6.6Affordablehousing
1.ThefollowingdevelopmentcontrolsdonothavelegaleffectuntiltheUnitaryPlanisoperative.
1Developmentcontrols
1.1Numberofretainedaffordablehousingdwellings
1.WhereanewdevelopmentwithintheRUBcontainsmorethan15dwellingsorinvolvesthecreationofmorethan15vacantsites,atleast10percentofthetotalnumberofdwellingsorvacantsiteswithinthedevelopmentmustberetainedaffordablehousing.Whereaframeworkplanapplies,thisrequirementappliestotheentireframeworkplanarea.
2.TherequirementforretainedaffordablehousingdoesnotapplytoanydevelopmentthatissolelyprovidingsocialhousingdeliveredbyHousingNewZealandoracommunityhousingprovider.
3.Wherethecalculationoftherequiredretainedaffordablehousingresultsinafractionaldwelling,anyfractionwillbedisregarded.
1.2Location ofretainedaffordable housing
1.Withinhousingdevelopmentsofdetachedandterraceddwellings:
a.theretainedaffordablehousingmustbespreadthroughoutthedevelopment,withnomorethanthreeinanyonecluster
b.thefloorareaoftheretainedaffordablehousingmustbesimilartothatofmarketratehousingwithinthedevelopment,althoughsitesizesmaybesmaller
c.theretainedaffordablehousingmusthaveasimilarrangeofdwellingtypesandsizestothatprovidedelsewhereinthedevelopment.
2.Forapartments,theretainedaffordablehousingmustnotcomprisemorethanonethirdofthedwellingsonasinglebuildinglevel.
1.3Securingretainedaffordablehousing
1.Exceptforretainedaffordablehousingprovidedbyacommunityhousingprovider,retainedaffordablehousingmusthavealegallyenforceableretentionmechanism,including,butnotlimitedto,acovenantsupportedbyamemorandumofencumbranceregisteredonthecertificateoftitleorconsentnoticeundertheRMA,that:
a.limitsrentorresale(includingafuturedwellinginthecaseofavacantsitesubdivision)toanoccupierwhoisapprovedbythecouncilasmeetingtheeligibilitycriteriabelow,or
b.limitsresaletoacommunityhousingproviderapprovedbythecouncil,or
c.limitsrentandresaletoaformulathatensuresthatthedwellingremainsaffordableintothelongterm,includingafuturedwellinginthecaseofvacantsitesubdivision,and
d.providesformonitoringofthetermsofthecovenantorconsentnoticeandtheprocessshouldthosetermsbebreachedincludingwhereoccupiershavedefaultedonthemortgageandlendersseektorecovertheirinterestsintheproperty,and
e.islegallyenforceablebythecouncilinperpetuity.
1.4Eligibilityforretained affordablehousing
1.Retainedaffordablehousingmustonlybesoldorrentedtoeligiblehouseholds.Aneligiblehouseholdiseither:
a.acommunityhousingproviderwhoisregisteredwiththecouncilasbeingapreapproved
purchaser,andwhosecriteriaforrentingand/orsalemeetstheeligibilitycriteriasetoutin2below
b.ahouseholdassessedbythecouncilasmeetingtheeligibilitycriteriain2below.
2.Tobeeligibleforretainedaffordablehousing:
a.atleastonememberofthehouseholdmustbeandwillremainaNewZealandresidentorcitizen
b.atleastonememberofthehouseholdatthetimeoftheapplicationtocouncilmustbeemployedonatleastaparttimebasis(morethan20hoursaweek)withanemployerwithinAuckland
c.thepropertymustbeusedexclusivelyasthehousehold’sprimaryresidence
d.householdsthatseektopurchasedwellingsmusthavesufficientassetstoprovidetherequireddeposit
e.Householdsmusthaveanincomeofbetween80and120percentoftheregionalmedianhouseholdincome.
3.HouseholdswhohaveassetsthatwouldenablethemtomeettheirhousingneedsinAucklandwithoutrecoursetoaffordablehousingwillnotbeeligibletorentorownretainedaffordablehousing.
