HeritageCovenant

1.Within6monthsofthelandinLongBaysub­precinctGbeingtransferredtotheCouncilandpriortoanyactivities(includinganyearthworks)occurringinthesub­precinctbeforethetransferhasbeencompleted,thelandownersofLongBaysub­precinctG(beingtheCouncilandtheownerofthetwoexistingdwellings)aretoagreeandenterintoaprotectiveheritagecovenantwiththeHistoricPlacesTrust,undertheHistoricPlacesAct1993.

2.Theheritagecovenantreferredtoinclause1abovemustbeforthelongtermprotection,conservationandmaintenanceofthehistoricheritageandlandscapesinthesub­precinct.

5.Earthworkscontrols

1.Thecontrolsinclause4.2oftheAuckland­wide­EarthworksrulesapplyintheLongBayprecinctunlessspecifiedbelow.

5.1General

1.AsitemanagementplanmustbepreparedforallearthworksintheLongBayPrecinctirrespectiveofwhethertheyareclassifiedasapermitted,controlled,discretionaryornoncomplyingactivity.

2.Allerosionandsedimentcontrolmeasuresmustbeinplacepriortoanyearthworksorsubdivisionactivitiesbeingundertaken.

3.WhereearthworksareundertakenadjacenttoanyProtectionAreas(includingriparianmargins),LongBaysub­precinctGandtheLongBayRegionalPark,aprotectivefencemustbeconstructedattheedgeoftheseareasandremaininsituforthedurationoftheworks.

4.Afterallconstructioniscomplete(includinghardlandscaping)inLongBaysub­precinctA,andLongBaysub­precinctBwithintheStreamProtectionAarea,reservesandopenspaceandallProtectionandManagementAreas,soilwhichhasbeencompactedasaresultofearthworksandvehiclemovementsmustbereconditionedtoaminimumdepthof400mm.

5.Fordevelopmentthatiswithinthecatchmentofstream1C,allsubsurfacedrainsmustdirectgroundwatertoexistingseepageareaspriortodischargetowatercoursesandtheremustbenodirectdischargefromsubsurfacedrainstowatercourses.

5.2Earthworks inExcessof 300m2 SurfaceArea ofBare Earth (30Hectare Limit)

1.AllocationsforearthworkswithinLongBaysub­precinctAandHandLongBaysub­precinctsBtoGmustbeonthebasisoffirst­come­first­servedrespectively.

2.Noearthworks(cut/fill)greaterthan300m2inareamustbeundertakenoutsidetheperiod1Octoberto30April,unlessanextensiontothatearthworksseasonisgrantedinwritingbyanauthorisedcouncilofficer(Theapplicationmaybegrantedorrefusedatthediscretionoftheauthorisedcouncilofficerhavingregard,withoutlimitation,toseasonalconditionsatthetimeoftheapplication).

3.Allexposedsitesmustbestabilisedpriorto30April(ortheendoftheearthworksseasonifanextensionpast30Aprilhasbeengranted).

4.Priorto1Julyoftheforthcomingearthworksseason,nosinglelandownerinLongBaysub­precinctsBtoGcanapplyforsiteworksconsentforgreaterthan21hectaresofexposedsurfaceareaofbareearthatanyonetime.

5.If,by1Augustofthatsameyear,earthworkconsentsforthatearthworksseasonhavenotbeenreceivedforallofthe7haintheLongBaysub­precinctAandH,thenapplicationmaybemadetoreallocateanyunallocatedamounttoLongBaysub­precinctsBtoG.

6.Earthworksareasaredeemedtobeexposedor‘open’fromthefirstdayearthworkactivitiesbegin(thefirstdayearthworkmachinesmoveanyearth,includingtopsoil),untilthedaythesitehasbeen‘closedoff’andtheentireearthworkedareaisstabilisedagainstanypotentialsedimentbeingdischargedinto

thereceivingenvironment.

Monthlyreportingoftheareaexposedandclosedoffinthatmonthandanyprecedingmonths,andtheexpectedexposedareaintheremainderoftheearthworksseason,mustbeprovidedtotheCouncil.

Extensionsofaconsentedearthworkingscheduletoaccommodateseasonalconditionsmaybemadeinaccordancewithclause2above,providedthattheaggregateareaexposedbyallliveconsentsdoesnotexceedthelimitssetoutinActivityTable5a.

Extensionsofaconsentedearthworksscheduleintothefollowingearthworksseasonmaybegranted

inwritingbyanauthorisedcouncilofficer,havingregardtotheareaofearthworksproposedforthatyearascontainedinallliveconsentsfortherelevantsub­precincts.

1.Anyapplicationforsubdivisionmustcomplywiththefollowingcontrolsforproposedroads,stormwatermanagement,protectionareasandmanagementareasinclauses6.2to6.10below,aswellasthesubdivisioncontrolsspecifictoeachsub­precinctinclauses6.11to6.18below.

6.2Proposedroads

1.TheProposedRoadsshowninPrecinctPlan1,4and5mustbeprovidedinaccordancewiththealignmentsshownandthestagingofsubdivision.

2.AllProposedRoads(otherthanGlenvarRidgeRoad)mustbeprovidedwithaseparateshouldercyclelaneineachdirection.

3.On­streetparking(otherthanGlenvarRidgeRoad)mustbeprovidedonbothsidesoftheroadinordertosatisfytheon­streetparkingrequirements.

4.TheProposedRoadsmustprovidetheroadwidthsshowninPrecinctPlan5.

5.TheGlenvarRidgeRoadmusthavea9mwidecarriagewayplannedwithinthe22metreroadreservesoastoprovidetwo4.5mwidetrafficlanes.

6.ToensurethesafetyofcyclistsontheGlenvarRidgeRoadtherewillbenoparkingpermittedonthe9mcarriagewayandparkingwithintheroadreservewillonlybepermittedifitcanbeindentedandshowntooperatesafely.

7.ProposalstoalterthealignmentofaProposedRoadbymorethan20meithersideofthecentrelineofaroadatanypointalongitslengtharenon­complyingactivities.

WithinLongBaysub­precinctBwithintheStreamProtectionAareaadjacenttoVaughansRoad,thereshouldbenomorethanonestreetconnectiontoVaughansRoad.Inthisarea,theuseofjointaccessways/lotstoaccessrearlotsfromVaughansRoadshouldbeavoided,althoughindividualdrivewayaccessisappropriateforlotsthatfrontVaughansRoad.

Roadsandreservesshouldprovideforthemainpedestrianandcycleconnectionsthroughthearea,withdedicatedoff­streetlinksprovidedwheretheywouldmaintainandenhanceconnectivitywherevehicleconnectionscannotbemade.