2.AssessmentDevelopment controlinfringements
2.1Mattersofdiscretion
Inadditiontothegeneralmattersinclause2.3ofthegeneralprovisions,thecouncilwillrestrictitsdiscretiontothemattersbelowforthelisteddevelopmentcontrolinfringement.
1.Numberofretainedaffordablehousingdwellingsandlocationofretainedaffordablehousing
a.provisionofretainedaffordablehousingoffsite
b.locationofaffordablehousingwithinadevelopment.
2.2Assessmentcriteria
Inadditiontothegeneralassessmentcriteriainclause2.3ofthegeneralprovisions,thecouncilwillconsidertherelevantcriteriabelowforthelisteddevelopmentcontrolinfringement.
1.Numberofretainedaffordablehousingdwellingsandlocationofretainedaffordablehousing
a.Provisionofretainedaffordablehousingoffsite
i.Retainedaffordablehousingshouldbeprovidedwithinthedevelopment,however,offsitelocationsmaybeconsideredforallorpartoftherequirementif:

ii.
thealternativesitesareincloseproximitytothedevelopment(i.e.within1km)andofferasuperioroutcomeintermsofaccesstoservicesandtransportandcommunitymix.Particularconsiderationwillbegiventowhethertheoffsiteprovisionwillleadtoamorebalancedcommunityandwhetherthealternativelocationwillbetteraddresspriorityneeds,particularlyfamilyhousing,or
theapplicanthasenteredintoalegallybindingagreementwithacommunityhousingproviderwhocandemonstratethatonsiteprovisionwillnotmeettheiroperationalrequirementsandthatanoffsitelocationwilldeliverasuperioroutcomeintermsofthenumber,mixand/orongoingmanagementoftherequiredretainedaffordablehousing.
ii.
Theprovisioninwholeorinpart,oftherequiredretainedaffordablehousingintheformoflandonly,ratherthandwellings,maybeappropriatewheretheapplicanthassecuredanagreementwithacommunityhousingproviderthatwillprovideasuperioroutcome.Inthiscase,thevalueofthelandtobetransferredtothecommunityhousingprovidershouldbeatleastequaltotheinferredvalueoftheretainedaffordablehousingrequirements,asdeterminedbyavaluationbyaregisteredvaluer.
b.Locationofaffordablehousingwithinadevelopment

Whereadevelopmentdoesnotcomplywiththelocationcontrolsforretainedaffordablehousing,theapplicantwillneedtodemonstratethattheretainedaffordablehousingisspreadthroughoutthedevelopmentandareofasizeconsistentwithotherdwellingswithinthedevelopment.
Someclusteringofretainedaffordablehousingwithinasitemaybepreferablewherethedwellingsaremanagedbyoneentityandfromanoperationalperspective,clusteringwillprovidelongtermbenefitsintermsofmanagementandmaintenanceoftheretainedaffordablehousing.
3.Specialinformationrequirements
Affordablehousingassessment
1.Allresourceconsentapplicationsinvolvingtheprovisionofretainedaffordablehousingmustbeaccompaniedbyanaffordablehousingassessment.Theassessmentmustspecifyhowthedevelopmentwillmeetthedevelopmentcontrolsforretainedaffordablehousingandincludedetailsof:
a.theexpectedtotalnumberandtypeofalldwellingswithinthedevelopment,includingretainedaffordablehousing
b.thepercentageofnewdwellingsthatwillberetainedaffordablehousing
c.whererelevant,thestagingofthedevelopment,includingthetimingofprovisionoftheretainedaffordablehousing
d.fortheretainedaffordablehousingcomponentofthedevelopment:
i.
ii.
iii.
iv.
theproposedprice(includinganyproposedvariancesforapproval)
thelocation,designandformofthedwellings,includingtheexteriordesign,theirsizeandinternallayout,includingnumberofbedrooms
iftheretainedaffordablehousingisproposedtobeprovidedoffsite,detailsofhowthatwillbeprovidedinamannerthatmeetstherelevantassessmentcriteria.
detailsoftheproposedretentionmechanismiftheretainedaffordablehousingisnotprovidedbyacommunityhousingprovider.
